  • Visa L1 - EAD - Please Help

    Hi all,

    Currently, I have L1 visa and I-94 will be expired 2015. I don't know with L1 visa and I-94 like this, can I apply EAD?

    How many percent and how long do I got approval? Which document do I need to provide when applying?

    What EAD are you talking about? You don't need an EAD to work in L1 status? Are you in L2 status trying to get an EAD based on your spouse's L1 petition? If yes, then when does the L1 petition expire? Visa expiry date is irrelevant here. When you ask a question, provide proper information, otherwise it is hard to help.

        Thank you for your quick response. Currently, I want to change to another company and some of them only accept EAD, H1B, etc ... (DON'T accept L1 visa) so I ask this question. Can I apply EAD when I am working in L1 status? I think we can, is it correct?

          There is no such thing as applying for EAD while on L1. The only way to get an EAD in your case is if your employer starts the GC process. It will take years to get the EAD if filed under EB2 or EB3 category of Green Card. You cannot switch employers in L1. Filing H1B is the only option.

              >>> I already answered this in the previous reply. You need to find an employer who can sponsor H1B for you. The effective date of the H1B will be on or after Oct 1st. Until then, you should work for the L1 employer and get paid to maintain the L1 status. The H1B should be filed when the annual CAP is open. The CAP is open right now. You cannot work for any other employer until the H1B petition getsa pproved (with a new I-94).

              One more question, Cac I apply Green Card by myself without support documents from company? I have SSN, Visa and I-94 and they are enough to apply Green Card?
              >>> You cannot sponsor your own GC. You have to do a lot of reading on the basis things. Read the links in the GreenCard section of immihelp. If your parents or siblings (over 21 years of age) or children (over 21 years of age) are not a U.S citizen, then the only option for GC is through employer. It will take years to get the GC.
