  • L1 Extension - i-797 lost

    Hi

My husband is on L1 visa. His visa is expiring on 11th sept. 2012.
He wanted to go to Canada and for that he applied for a Canadian visa. He sent all his original documents to Canada embassy in Washington. He got his passport back with Canadian Visa stamp but he didn't got his original i-797 form back. He contacted the agency through which he applied for Canadian visa but they says that its neither with them nor with the embassy. Its been misplaced somewhere and they can't find it. Now my husband has to apply for his L1 extension and he doesn't have his original i-797. What should he do in this case? pls help.

A copy of the previous approval notice is enough to file the extension. There is no need to send any original to USCIS while filing the extension.

Thank you so much Shervin143. And also how can we apply for a duplicate 797?

You cannot apply for it. Only the employer can request a duplicate approval notice.
