    Hello there! im from Argentina and I'm in NYC on a B2 visa.
    I'm a performer so I came here to train, and since the option of taking seminars and private lessons was more suitable for me that getting into college is that I've been doing it that way instead of a student visa.
    I applied to an extension visa last october, understanding that I can extend my stay for 6 more months.
    I received the confirmation letter but still havent received a final answer.
    Reading information about the process I understand I can be in the country legally waiting for an answer, but theres some confuse information between being allowed for no longer than a year, but waiting for an answer of the application, it says you can wait 240 days or the USCIS resolution, whatever comes first.
    This doesnt really make sense since 240 days are around 8 months, so, I've made plans to leave before my year here is due, but im worried that without a firm answer from USCIS my most recent I 94 shows that my latest entry should have lasted till december.
    I wanted to know what happens if I leave in the middle of the process, since I dont want to have problems if I wanna visit the country in the future, and with my profession I most likely will.
    I've tried contacting via phone and submit a inquiry about my case and the answer every time is that its within the processing times (its an automatic answer tho)
    I'd really appreciate any kind of advice or information.

    You can leave the country in the middle of the process. there is nothing bad about leaving without the extension being decided. And in fact, waiting until a decision could be worse because there is a risk that it's a denial. Extensions take around 3-5 months to process these days. You must have received I-539 receipt. Please save that receipt to prove in the future that it was filed while you were still in status and you left while it was pending.
