    Hi There,

    I am from Australia and arrived in the USA in April valid for 5 years (multiple entry). When I arrived in LA I was informed I have to leave by October and I am not allowed to renew this by going to Mexico or Canada. The reason why I am on this visa is because I have a boyfriend who lives in the US and I am staying and travelling with him and his family for the duration of my stay. I have a few questions regarding reentering the USA so I hope someone is able to give me some help.

    * Going to Mexico/Canada is not an option so I will have to leave the continent - I am wondering how long I will have to leave the country for in order to be allowed back in the US? Also when I do leave and if I get allowed back in, will I have to leave the country every time I need to renew my visa?

    *If I leave the country before October and go to another country for a few weeks, will that change the October date I have to exit by?

    You can not use a B visa to live in the United States

      Every time you enter the US they stamp an exit date on your passport and you have to leave by that date and re-enter again. No need to renew the visa because you have 5 years multiple entry. Yes, every time you enter, they will stamp a duration of stay. However if you keep re-entering frequently that can be construed as misusing the tourist visa to live in the US and your visa can be cancelled.

        Thank you for your reply. Do you know how long you have to leave the country for? Or if it's advised to leave for a few months?

          There is no written duration in the rule book , the immigration officer decides based on the pattern of entry and exit and the duration stayed in US versus outside to determine the nature of usage of the tourist visa. It is just a common sense thing. For example if you stay in US for 4-5 months and come back in a month and repeat this pattern a couple of times it will raise red flag.
