  • mother's visa

    Hi All,
    My mother visited US twice before and left India in time (she got single entry visa both times) and got rejected twice now (once in Jan06 and Feb07). The only reason for rejection we could see is we are two brothers and both are living in US and my mother is a widow. So they could see her as a potential immigrant. I became a USC after my mothers 2nd rejection and planning to appy for a GC for her asap. I am hearing the following versions from people I knew,

    1. I could apply I130 and go for consular processing
    Or
    2. Apply for Vistor visa again and if she gets the visa then apply for 485 in US

    So my questions are;
    which option is better?
    what are the actual steps needed in option 1 after I-130?
    If I try option 2, what would be the best way to approach? Should I go for a Senator recommendation?

    Also I am visiting India in July so I want to make a quick decision on the options.

    Any input is greatly appreciated.

    Depends upon whether she is really planning to stay here most of the time or occsionally.

    If most of the times, try for green card. Otherwise, try visitors visa.

      mothers' visa

      Thanks for the info but I am still confused on which option to choose. She may not stay here for long time but should have a flexibility to come to US whenever she wants. Looks like it is going to take atleast over a year for complete process of getting a GC. We are looking to bring her as soon as possible. Is going for a travel visa risky after submitting the I130? or is better try for travel visa one more time now and apply for I130?

      Please advise..
