  • Vistor Visa's - Special Situation

    Hi,

I am a US Citizen and have recently entered a marriage with an immigrant that is currently out of status. We are currently going through the green card process with our lawyer and have just sent in all the necessary paperwork to immigration services.

My wife's mother is currently in Russia and would like to come to the US as a temporary vistor to see her daughter. If the mom applies for a visitors visa, can this have a negative impact on our green card process?

My concern is that when the mother applies to come to the US, the consultant will see that her daughter is currently out of status and perhaps this can trigger some further investigation into our marriage, or stall the whole process altogether.

Any feedback would be much appreciated...can this happen? Perhaps I’m just over thinking this...

Perhaps some additional background information that explains why you think there is minimal risk? I am unfamiliar with the visa process and I don't want to have it jeopardize the current green card process.

It is very difficult to make guesses about an applicant's chances based on the limited information they provide on the forum.

The risk you mentioned about your spouse's currently illegal status is definitely valid. So if it is not an emergency do not invite her mother.

The other option is to go in for a paid consultation with a immigration attorney with your spouse's complete file.
