  • In-laws second visit to US ?

    Hi,

    My inlaws came to USA on B2 visa in Oct 2010 and will be leaving by the end of March 2011 (12 days lesser then their valid 6 month stay). After they came here, we got to know that my wife is expecting a baby by June 2011.
    We were contemplating whether to file for an extension for her parents or just let them leave the country for now and arrange for them to visit again in June. As we are being advised against extensions, we probably wont take that route.
    I have read the forums that it is safe to have a 6 month gap between 2 visits and also the info in the link https://www.immihelp.com/frequent-vi...visitors-visa/

    - If we arrange for them to visit again, would it be an issue for them to visit within 3 months (2.5 months really) ?

    - I have heard cases where parents were allowed entry to US for another term of 6 months within 2-3 months of their return.
    Under what circumstances can they be allowed entry ?
    Do we need to show any documents or ties to the home country so as to avoid them getting a limited stay No EOS on their Visa or worst case, getting rejected ?

    - Also heard that if the parents are old, have property in India and do not violate any regulations while here, they are usually allowed entry within 2-3 months. Also the fact that they would now be returning in summer, can this be used as an advantage for our situation?

    - Heard 2 visits in a year is risky, would that mean that calender year? My in-laws arrived here in Oct 2010 and their next visit would be in June 2011. Is this safe ?

    Based on the situation, appreciate if you can advise what action to take.

    If I were you, I would file for an extension, rather than visit so soon again.

      Thanks for the reply..!

      Extension may not be very feasible for us, as my wife sponsored the visa and she is now moving as a dependent.
      Could you please provide a reply for each of my questions in the original post ?

        Extensions without really genuine reasons are rarely approved.
        As a rule of thumb Visitors should spend more time outside the US than inside.
        This is my opinion and not legal advice.
