I-539 Filed for Aunt but I-94 Expires on Oct 12, 2012
Hello:
I need help with the following:
1) My Aunt is here on Tourist visa B2. She eneterd USA on April 13th, 2012
2) Her I-94 Expires on Oct 12th, 2012
3) We file for her Extension I-539 with USCIS on August 27th and receive notification that her I-539 is in process with Vermont Service Center - but Vermont Service center is processing applications from May 7th, 2012. It will take 3 months or more to process the application.
4) I am confused now - should I send her back on Oct 12th when the I-94 expires?
5) For some reason if the application is denied and she stays after I-94 expires? What will happen? Has Anyone been in this situation?
6) Is there is something we can do to speed up the process?
