  • Got the RFIE today. It is for Form I-864 for petitioning sponsor. We submitted the I-864W for my husband (beneficiary) since he qualifies for one of the exemptions (over 40 ss credits), but I had no idea that I, as the US spouse petitioner, also had to submit the I-864 for myself? Please share thoughts!

    07/02/20 Interview has been scheduled (waiting for notice)
    08/27/20 Interview/Card being produced!
    08/28/20 I-485 and I-130 Approved
    09/04/20 Card was mailed to me
    09/10/20 GC in hand

    • Here’s the exact wording:

      - Submit a complete and signed Form I-864, Affidavit of Support, for the petitioning sponsor listed on Form I-130. Even if a joint sponsor will be used, the petitioning sponsor must submit Form I-864. Also provide copies of the petitioning sponsor’s most recent Federal income tax returns and all supporting tax documents. If you have submitted Form I-864, the version you submitted is no longer accepted. You must submit Form I-864. All pages must be present and of the latest edition date.

      If the applicant qualifies for one of the exemptions on Form I-864W, please submit a completed and signed Form I-864W.

      Fir further instructions and the latest edition of Form I-864 (or I-864W), visit the USCIS website... etc”

      So my question is do we simply resubmit the Form I-864W — maybe they lost it? — or do I (the petitioner) also need to submit the I-864?

      • Sorry to keep posting. Talked to an attorney friend who said RFIE isn’t asking for both forms. If my husband qualifies for the exemption, we simply need to re-submit the I-864W with supporting documentation. Forms must have been misplaced or overlooked in the initial package.

              Received Nov 4th& Priority Date also Nov 4th
              I130 i485 & work permit (did not apply for travel documents )

              Nov 15 received 2 hard copies for NOA
              Nov 22 Received biometrics appointment Notice
              Biometrics done, Dec 2nd.

              Jan 6 2020 courtesy letter for missing medical (dated Dec 31 2019, mailed Jan 2nd 2020)
              Ready to be scheduled for interview (Jan 31st 2020)

              • How my case still has no response after fingerprints done.
                pd 9/27, 11/1 fingerprints done.
                is this because I filled in Bayarea CA
                San Jose F1 AOS with UC 4 forms
                9/24 2019: Sent 4 forms to Chicago
                9/27 2019: PD
                11/1/2019 : Fingerprints done
                12/13/2019:Case is ready to be scheduled for an interview
                1/21/2020: Interview was scheduled
                2/25/2020 12pm: we interviewed in San Jose.
                2/25/2020 5:00pm: I-485 new card is being produced.

                  • I received biometrics notice for 12/17/2019 , the web site my uscis or any apps didnt update! Notice date is nov 19 so they are slow in updating online status

                          Likewise mine too. I called to ask about my biometrics notice and the rep said he saw nothing being mailed out to me. That same day I got my bio appointment in the mail. No updates on line or anything.

                                11/21/2019 Called USCIS right when they opened and was told Notice for I130 mailed out on the 20th and was given receipt number

                                11/26/2019 Received all NOA notices via postal mail
                                12/06/2019 Received Biometrics for 12/18/2019 dated 11/29/2019
