I-485 - Case was transferred to a new jurisdiction

    The case was transferred from NBC to Nebraska on Aug 2021.
    Yes, got EAD/AP on Dec 2021.
    Medical was not filed along with initial application.. thinking of doing interfiling.
    No chat with Emma, i dont think it will be fruitful by any means as they always gives links to standard USCIS links which we all are aware of.

    It will be 16 month since I485 has been filed, 13 months since transfer, 12 months since I140 approval.
    Sometimes, I tend to check my I140 status also to see if it stays under approval or whether it moved back to some other status that i m not aware of

    NBC timelines is 16.5 months and Nebraska is 18 months.. So i m inside the bracket of both centers. Not sure if there is any ray of hope.

    Ohh yeah i wonder why they are transferring to and fro. Honestly with USCIS, you just never know what they are upto. They just surprise you. Their customer care also sucks. These days made it really hard to get to the actual person. Let's just hope for the best. All the best to you and hopefully you get it soon too.

    My filing date is May'21 but I am still waiting for my case to be transferred to NBC. It was originally in NBC and then had transferred it to Nebraska only to be transferred back to NBC..! I don't understand the logic based on which they operate. I am keeping my fingers crossed that I should get my GC before EB1 retrogresses.

    I believe USCIS had responded to a law suit where this information was shared, shortly before the Oct visa bulletin was published. Unless they have already blocked some visa numbers, you might have to wait until Oct to get your GC. Just my understanding. Good news is that considering EB1 is current, you would get fresh visa numbers in Oct so you should get it in Oct. All the best.

    shiva_82 India is the country. My filing date is July,21 under EB1 current and we have received everything else from USICS.. We got the letter for Medical on Aug 19 that if we want the GC send the i-693 immediately. So I am hoping they would still. Where did you find out that they are not issuing any more? Any article?

    When I said they won't issue any GCs this year for EB1,2 & 3, I meant no GCs is expected to be issued for these categories until end of Sep. From Oct a new year starts where there will be new visa numbers available for allocation from DHS. If your date would still be current in Oct then you will get your GC. If your date is not current in Oct visa bulletin, then the chances of getting GC until date is current is very very less.

    Hope it's clear. Btw, I'm not an attorney, whatever I shared above is based on my research based on USCIS publications and other news.

    Because they believe that with the visa numbers coming available in 2023, they will be able to allocate visas to all pending AOS cases. May be as months move by, if they continue to get demand greater than what they anticipate, they might retrogress EB1. That's the scary part because with the dates being current, so many people can file and also because they don't process applications based on a certain order, there is a possibility that people even while their priority date is a few years earlier, might get missed out even while new filers from 2022 or 2023 get GCs. Scary...!
