I am holding H1 and married to a US citizen . I want to apply for Change of Status and my wife will file I-130 for me .
I have some questions on the process .
1) Can she file I-130 first and I will file I-485 later . If yes , where will she file this ? Chicago Lockbox or Nebraska (for Utah) ? I hope the relevant documents in this case would be her birth certificate , G-325A for her , G-325A for me , passport copies , her photo (1 copy) , my photo (1 copy) . Am I right ?
2) As I am holding H1B I can work in US ? Do I need to file for EAD separately ? If I want to change my employer , can my H1 be transferred to the new employer ? Can I file I-765 at a later point of time ?
3) Our marriage is 2 months old and my wife does not wark . Whe has to file I-864 (Affidavit of Support) for me . Can she use my income ? I have worked in US last 4 years and I have all the documents available . Is there any criteria , that we should be in the same household for at least 6 months before she can use my income ?
4) Apart from my ideas what is the best way to file for Permanent Rendency in my case ?
