Very confused about i751 waiver
Hi guys,

I am very confused on how this whole waiver process works, if someone can shed some light here, please.

Currently doing through a divorce.. filed i751 jointly. Nov 2019 case, so expecting a response like 2-4 months based on current processing.

So I consulted two different lawyers.

One says stay put until you have the actual decree. If you get an approval before divorce is finalized then congrats. Else with the decree, change the case to a wavier.

Other lawyer says, I need to inform USCIS right now that I am going thru a divorce and change my application to divorce waiver. (But how can you change that if you don’t have the decree in hand yet?). He says if I don’t inform now and get an approval pre decree, then it will become an issue during citizenship process.

Other issue I am confused about. My soon to be ex is extremely vengeful and I am surprised she hasn’t withdrawn the case yet…. Or has she and I never received a notice? Can that happen? If so, am I out of status? How can I verify?

I’ve a few doubts if someone can help me, what is the documents order inside of the package to send to USCIS?

My green card will expire on September 19, I know that I just can send the package 3 months before the green card expire, but can someone tell me the exact day that I can send it?

I applied for my i751 in March 2020 still my case stucked with uscis my receipt number starts with msc and my case statutes updated ready to schedule for an interview since Jan 20 2021 but I haven’t heard anything back from them regarding interview date n time.any one in same situation or any one got their interview done recently..I lives in Pennsylvania and my asc center will be Philadelphia I guess.

December 9, 2020 We transferred your Form I-751, Petition to Remove Conditions on Residence, to another USCIS office that now has jurisdiction over your case.

December 8, 2020 Your Form I-751, Petition to Remove Conditions on Residence, was transferred to another USCIS office.

June 13, 2020 The fingerprints relating to your Form I-751 Petition to Remove Conditions on Residence, were taken.
