EAD expedition: USCIS? or Congressmen?
Now I'm out of normal processing time of EAD for my center (Texas center, NIW concurrent with C9 EAD)

So, I'm about to submit an expedition request. Where should I need to submit? USCIS or Congressmen?

EAD
Hello,
I haven't seen any discussion on this topic before. I got a job offer from the Texas state agency. Application filled for EAD on 11/16/2018. Receipt date 11/28/2018. My center is Potomac (Virginia)
My job offer letter said start date for January 14, 2019 but I wasn't able to start as I didn't have my EAD card.
State agency sent a letter to USCIS for expediting the process on January 15. I received an email from USCIS saying that they have received the correspondence and are reviewing it on February 1, 2019. On February 7, 2019 I again received an email from USCIS saying that we initially received your application on January 24, 2019 and there have been no update since. I haven't called USCIS once. I have also read people involving Congressman to expedite the process. But I'm not sure since the State agency only sent a letter to USCIS. It would be great help if any one can give their input on the same. Thank you

L2 EAD renewal processing time 2019
Hi,

I requested an L2 EAD renewal. My details:

Nov 7 2018: Case received

Its been over 90 days but there is no change in status. My previous EAD expires on 11th March. Just want to see what best I can do to expedite the renewal.

Has anyone applied in Oct/Nov 2018 and is the case approved? Did anyone raise a Service Request? Please advise. Thanks.

EAD Expedite Rejected
I485 PD: Sept 2017 NYC
EAD Renewal Application PD: Aug 1st 2018
EAD original expiry date: Nov 2018

My EAD renewal application is up to 6 months now so I have been trying to make sure it is not one of the forgotten cases. Here is what I have done so far:

July 27th 2018: EAD renewal received by USCIS, notice date is Aug 1st.
Jan 25th 2019: Contacted congresswoman for help expediting
Feb 2nd 2019: Received letter from Congresswoman saying they were working on it
Feb 4th 2019: Called USCIS to request expedite on financial hardship as I am only worker in family, wife is student, we have a newborn and all insurance/income comes from my job, they told me that this was the first request so looks like Congresswoman's office has not done anything so far.
Feb 7th 2019: Email received from USCIS saying that due to high number of requests they are following the guidelines strictly and I don't fit them. They directed me to check if I was eligible for the automatic 180 days extension, which I am.

I wasn't even asked for proof of hardship, I think that because I have 3 months left on my first EAD auto renewal they have rejected the expedite even though it's also outside normal processing by their standards. I wonder if I have to run out the extension and lose my job before I we will becomes eligible for expedite?

I now have to hope my EAD comes through before May else my family is really in trouble, not a position I want to be in.

EAD after Expedite
I am a silent reader on this thread and i just thought to share my experience.

PD: November 1, 2018 (Married to USC, First time EAD)

I got a job offer on January 2nd with a tentative start date of January 29, and on the 3rd i called USCIS to request an expedite. The tier 1 lady i spoke with didn't put my request down the way it was supposed to be, and that very day i request got rejected. So i called back that evening and spoke to a tier 2 representative who didn't have much info to give me but a number to fax my supporting documents to, i did that the next morning (funny enough the document wasn't acknowledged because it wasn't required of me officially) and also googled my congressman's and senator's branch offices close to me and went there to ask for assistance. I filled out the required forms there in their offices and they assisted with the expedite immediately.

On January 9th, i called again to expedite and i spoke to a tier 2 officer who helped with the expedite and was well detailed in putting in my request, the next day i got an email to send my supporting documents, did that the same day which was January 10. And i got updates from my congressman and senator's office the week after that my case has been received and has been requested for adjudication. So i waited, although i kept calling USCIS almost everyday but they didn't have any kind of update. One officer i spoke with told me "they haven't responded because my evidence wasn't solid enough, and they would reject it". It made me sad but didn't deter me from calling again. I set up an info pass appointment that day to go in to talk to them myself.

January 24 i got an email that said that on January 23rd an RFE was mailed to me, it made me really sad and ruined my day but i knew it wasn't going to stop me. I got the RFE in my mailbox on January 26 which was a Saturday, and i mailed the requested document back on January 28 which was Monday, i used overnight shipping option and so it got there on Tuesday. On Thursday i got an email that the response to my RFE was received. All the while my Senator and Congressman were also updating me with the emails i got from USCIS, i think they get the update too as i get them from USCIS.

On Monday February 4, i went in for my infopass appointment, when i got in there the network service on my phone was bad and i couldn't receive texts or calls. So i met the guy there, and he told me there was nothing he could do about my case because the decision rested upon the case officer and he said the only thing he could do for me was to check his system for the status on my request, lo and behold he checked and said my application had been approved a couple of minutes earlier. I was so happy, when i got out of the building and network service came back to my phone i got the email and text that my card was being produced. And on February 6, i got an email that my card has been mailed to me. So including my RFE my expedite timeline was less than a month (January 9 - February 4).

Thanks to everyone that shared their story which gave me hope when i was down. Goodluck to everyone else still waiting on their positive response. Cheers

Over 6 Months Since Applying & Still No Update
Here Is My Husbands Timeline, We Applied For His EAD + Greencard Under C9.

Sent Application: July 8th, 2018
App Received: July 11th, 2018
Biometrics Done: August 14th, 2018

Thats It....No Response From Them. I've Called Multiple Times Without Any Proper Reply As To Whats Going On. When I Hit 6 Months Since Applying I Called Them To Submit A Query With The National Benefits Center As To Why His Case Is Taking So Long For A Decision. They Said I Should Receive An Email Within A Month. I Did Receive An Email From USCIS But It Seemed Like A Standard Email. It Said That A Decision Is Yet To Be Made On The Case & We Last Took Action On Your Case On October 31st, 2018. But It Doesn't Say Anything Else Or Give Any Other Information.

I have Also Tried Expediting But Really NO HELP AT ALL.

Info
USCIS reports that I-765 and I-131 applications filed concurrently with an I-485 adjustment of status application, particularly those filed with the NBC based on the “Dates for Filing” chart contained in the monthly Visa Bulletin, are undergoing a “second review” to determine underlying eligibility for adjustment of status. These reviews do not currently have a timeframe for completion, and in some cases, appear to be slowing down the overall processing time for I-765 and I-131 applications pending with the NBC. This review must be completed before employment authorization or advance parole may be granted.

There is, however, an expedite process for applicants if they meet at least one of USCIS’s expedite criteria, which must be supported by evidence. The NBC has specifically stated that a single letter from the applicant, without additional supporting documentation, will not be sufficient. The following are the bases on which an expedite will be considered:

Severe financial loss to company or person;
Emergency situation;
Humanitarian reasons;
Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States;
Department of Defense or national interest situation (These particular expedite requests must come from an official U.S. government entity and state that delay will be detrimental to the government.);
USCIS error;
Compelling interest of USCIS.

Case status should be changed after biometrics?
Case status for I-485 shows 'Fingerprint Fee Received'. Should this be changed already?

Case status for I-765 shows 'Case was received'

EB2 / NIW

PD: 04/26/18
RD: 08/17/18
Fingerprint fee accepted: 08/27/18
Biometric appointment: 10/19/18
Center: NBC

I have also filed I-140 on 04/23/18, which also still waiting.

Both I-140 and I-765 seems outside of window that's posted on USCIS processing time.

Currently I-765 (C-9): 08/21/18
