I came here on a J1 and overstayed because I fell in love. I was out of status for 2 years until today so I was so scared that my case is more complicated than others that's why we decided to be on the safe side and hired a lawyer. I worked the whole time but I didn't have any problem regarding that during the whole process. We got engaged on our 1st anniversary as a couple then got married at the city hall 5 months after.
So let's skip the boring part and fast forward to our interview day. My husband and I had a little practice the day before with the lawyer and she said there shouldn't be any problem during the interview proper because she proved, the way we answered, that our marriage is bonafide. Our interview is at 8:15 AM but we were called in at 10:30 AM. DREADFUL WAIT I TELL YOU! So the lady called us and we all went to her cubicle. She didn't introduce herself or even greeted us, IT MADE ME AND MY HUSBAND SO NERVOUS! So she just asked for the documents that we brought and I gave her everything. She asked me first, and she asked me right there and then as if she was really trying to catch me off-guard. She asked me when my husband's birthday is, where we met, how much he earns, highest education attainment, have I met his siblings and what are their names, if he ever had kids, etc etc. I actually didn't know how much my husband earns exactly (millennial couple lol) so I just said an estimate and she was like "what kind of wife does not know how much the husband earns" then I just didn't say anything. NOTE: the more you try to explain too much, the more doubtful you will look because it seems like you are trying too hard to prove something. They want to see real marriage, and real always shows. Just answer whatever they ask you period. But that's just me! So after she was asking me she asked my husband and she kept repeating the wrong birthdays to see if my husband really knows when it is. She even told him "so are we just guessing here?" my husband said "no ma'am, I'm just really nervous" and they both laughed. She asked him how much I earn and he also just gave him an estimate. See, if you say EXACTLY how much, it looks too practiced :/ again, that's just me. She looked at my I-94 and asked me if I am subject to the 2-year residency because of my J1, I said no. She was like "are you sure?" I said yes I am. She asked how am I sure, I was puzzled but I answered "Because I read my I-94". She laughed and said "somebody did her homework!". So in the end she got a little bit kinder to us and walked us out. Our interview lasted only about 10 minutes.
Just a tip, study everything before your interview. I read all the application form that we sent to USCIS the night before and my lawyer checked NO on the box that asked if I worked undocumented during my stay. My IO asked me about that and I said yes I have and my lawyer just made a mistake. She changed it with her pen.
My husband is a pilot and is based in Washington DC but he put all his address here in New York, we filed taxes jointly for 2018, we shared leases, we have a debit and credit card together, I am on his life benefit, I put him as the beneficiary for my savings account, we brought lots and lots of emails with the hotel/airbnb bookings of our travels, we had the receipts for the buses and plane tickets, we had screenshots of our first conversation, we provided Venmo statements because he would send me the money for rent there, and we had lots and lots of pictures. My husband's state ID is not even New York State and we thought it was gonna be a big problem but good thing it was never brought up in the interview because my husband didn't hand it to her because she didn't ask for it (only give them what they ask for).
This whole process was so dreadful - I had sleepless nights and I would cry because of frustration. I totally understand most of the people here. Sometimes I felt like losing hope and giving up especially during the time when we didn't hear anything from USICS but I kept praying and praying. God will provide if you believe. It's gonna be our 1st wedding anniversary this month so we can finally fly somewhere! So for everyone who just started, in the middle of processing, or receiving their green card just like me - YOU ARE MEANT TO BE HERE SO DON'T GIVE UP! :)
