You only have around 90 days since the date of marriage to be added to your spouse's plan or it must be the next open enrollment.

Here is what you need to do concurrently:
    1. File a complaint with the HR Department manager.
    2. If this is a large employer, file a complaint the US Department of Labor / ERISA division.
    3. If this is a small employer, file a complaint with your State Department of Insurance.
    4. Remember to document everything.

You will only need a form of ID and proof of marriage to get added to the plan. Nothing else is needed.

This is pretty much the law.

FYI - I resolved such issues for many people with my official capacity. Personally, I am a US citizen and I refused to provide my SSN due to privacy reasons.

Quick update from me : I have received my combo card around the 25th of January ( Still waiting on the SSN as it's supposed to follow the issuing of the EAD ) My interview is next Tuesday and I am beyond anxious and nervous, particularly because without SSN we were not able to get a lot of major insurances that would serve as supporting evidence, so we had to get a bit more creative in terms of that ( Even though we have a lease, internet and a bank account in both of our names ). Same situation with filling taxes together, I just learned about the ITIN number not too long ago, I didn't apply, since the interview is so close and the processing of that number could take up to 7 weeks. Hopefully everything would work out for us Tuesday, I'll be sure to let you guys know how the interview went, I can't believe I'm the first out of October fillers to have an interview, but I really believe it's because of the FO being in Chicago ( Other Chicago filers also have their interviews 4-5 months after filling, which is still a surprise to me ) Please wish me luck!
Good luck!!!! Positive vibes your way.

                  • @MGarza78 finally, there is someone else in my shoes. I don't understand how ppl get their EAD's even they applied after us
It is really getting frustrated and my current EAD expired on 2/11, cross fingers hope we will get approval early next week

I know right???? zorlu86 I agree 100% with you. It's frustrating knowing USCIS don't go by received dates. Seems like there is no order on how they will work on cases. I just hope by reading other posts and going by the number of days that other people got theirs, I have faith we will hear something this week as well.

                              • Hey guys! Just a quick update to say my hubby did his biometrics today, finally! Woohoo lol. Took 4 months but we are so happy it’s done. His appointment wasn’t until this Wednesday but he decided to go as a walk-in today, and they took him no problem.

How long does it usually take for case status to update?
