    That is great news. It's a strong indicator that even though thousands of people filed in October 2020 things are moving and interviews may be waived. I just wish we all had sent medicals with the original filing.

            • Hi! I'm an October AOS filer, and have a question regarding H1b extension. My H1 expires in June, so the company filed for an extension. But the extension was granted only for 1 year, even though this was my first H1 extension. The lawyers say this is because my AOS application is processing.

              Is that accurate? My understanding was that the AP/EAD would be for one year and the H1 extension would be for 3 years.

                    My I-485/EAD filing date is 30th Oct 2020. Received the receipt notice beginning of Feb 2021, but still in progress waiting for Biometrics letter.
                    Meanwhile my L-1 A extension got an RFE and RFE due date for submission is March end. My employer is asking me to wait beyond RFE due date and stating, we will check the status on the EAD and then RFE response can be submitted in the grace period which is after the RFE due date.
                    Please advise:
                    1. Is there such a grace period to submit an RFE beyond the RFE due date?
                    2. If it is true, is it ok to wait and then submit the Extension RFE response in the grace period?
                    3. What will be the advantages or disadvantages of EAD for Extension approval?

                    • Vishnu...this is just my assumption. I am not raising your hopes. Typically these days you are asked to bring the medical during the interview. If there are no plans for an interview...they will ask you to send the medical...and you would see online...after days/months that your green card is being processed. I dont think you will ever receive any letter saying that your interview has been waived. Do keep us posted about your progress. All the best my friend

                          • Filing I485 + I944 + I765 + I131 on 29OCT2020
                          • USCIS Office - NBC
                          • Local office - NJ state
                          I received the receipts for 485, 131 & 765, since then no update.

                          485 status shows as fingerprint fee was received.

                          How long it takes to get the appointment notification for fingerprinting?

                          Anyone else on the same time line as above? can you share you case status please ?

                          • Hi...my colleague filed on Oct 27th and is in the same situation as yours. I filed mine on Oct 20th and got finger printing done and received my EAD and AP combo card. So, I think that there is no pattern since all our details are the same..only 1 week difference....

                              I believe they are working off of a list of documents and stalling if any document is missing including Medicals. In this case your Priority date has not even reached the final action dates for EB3 India. Hence I am not sure what is point of sending an RFE by USCIS. There are cases that I have read on trackit in which the interviews have been waised. I also read in July/August forum that someone got an interview appointment notice from the field office after the RFE for medicals. But again, USCIS is unpredictable as always. But yeah it would be awesome if the interview gets waived off.

                              BTW, did you say that you got RFE for EAD/AP or I485? You can confirm by the receipt notice numbers and/or the case status as well.

                                My lawyer had a same response for the RFE and filed it post the due date taking advantage of the RFE extension offered by USCIS

                                • Requests for Evidence;
                                • Continuations to Request Evidence (N-14);
                                • Notices of Intent to Deny;
                                • Notices of Intent to Revoke;
                                • Notices of Intent to Rescind and Notices of Intent to Terminate regional investment centers;
                                • Motions to Reopen an N-400 Pursuant to 8 CFR 335.5, Receipt of Derogatory Information After Grant;
                                • Filing date requirements for Form N-336, Request for a Hearing on a Decision in Naturalization Proceedings (Under Section 336 of the INA); or
                                • Filing date requirements for Form I-290B, Notice of Appeal or Motion.
                                Notice/Request/Decision Issuance Date:


                                This flexibility applies to the above documents if the issuance date listed on the request, notice, or decision is between March 1, 2020, and Jan. 1, 2021, inclusive.

                                Response Due Date:


                                USCIS will consider a response to the above requests and notices received within 60 calendar days after the response due date set in the request or notice before taking any action.                                 If you do get the EAD in the mean time, you don't need to depend on the L1 extension. However my lawyer advised that its better to keep both tracks open and we sent in the RFE response even though we didn't get the EAD
