    Situation:
    I came to US in April 2014 and was working for company A. In 205 April, A asked me to go back to India. I started H1B transfer to a small consulting firm B and once I got the receipt number, i quit A. I payed 4000 $ to B to do the transfer(normal processing) and I didn't sign any contracts with B. Since I didn't have any project, i was not getting payed(no pay stub) and hence out of status. The petition went to RFE on June 30th. I got a contract job and joined the project on August 10th. MeanwhileI got a full time job with company C and they did the H1B transfer in premium and it got approved last week(aug 28th). Only thing is I have to go out of US and re-enter to get new I94 stamped at port o entry. When I informed B that I am quitting, they told that since I didn't serve 2 weeks notice, I won't get paid for month of August for which I worked and that since its a breach of contract between B and the vendor D through which I got the contract job, I have to pay them some money. My question are:

    1. it required that I have to pay them the penalty as I didn't sign any contract?
    2. Since I didn't sign any contract with anyone and if i decide not to pay any money to B, will they take any action against me?

    >>> Not required. But I suggest that you work out the situation appropriately. They will need to pay you until your last working day or you can complaint to DOL and make them pay. Without payslip you will go out of status.




    2. Since I didn't sign any contract with anyone and if i decide not to pay any money to B, will they take any action against me?
    >>> If you haven't signed anything, they cannot. But getting an experience letter is important for future petitions and GC process. So better work this work smoothly and get the experience letter and make sure they pay you until the last working day.
