H1B transfer when salary less than minimum wage

Hi,

I got H1B approved for employer A. While on OPT they paid me say $X dollars. While applying for H1B they mentioned in a letter that they will be increasing my salary to meet the minimum wage for position example say IT specialist and the salary say is $X * 2.5 = $2.5X. But now its been more than 4 months after approval and the company is still paying me original amount $X and say it's indefinite when they can pay me more. I want a transfer but I know for H1B transfer we need the paystubs but my paystubs show ($X) less than minimum. Can I still go ahead and apply for H1B transfer?? Your answer are appreciated.

You will get into trouble if your W2 at the end of the year doesn't meet with the approved LCA. It is your responsibility to make sure that you get paid as per your LCA. File a complaint with DOL and make the employer pay you correctly. A copy of the complaint to DOL will help you in successfully transferring your H1B to a different employer or to justify to the VO why your W2 was less when you attend the visa interview.

Thanks much. I asked this question 2 weeks ago in other places .. got no answer. I appreciate your quick reply. I will consult a lawyer about my next course of action and will most likely file a complaint. These employers are exploiting employees .. very frustrating.
