Completed 5 years on L1B, got approved in H1B second lottery and petition is expiring
Hi,
I completed my 5 Years on L1 and in 2020 I got H1b petition approved for one more year which is expiring this October 2021. Due to the pandemic and non-functional VISA consulate, I didn't get stamped. What are my options? Can I file a new petition based on the previously approved petition? Do I need to go through the H1 lottery again? Can I transfer my H1B as I got the petition approved to another employer? Can another employer file a new petition on the current expiring approved petition?

Please help and answer my question.

Can someone share how long H4-B visa process will take ?
Hi,

My spouse & kid attended H4 visa drop box on 6th August, till now passports are not received. when checked in tracker status showing Application received. Its been 2 weeks but no updates. Did anyone experienced same ? how long process took ?

H4 to F1 visa
Hi,
I'm currently on an H4 visa, where the stamping was expired in Aug 2020, and have also received my renewed H4 petition which was extended till 2023. I haven't traveled to get my Visa stamped. Meanwhile, I'm planning to attend Master's in the USA during Fall 2021 and was accepted into a University. Now the challenge is, to get the F1 visa active I have to cross the country to change the visa status from H4 to F1.
1. What are the complications while switching from H4 to F1?
2. Can I get the visa stamped in any of the bordering countries as the wait time is less when compared to India. Is there any probability of rejecting an F1 visa as it's not stamped in the home country? or would they reject stating that 'Masters can also be done on H4 instead of F1'?
3. The course that I have enrolled in would be starting around the 3rd week of this month, How long can I be on H4 while trying to obtain F1 status?

Can anyone please help me in clarifying my doubts?

H1B Experience July 13 2021 - VO told visa Approved (No slips given) - status showing Administrative processing - still waiting for passport
Hello,

I had my H1B interview at Hyd consulate.

Date of Interview : July 13th 2021

VO did take my passport and she said i would get my passport in 2-3 days and she said she would try for it. But since the day of my interview its showing as "administrative processing" and case last updated date is the same day of interview which is July 13th.

Its been more than 18 working days and i see no change in my status and when i check for my passport in DS-160 portal it says "Document Delivery Information: Empty"

Tracking my passport says "your passport is still with consulate"

Can someone please let me know if you are in similar situation or any suggestions would surely help.

H1B TTRANSFER IN PREMIUM ON HOLD DUE TO SECURITY CLEARANCE DELAYS
Hi,

My H1B was filed in Premium in April, 2021 and received a RFE within 4 days. The RFE was to justify why a specific role (job title) is required for the position. The RFE was responded and received by USCIS on June 9th. After the case status was not updated even after 15 days, the attorney raised a service ticket and were informed that the H1B case processing is on hold as the security clearance report is pending. USCIS stated that the case will continue to be suspended until the Security Clearance report is received.

I have been in US for over 2 years now, and I never had a H1B RFE / Denial in past. I have had 3 H1B approvals in past, and never had any issues before. I file my Tax on time, and have no other source of income other than employment. Also, never was out-of-job and never been Out-of-State.

I am seeking out for some insights on the following concerns:

1. Can my case be classified as one those randomly picked for Audit? Should I be worried of getting rejected eventually? None of my colleagues, or attorney, has had this experience before, so its a wild guess.

2. What is the average processing time for USCIS Security Clearance? Various forums says that it may take up to a year depending on backlog.

3. My I94 is valid until 12/31/2021. I am worried whether I will have to go back to native country if the case status is not approved until then. Assuming it can take up to a year for USCIS, I am at risk of going out-of-status starting 2022.

4. Does the H1B Petition from the previous employer automatically expires after 2 months on leaving the job? I had the validity until 12/31/2021. Asking as the current petition is still getting processed, and the only approved one is from the previous employer

5. Can I reach out to the local congressman to help expedite the case status? If yes, is there any specific waiting time before reaching out to him/her? Do I need to have any specific business case built out for it?

Apologies for the long email, and list of questions but I am earnestly worried, and seeking clarifications ASAP.

DUI charge and H1b approved
Hi Everyone,
                    I was recently arrested for DUI with a BAC of 0.17% on June-04-2021 and I hired a Criminal Attorney and he told me not to worry and he will work on my case and see what he can do. My H1B got approved on July-23-2021. I just wanted to know what will be the consequences if I was convinced ? Can I go back to home and come back without any problem? Or if I get convicted my H1B will be revoked? My H1B gets activated in the month of October, so if I get convicted with DUI will it affect my H1B ? Will it get revoked ?

I still don’t have any update on my case. Tried to reach immigration lawyers and they asked me to update about the case so they can see what they can do.

Can anyone please help me out here. This is really stressful.

I had attended H1B Visa interview on mid APR 2021 at Chennai US Consulate. Due to covid-19 pandemic, there was not much waiting time in the consulate. Post security check, I was directed to meet visa officer.

VO: Very Good Morning
VO: Place your fingers on the scanner
VO: Do you have your i797 with you?
Me: Yes sir
VO: What is your highest qualification?
Me: Bachelor Degree in Computer Science and engineering
VO: Tell about your visa sponsoring company?
Me: I briefly told about the company.
VO: How long you have been working in YYYY company?
Me: I never work for this company, I am yet to start.
VO: Do you know the address of your employer?
Me: Yes
VO: Where is your client letter?
Me: I don't have a client letter. I am going to work for a product.
VO: is your visa sponsoring company a product company?
Me: Yes, YYYY company's key focus is on product development but they also do technology consulting services based on its client engagement.
VO: Could you please explain about the product that you are going to work?
Me: Talked about the product. (VO looked at my face and also computer screen. He asked few more questions related to the product.)
VO: What is the duration of the project?
Me: Answered.
VO: What is your roles and responsibilities in the product?
Me: Answered appropriately (While answering VO was checking something on the computer)
VO: Congratulations, Your visa has been approved.

Finally Visa Officer collected my passport and issued a small booklet called "KNOW YOUR RIGHTS".
