    Hi All,

    Please help me and following is my situation.

    1. I am working for client from last 20monts thru my employer A
    2. Employer A is not paying from last 4 months though I am in a project
    3. Recently I have applied to Company B for transfer and got RFE for last three months paystubs

    Now what I have to do. I am keep on asking for paystubs from last 20days and Employer A is telling that I will give tomorrow. Every day I am getting the same answer. But he is not giving the payslips.

    Please help me GURUs and Guide me. I don't have much time to respond RFE.

    You can apply for new H1 thru same employer B as quota not yet filled.
    You may have to get a visa and enter US again.
    I see only that as option to keep your job.

      Complain to DOL and they will make your employer pay. You should have known better not to apply for transfer without the latest paystubs, since it would end up in RFE. Filing a transfer with a copy of the complaint to DOL will be helpful sometimes. You can also reply the RFE with a copy of the complain document to DOL.

          Hi,

          Now my employer is giving paystubs and I have question on check Dates. My employer generating paychecks(3rd party) for last three months in December and the Check Date will be in December 18 onwards.

          Ex. For Aug Payslip, Check Date is 12/18/09
          For Sep Payslip, Check Date is 12/20/09
          For Oct Payslip, Check Date is 12/22/09

          Is this a problem for getting H1B approval.

          Gurus and experts please help me.

            Not a problem.
            You can submit that for transfer.
            If there is any problem, they will come back. And your employer has a reason for paying you late.
