H4 visa when L1B Individual is under processing
Hi all,

Can my husband apply for H4 visa when his L1B individual visa is in regular processing already?
Below is the history of my case:
I have a little complex situation with me. I am on H1B from Sep 2013. I got my H1b from emp A and got my stamping done, valid till Sep 2016. I changed my job to emp B in 2015 and they applied for transfer and extension and my petition is approved till May 2018 and my I-94 is valid till May 2018. I never got visa stamping using emp B. My GC in process (employer submitted ETA 9089 in sept 2017 only). My husband is in India from last 2 yrs (he was in USA on L1B from 2010-2015). His L1B was denied in July 2017. My husband is planning to apply for H4 in a month or two. I am in USA and he will be going alone for H4. I have following questions.
1. Because my stamping is expired, will it impact any ways his H4 visa approval chances? (I know he will get his H4 approved for the time my H1B is approved which is May 2018)
2. Will his past L1B denial impact his H4 approval chances?
3. My GC has been just initiated, will GC in process impact his H4 approval chances?
I am really stressed out because of so many complications in my situation. Any suggestion will be greatly appreciated.

H1B visa stamping in Toronto
Hello All,

I wish to share my experience in visa stamping @Toronto.

I had appointment on Sep 19, 2017 morning.

As happened:

- Appointment and Passport verification at gate.
- No electronics devices were allowed, including smart watch. Car key was allowed.
- I traveled with family. Kids were allowed.
- Security check
- Document verification @ counter 1
- Photo verification and finger prints @counter 2
- Visa interview @ counter 3 - The questions were mostly on my Master's degree and project. The officer was interested in the technical aspects of it.
- Visa approved

Overall it took 15 - 20 min after security check.

Passport was delivered to Canada post office on Sep 22, 2017.

Incorrect petitioner name, number and expiry date on visa --h1b
We got our visas approved(h1b and h4) and received my passport today. When I checked my passport petitioner name, petitioner number and visa expiry date are wrong. I sent an email to usvisadocs requesting for correction. I got a reply back saying that they will reply in 24 to 48hrs. Later when I checked my ds 160 I have entered WAC instead of EAC for my Petition number(got confused with my old approval). Did anyone face this issue before. The visa officer checked my i797 and asked me for my employer name. He did not raise any questions during the interview about my pitition number. My travel date is approaching and I am worried. Did anyone face this issue?

H1B six years limit question
Hello All,

My six years on H1B will be completed by October 2018, where as by H1B expiry date is not until October 2019. This is because the 1st H1B was for one year and the next two extensions were for 3 years each, adding up to 7 years for expiry.
My employer hasn't started my green card processing yet, but will soon in the next couple of months. Right now I have an offer from a fortune 500 company and they wont start the GC process until an year after I join them. So my questions below:

1) As the 6 year period is reached in 2018 before the H1B expiry in 2019, will I have to apply for extension in 2018 itself with an approved labor? Or do can I continue until 2019 as normal and file extension when the actual period I will be on H1B will be 7 years.

2) If I apply for extension in 2019 will it have any affect on the processing due to being on H1B for 7years.

3) Do I still have an year to start GC processing with the new company if joined in the next couple of months?
