H1B, H4 Visa

Hello,

I got an RFE on 09/05/2017 and I am planning to join day 1 CPT school, my OPT expired on 07/27/2017 and i am in my CAP-GAP right now which ends on Sep 30th. My question is

1. Do I have to take admission before Sep 26th (End of my 60 days after OPT expiration) or do I have 60 days after Sep 30th for the transfer of SEVIS?

As per my knowledge I will be out of status after Sep 30th and my attorney said I cannot do any change of status after Sep 30th.

Hello Everyone,

I am planning to travel India in Oct 17 but my current H4 is valid till 18 Nov 2017 only.
i need to do visa stamping through drop box (eligible for drop box as current stamp expired on Nov 2016).
I need to stay till 26 Oct in India.
I can submit documents at drop box on 9 Oct 2017.
Is there any possibilities for not issuing visa on account of short period remaining on my H4 (which expires on Nov 2017) or any delay that are occurring frequently on drop boxes receipt of passport after stamping.
If any experience or doubts - pls share.

Aug 29th - fingerprints/picture OFC @Gowra plaza, Hyd
Appointment was at 9 am. My wife and me were there at 8.30 am. Security let us in at 8.45 am. We were done in less than 10 mins. All they needed was passport, ds160 confirmation, appointment confirmation letter, that's it.

Aug 31st - interview

Mine is H1B, 1st renewal. Wife was F1 to H1 to H4 COS
Appointment was at 9.00 am. We went through security etc and were in front of VO in about 20 mins.

VO: Hi, please pass your passports
Us: good morning, and passed over our passports

She picked my wife's passport first so she started off with her interview
VO: I see you have done your masters in USA. Which univ and which course
Wife: gave appropriate answers
VO: the univ with which visa was issued and d one u graduated is different?
Wife: yes, I traferred after one semester
how long have you been in the USA?
When did you change status?
When did you get married?

All the while she was typing and working on her computer. After a while she wrote something on a sticky note and kept the passport in a bundle of other passports. Later we realized it was case no.

Then she looked at my passport and started asking me few questions.

Who is the petitioner?
Where do you work?
Is this first H1?
Did you get previous stamping done here?
How long have you been in usa?
Has your GC been filed?
Did you do masters in USA?
Where did u graduate from?
How long with employer?
How long with client?
Employer location?
Client location?
Salary?
No documents were requested during the whole interview.

I had made a mistake of saying I work for my employer but technically she was asking my clients name. So I apologized repeated and clearly stated 'my employer is ___ and my client is __. I work at client location in ___ while my employer is located at __' . She looked at screen while I clearly stated each detail slowly and clearly.
Then she started typing and said BOTH your visa are approved and while looking at me said you will get SMS when passport is ready for pick u in couple of days.
She then looked at my wife and handed over a white 221G and said we need additional time for processing. And then the VO walked off with all the passports she had from our and previous interviews..
We came out a bit worried as she handed a 221g but said both visas are approved so we were confused.
My Passport was ready to pick up in 2 days but my wife's was still in admin processing. We were super tensed but by gods grace my wife's passport was ready for pick up in 6 days. We actually picked up our passports together because we were out of town.

The interview was more of cross verification of our previous stay and everything on the DS160 form. It is very important to write correct information in DS160. Like is GC filed, location of work etc.

While picking up passport, if you don't have any Indian govt issued ID, make sure you carry passport copy because they did not access USA State ID.

PORT OF ENTRY: asked if ours was H1, H4. Passport expiry date was checked repeatedly and then he said the beautiful words 'welcome back to the USA'

Quite a nerve wrecking experience but all is well that ends well.

I am going to india this coming Oct 2017 , I have been on H1b since Oct 2013 , I had a previous stamp (H1B) which got expired Sep 2016 (From Previous Employer A) , I would need a renewal Stamp with new employer B this time .

Little background on employer , I am Full Time employee of employer B , this is a insurance company , & I dont have any client vendor relationship & NO I dont work remote , I go to my Office everyday which happens to be company head quarters , this is direct full time employment . Size of the employer is 50-200 people.
 But I am the only employee which is on H1b & the first one going for VISA interview with this employer .

My employer is okay providing me with all the support & documents I need (including Company Tax returns or any thing I would need )

Is their any risk with going for interview with First time employer filling H1b?
What are the things I need to pay attention to ?
List of document I need to take For Myself & Company?
Given that this is a renewal & I am working as Full Time Employee , Will their be any extra questioning ?

Mine was H1B earlier also, i was applying for renewal as my visa got expired during Feb 2017

As my applying was before 1 year they asked for drop box

I went to chennai for drop box on Aug 23 2017
They issued blue slip asking for document submisson[Really all documents]
14 Sept 2017 went to chennai for VO interview and document submission
VO asked many questions one is my present project[Internal project] and my stay before
Then he suddenly called me saying give all documents in file that is easy for me to look over
He gave me yellow slip and asked to wait
After nearly 45 mins[[He was interviewing all others]
then he issues blue slip stating admin processing

VO told me when we call you bring passport no need to go for appointment!, as i was disappointed at that time i forget to ask when you guys will call me!

I went for H1 visa stamping at Chennai on this July.

In the first round, Visa Officer asked us following questions,

Who is your Petitioner?

Where it is located?

How many years you were there?

Salary?

Where do you work client place or in house?

Where is your client?

How many layers between your employer and client?

Give me your Employment letter, client letter, vendor letter, petition, LCA.

Questions to my wife

How long have you been married?

Do you have kids?

Is your child a US citizen?

They gave yellow slip to us and asked us to wait for sometime. Waited for an hour.

Again they called us and asked about employer, who filled your I140, does your employer pay you regularly on time?

Is your new client located at same city?

Asked my paystubs, w2s.

Again waited for some more time and VO called us and said visa is approved.

Me and my wife attended interview for H1b.

VO asked us about Relationship with Vendor, salary,client and whether employer applied for green card.
Once answered they said our visa was issued.

I came to USA on H4 and after an year converted to H1B, and this is the first time I am travelling out of country.

28 AUG - OCF, straight forward and I was done in half hour.
29 AUG - Interview.

Interviewer: who is your employer ?
Me : My employer name.
Interviewer : what is your highest degree of education?
Me : Bachelors in CSE
Interviewer : Which place are you travelling to ?
Me : State name.
Interviewer : Have a safe travel. You Visa is approved.
Me : Thank you.

Immigration in USA - EWR Airport

Officer: You are on H1b ?
Me : Yes.

That was it . Done. No big questions.
I was so worried about converting from H4 to H1B. Glad that I am one of the lucky ones.
