updates on my EVC model 221g,
I was issued 221g green last week and already i have posted my interview experience here. I was asked to get an updated USCIS letter and LCA with Middle vendor name and address, I did some extensive research, talked to my attorney and i thought i should share my understandings,

Letter to USCIS is the letter submitted by H1B employer (petitioner) to USCIS for H1 extension filing, this letter can and should have the middle vendor details since USCIS approves H1 extension petition based on this letter from petitioner. Since there is no assurance that we will be working with that specific middle vendor unless it is long term project H1B petitioner don't mention them in letter to USCIS. In my case attorney suggesting me with an explanation letter stating that letter to USCIS cannot be changed and if consulate does not accept this then i have no option but do a H1 amendment with new letter to USCIS and not sure how long this will take.

LCA can and should have middle vendor name and address and per attorney this can be submitted and obtained in 7 to 9 days including Client, middle vendor and petitioner name and address.

A friend of mine with EVC model last week got his visa approved in Chennai and he was not questioned by VO about middle vendor details. My personal opinion is that not all EVC H1's are issued 221g and it solely depends upon VO and he asks if the middle vendor details are mentioned either in LCA or letter to USCIS and may be having middle vendor details in LCA should satisfy him (not sure though)

Please note that above comments are my own perceptions and please do not follow the steps i have mentioned, do consult with your Attorney.
I will keep updating my case status and if any one of you has experienced the similar situation, please guide us.

VO: How are you ?
Me : Good !

VO : Are you visiting the US for employment purpose?
Me : Yes.

VO: Have you prevoiusly been on H1B?
Me : Yes.

VO: For how long?
Me: One year

VO: Is this a direct or client company?
Me: direct

VO: Where will you be located?
Me: mentioned

VO: What is your designation in your current company?
Me : Software Engineer

VO: What will be your salary?
Me: $x per year

VO: Can you show me your paystubs.
Me: Yes but I dont have the H1B visa as I entered on F1 visa and did a change of status to H1B and then B2.

VO: That's fine.
Me: [Showed all paystubs/W2 for all companies including while I was in F1 status]

VO: I'm approving your visa. You will receive your passport in 3 days time.

Me: Thank you very much !

It took me more than 3 days to receive, so I contacted VFS via email and phone. The next day after sending the email, my passport was delivered to VFS and the following day I received my passport at my Mumbai residence. Interview was at Chennai. I'm living in the US for 5 yrs, first on F1, then Changed my status to h1b. Once again changed my status to B2 and now back on H1B. Smooth sailing at Port of Entry too !

H1B @EVC model: 221g issued with white slip
Hi Guys,
I have attended the visa interview on 29th Nov 2011 at the Hyderabad consulate. This is my first H1B stamping (was on F1 before that).

My number was called and I greeted the VO and he asked to pass on the passport and the appointment letter.

VO: Employer Name?
Me: ZZZ

VO: Where do you work at?
Me: Client Location (ZZZ)

VO: Client Letter?
Me: Handed over the same

VO: Who controls ur work (daily activities)?
Me: My client manager assigns me daily activities., but my manager (employer) supervises and controls my work.

VO: When/how does ur employer control the work?
Me: Any change in the projects and activity has to be approved by my employer.

VO: When/how does ur employer control the work? (something similar to that)
Me: Weekly calls and monthly reports

VO: How does ur employer validate your work?
Me: Based on the monthly reports and reviews from my client manager.

VO: so, ur employer is dependent on the client to validate your performance?
Me: Yes sir

VO: Is there any layer (vendor)?
Me: Yes. YYY

VO: Can I have the letter?
Me: Handed over the same

VO: Who provides you the equipment to work?
Me: My employer provided me w a laptop, and I also use the desktop provided by the client for client's proprietary applications and tools.

VO: can you hand me the LCA, I-129, I797, USCIS petition
Me: Handed over the same.

VO went thru the docs and mentioned that the vendor's name (YYY) is not mentioned anywhere in the LCA or in the letter to USCIS.
Me: I do not know why my employer failed to mention that.

VO: So Everything goes thru client->vendor->employer.... Is the YYY (vendor layer) added sometime later during the contract?
Me: Nope. YYY has always been the part of the contract but my work is totally controlled between the client and my employer. YYY is not involved in my work.

VO: But it has to be in the USCIS letter.
Me: Did not say anything,

At this point VO gathered all the originals, returned my passport with a 221g WHITE SLIP and said "I am returning ur passport as I dont want to loose it, We need to do additional validation on your documents. We will update you in less than a weeks time. If approved you will have to come by and drop your passport".
He did not ask for any additional documents.

I got my visa approved in Chennai on 17 November 2011. My interview is too good

Me : Good Morning Mam
VO : Good Morning

VO : Who is your client?
Me : ZZZ

VO : What do they do?
Me: I told there major business activity in short.

VO : Which location you are travelling to?
Me: City, State

VO : Its good place, you will get your visa in a week.

Thanks for immihelp and all of them who posted their experience here, it helped me lot to prepare for the interview.

H1B EVC Model
Looks like there is an issue for all EVC model visas, VO is stressing more on employer and employee relations ship and with out proper reason he is sending the case to USCIS, i had interview on monday and had a 221(g), any body please share experience what are next steps and how long we need to wait for USCIS to get back

H1B Approved at HYD consulate
Hi,

Got my H1B visa approved on 28th Nov at Hyderabad. Mine is a inter company transfer from India to US office.
I went to US for doing my masters but came back to India due to some personal reasons.

Questions;

VO: What is your highest degree and from which university?
Answer: BE

VO: You travelled to US 3times on B1 visa. Were you working in US?
Answer: No

VO: But our record shows you were in US for 6 Months continously from Jan to June, were you working?
Answer: (authoritatively) NO, i never stayed more than 30days in US. Please check again.

VO: Ya, I see that you came back in Mid-Jan and again from April to June
Answer: Yes thats correct. I travelled for Sales discussion with prospective client.

VO: So this is the first time you will be working in US?
Answer: Yes

VO: Do you have client letter?
Answer: No, I will be working out of out US office and might travel to client place as needed.

VO: So who is the client?
Answer: XYZ

VO: I see a F-1 stamp on your passport. What were you doing in US?
Answer: I was at Univ of ABC for my masters. But i could not complete due to personal reasons, hence i came back to India.

VO: Ok Sir - YOUR VISA IS APPROVED and you will get it in a weeks time.

Visa interview EVC model Mumbai
Had my Visa appointment in Mumbai at the new office in BKC. its a huge complex and everything from waiting in the line to interview lasted for an hour.
Visa was at 10.00 . they took us in by 9.45
Figer printing and formalities were quick .
sat on the bench and within 5 minutes my number was called .
VO Good morning how are you
me good morning i am doing fine how about you
VO pretty good what is the name of your company
me ZZZ
VO what do they do
me : YYYY does infrastructure projexts and xxxxxxxxxx
VO what is your clients name
me ZZZ
VO how long is you project going to last
me YYYY (check your petition and try to target those dates)
VO can i see you latest pay slips
me presented payslips (Vo just glanced over it)
VO what do you plan to do after the projcet is over(tricky question which i said i want to come back home)
VO have you read the white pamplet(this means visa is approved)

VO your visa is approved you will get yor passport in a few days
