Hi All

First let me thank you to all who have posted their experience.

Today is my interview and my time of interview is 1.00pm. But i went there by 12 pm. Not too much people today.

So, i went inside, completed the other formalities in 5 mins and was there in counter in 2 mins.

VO asked only 2 questions.

What is ur Designation?
What is ur Highest Degree?

Then the golden words came..

"Your Visa is approved and will get ur passport in one week"

Thats it.

H1B Stamping pending status.
I went to Mumbai for stamping on 18th Jan,2011.

VO asked me common questions like why you want to go to US ? you get paid regularly? do you work for client? and then she said look "your company YYYY does not follow US Laws" so either you revoke your application or I will write draft to DHS to revoke your application. then i said I will prefer not to sign that letter by signing and revoking my own application. then she took some blue form out and asked List of employees, unemployment wage reports and IT returns from my employer as well as client letter and she marked those documents submitted in blue form(VO did not gave me that blue form). and then she returned my passport without saying anything. everything including passport,I-797 are with me.

does same thing happened to anyone?

Guidence on H1B
Hi,

I got H1B petition approval in 2008, Now i got the offer in one of the US company so i am planning to attend the H1B interview in feb-2011.

I think the Vo may ask the reason for the delay on attending the H1B interview.
Please guide me, what we can say to them....how to manage this situation.

My slot was at 9 am. I reached consulate around 8 and was let in at 8.15 am. After body frisking, went inside and waited for my turn for document checking and fingerprint scanning.

Then waited half an hour before my turn came.

Questions asked:
1. What is ur designation? SSE
2. What is ur degree? B Tech. In what? Mechanical
3. What is ur IT experice? 2.5 yrs
 
OK Sir. Your VISA is approved and u will get the passport in a week.

H1B revoked/additional docs asked (221G)
Heres how the interview went.

VO:Name of ur employer?
ME:A INC
VO: Title?
ME: Programmer Analyst
VO: Where do you work?
ME:Client location.
VO: Whos the client?
ME: C Group
VO: Client location? Employer location?
ME: X City, Y City
VO: Is there a contract between A n C?
ME: Yes
VO: Do u have the contract with u?
ME: No
VO: Is there a mid-vendor?
ME: Yes
VO: Name?
ME: B company

After this the VO asked me lots of questions regarding involvement of my employer at the client site.
I tried my best to satisfy him.
He asked me about the interview process and was I given any training?How was the training given?

After half an hour of questions the VO told me:

VO:Heres whats happening over here.
This is a clear case of Loss of Control.
Ur employer does not have control over u as he should as per the H1b laws.
Let me tell u one thing,A INC does not have any contract with C Group. A INC may have a contact with B, and B may have a contract with C, however this is not acceptable as per H1b laws.
B tells C that you r an employee of B (however u r an employee of A) to save taxes (illegal way to save taxes).

Now u have 2 choices:
Option 1: Write me a letter saying I am withdrawing my H1b petition and I will never work for A Inc.
Advantages: If tomorrow B or C offers u direct employment, u can accept it and a new H1B can be processed.(This H1B wont be in pending status as u have withdrawn it)

Option 2: I am gonna write a letter to DHS (US Visa authority) asking them to revoke ur H1, and u need to provide additional documents as mentioned in this 221G letter.

I am sure ur employer wont b able 2 provide all these documents.
Anyways if he does, all ur documents and my request to revoke ur H1 will be sent to DHS.
As per my experience there is a 75% chance DHS is gonna revoke ur H1.
Any which ways DHS has a lot of applications to reveiw any it may take upto 5 months for them to accept/revoke ur H1, during this period ur H1 will be in pending status and u can cannot file H1 for a different employer.

Option 1 or Option 2,U have to decide now!!!!!

           Thanks a lot for sharing your PA experience. It was really helpful. Let me share my experience here.My PI was at 8.45 AM. I reached Chennai Counsulate at 8 AM itself. It was well organized. I got my turn around 9.30 AM.

VO :: Good Morning Sir.
Me :: Good Morning Mam.
Then i gave my folder to her
VO :: Which city and state you will be travelling?
VO :: Who is your Client?
VO :: What will be your salary?
VO :: What is your highest degree?
Since i am from chemical engineering i got to answer few more questions from VO.
VO :: Have you done any computer courses?
VO :: What type of Course?
VO :: What is your IT Experience?
VO :: What you will be doing for Cilent?
Finally she took 30 seconds to looks at my petition and finally she said your visa has been issued. It was nice experience.

Generally in how many days will we be receiving our passport.I received my F1 Passport in 4 days..I need to go back on jan 22 to US

This forum is very helpful and also thanks to everyone who shared their experiences here.

I am from Hyderabad, I got a full time opportunity in one of the Public Universities and they had applied for my H1B.

I haven’t got the slots in Hyderabad and I came to Chennai for interview. This is my fresh or first H-1B.

My interview today was at 10 AM but I went there around 8.30 AM and the security guys allowed inside and 8.50 AM. I had my fingerprints done at the first building and allowed to go to the next building for the interview. I waited there for 15 mins and next is my turn. Below are the interview questions.

Myself: Good Morning Madam
VO: Good Morning. How are you doing?
Myself: Doing good. Thank you. How are you?
VO: Good. Thanks.
VO: What are you going to do at the University?
Myself: I am going to work as an ETL Developer and develop several jobs to load the data into Data Warehouse tables.
VO: How did you get this opportunity?
Myself: One of my Ex-Colleague referred me there.
VO: Thanks a lot sir. Your VISA is approved and will get the passport in a week’s time.

No questions and no other documents were asked. She just looked at the I-797, LCA and passport.

Reg H1B visa
Hi i want to know when VO ask u why u want to go US not other country what should reply also is there any time bound that we must say that we r going for 9 months or more but less than 1 year. .One more question my client send me letter for more then 3 years for H1 Visa .now waiting my papers from client. as soon as got will apply for US embassy Interview in delhi. Plz suggest what should i reply .
