Adjustment of status for F2A category
Hello All,
i need some clarity in this process will really help because i'm confused with (lawyers, USCIS, NVC ) giving me different information.
I filed my I 130 last year and my priority date is July 18 2016. My spouse is a green card holder and i am in US on H1B right now.
MY I 30 got approved in January 2017 and case got sent to NVC and i got the case number from NVC as well.
couple of question?
1. Am i eligible for adjustment of status and EAD. USCIS told me since my spouse is a GC holder i'm not eligible for either is that true?
2. if i can file for AOS and EAD whern is the right time? looking at october 2017 bulletin the dates to be filed table shows november 2016 for India and F2A which makes my priority date before the the date on the bulletin.
3. NVC reached out to be couple of days ago to sent support docs like income, tax, marriage affidavit etc that is a step in which process? when i asked NVC about EOS and EAD they said i need to call USCIS and USCIS says NVC will handle everything after i130 being approved.
CAn any one tell me what are the next steps

any help is greatly appreciated
thanks

Ajustment of status I-485
Hi,
We are in Miami Florida. The I-130 was applied in August 2016, we went to an interview in July 2017 and get I-130 approved the same week. We applied I-485 in August 2017 and did biometrics in September. do you think they will ask for another us to go to another interview for I-485 since we went in for an interview in July 2017?

Same Sex Marriage - Canadian to US Citizen
Hello, my experience was somewhat painless and from marriage date to receiving my conditional green card it took a total of 8 months. We opted to NOT use a lawyer to save on expenses. We did everything ourselves and after a few I-797C notice of action forms for petty things, we finally got some responses we wanted to see. See timeline below. The major thing to note is be very careful to make sure you aren't filling out your forms and sitting on them a while before submitting them. They update their forms pretty consistently and if you fill out an earlier edition they will send it back to you. Be sure to look in the bottom left hand corner of all applications to make sure it's the most up to date revision AS WELL the top right hand corner to make sure the form isn't expired. This was our mistake for about four tries before we realized what we were doing wrong. We also overpaid. Because we filed the I-485 together with the I-765 we didn't actually have to pay for the I-765 form.

APRIL 10, 2017 - Sent all of these forms together to the USCIS Chicago Lockbox
 G-1145, I-130, I-130A, I-485, I-765, I-693, I-864 and a G-325A
(This is where we had some back and forth for not doing the most revised version of applications)

JANUARY 27, 2017- Married my husband in the U.S.

APRIL 2017 - Once we finally received our marriage certificate we could start our immigration papers. It took a very long time to get this in the mail. We had to call. Not sure if that's normal but we would have loved to start the paperwork earlier - but you need the marriage certificate.

MAY 16, 2017 - USCIS receives all forms
JUNE 1, 2017 - Forms accepted by USCIS and in review
JUNE 2, 2017 - I-485 Biometrics Appointment Letter received in the mail
JUNE 12, 2017 - I-765 accepted by USCIS and in review
JUNE 17, 2017 - I-765 Biometrics Appointment Letter received in the mail (yes I had two appointments)
JUNE 20, 2017 - Biometrics Appointment for I-485 scheduled
JULY 5, 2017 - Biometrics Appointment for I-765 scheduled (I was going to be away this date so I actually just walked in on June 27 to see if I could get in, they did take me which was great)
AUGUST 9, 2017 - Received letter with a scheduled initial interview for I-485

SEPTEMBER 13, 2017 - IMMIGRATION INTERVIEW. This lasted about 20 minutes and was really painless. We were nervous but if you have a legit marriage you will have no issues. You should know about each others family, jobs, how you met, where and when you married, birthdates, etc. Most of the info they really just take off your original applications. Don't be nervous. You should know these answers
APPROVED ON THE SPOT FOR MY GREEN CARD. Yay! They gave me a letter and said it would arrive in the mail in 3-4 weeks so I'm just waiting for that. It's worth mentioning that I never received and EAD during this entire process and now that I have a green card it's not necessary. This is a conditional green card. Meaning it is good for two years. 90 days before it expires I have to file another form to have the conditions lifted and then I'll be really permanent.

Good luck everyone! Be patient and make sure you read all the fine print of each application. Be sure to have all originals, copies, support documents, photos (we had 36). Put it all in a nice binder and be organized. You'll have to pull stuff out at your interview.

Hope this helps you :)

Waiting for EAD/ apply for marriage based green card
Hi Forum, I'm hoping to hear some advice or someone to talk to, I'm super worried and the wait on EAD card is so long, even though I know it's supposed to be 90 days or so. My husband is in the Navy, we got married in Jan 2017, he went underway for 6 weeks afterwards. We've known each other for 2 years before our marriage.

I came here in 2010 under F-1. I got my Bachelor's 3 years ago, I've lived in Washington for little over 6 years now. My background is all clean. Fast forward, I finished my certificate program in June 2017. I'm not under OPT.

I-485, I-765, I-130
Filing date 4/30/17
Notice date May 4
Biometrics May 30
Office in MO

I know it's only Sep 2 today but I heard that EAD would take quite long. I need EAD to contribute to the household. Does anyone have any guess why EAD takes so long? I've read other people's experiences and a few of them didn't wait exactly 3 months to receive the work permit. Whoever's reading this I hope you have more luck :) Please share your experience too =D

APPROVED ON SPOT- Holtsville Long Island NY interview
PD- 10/25/16
Interview -08/30/17 -Approved on Spot!

Arrived about half hour early- interview time was for 11:20am.
Went tru security check and hand in interview notice, IO called my name exact time that was on the notice (11:20am)
She then make us take the oath, sat us down, then she opened my file that they had for me.
She then asked for our passport, I gave her me and my husband passport, she went tru it and ask if this was my last. i-94 entry to the USA, I told her yes! She asked how long we were married, I told her about 4.5 years, then she said that it's her first time that she interviewed a couple who had been together for such a long period (17years-since highschool) and that alone proved that our marriage is legit. I had send pics of us from when we first met in school along with bank statement, hotel receipts, insurance(life&auto) and cards we shared along with the package when I mailed it.
I then asked her if she needs any other document from us since we walked with a high folder...And she laughed and said noooo...That she even want to give me back some of the stuff I had sent. I asked her if she wants our 2016 tax that we filed jointly she said she had enuff evidence, I had a new medical, she said the old one is fine! She was so friendly..It's like we were having a friendly conversation rather than a GC Interview! She then said that I will recieve my greencard in about 2 weeks and I can apply for citizenship 3 years on this date! So I asked does this mean we are approved??? She said yes! I wanted to hear it from her! I then asked if I have to sign anything or if she need the EAD she said no...That I can keep that, it's all mine! She then thanked me for having everything organised! Our interview lasted exactly 4 minutes and 36 seconds! (I stopwatch it) my husband is the USC and she didn't ask him any question!

I just want to say thank you to all of u on this forum for helping me tru to the end, ur experiences and advice made me this far! Also I prayed that u all will get ur approval very soon and good luck to everyone!

my status hasn't changed yet to card in production, I will let u guys know what I recieved that update.
Again ...THANKS TO ALL U WONDERFUL PEOPLE!!!
