Petition for my Mon with a current approved i130 from her Mother
I am a US Citizen and I will be 21 pretty soon, I will like to sponsor my mother which is currently leaving in the US. She entry legal and her mother filed an i.130 7-8 years ago and it got approved but since the 245i was not filed she did qualify for a change of status. I have a couple of questions.
1. Can I just change the process with a new i130? and pay for a new form or hows that? and file along with the change of status 1.485? I will turn 21 in March, can I send it a few weeks before?
2. I'm a college student, I do not work but we can get someone to provide an affidavit, can I do that?
3.My mother have always paid her taxes but received medical help when I was born and later she applied for my medical card, never for any government assistant.

petition for family
hi everyone, does anybody has a knowledge about getting a spouse or petition a spouse? My son and I are green card holders since December 2012, but my wife is still in my country until now. We just got married last August 2015 but we've been living together since 2004 and we have a 9 year old son. I am not able to file a petition for my wife yet, because my question is should i wait until i will become a citizen or should i petition my wife now as even i'm still a permanent resident? This coming December 2016 it will be my 4 yrs here in US.

DS-260/ family based immigration
Hi,
I am writing regarding to my concern about the section of DS- 260, Violation of immigration law. I am petitioning for my mother. In her case she was in USA, 25 years ago, and at that time, she overstayed for almost six months. she was also pregnant at that particular time. (Note: My mom is not literate)
So, my questions are
1: do I am required mention her overstay as it was long time ago, 25 years ago?
2: If I am mentioning do I need to fill out any waiver with it? or only explanation is enough?

I'm a US Citizen, my husband is of Jamaican Nationality...we've been married now for 4 years and share a 3 year old child together.

Biometrics appt, rec'd 01/16/2016 due to zip code typo error

Rec'd letter for interview 06/06/2016
Interview date 07/06/2016

We went in for our interview not too many questions asked of us together. After showing some documents and pictures, our officer told us we can put everything away. Told us she had everything she needed. She told my husband that he was approved and he would receive his card in the mail. What she didn't do was give him a temporary stamp in his passport. What she did do instead after asking him was he planning on going back to work on the cruise ship and did he planned to stay here. My husband answered no that he had to plans to go back on the ship and he planned to stay here. She then marked red lines through his "Visitor Visas" and his "C1D Visas" and wrote "CWOP" not sure what that means. Should we be concerned that he didn't get a temporary permanent resident stamp in his passport?

Family based & Employment based green card
Hi all,
 My spouse has a pending employment based 485. I recently got my US Citizenship. Do I need to re-file I130 and I485 in the Family Based category for my spouse? It's a lot of money so I'm trying to see if there is any way to leverage the existing pending 485.

NO NOTICE OF ACCEPTANCE AFTER 8 DAYS
I mailed my I-130 along with I-485 and I also completed form G-1145 (e-notificaiton) on Saturday June 10th and i haven't heard anything as of now (after 8 days).
Is this normal? What reason(s) could account for the delay in getting a receipt number. Also, I paid with a cashier's check so there wouldn't be anyway of knowing it has been processed.
Will appreciate any insights.....

Green card for parents from india
My parent's live in Indian and have visited USA couple of times. their visitor visa is about to expire and now i want to file for their green card instead of a visa renewal. Some people have posted their timelines, but i would appreciate if others may share their experience regarding the current processing times.

Also, similar to the previous post, i think they don't have their birth certificate or the marriage certificate. What should be done in this situation.

Hi all,

I am a US citizen (Born in India) and applied green card for my parents.

Submitted - I130, I131, I485, I693, I765 and Biographic information.

04/11 - Application submitted
04/18 - Case received
05/12 - Scheduled for bio-metric appointment (biometrics completed)
05/13 - RFE sent requesting for birth certificate and B2 Visa - stamped with US entry details.

My question is my parents don't have birth certificate and they are born before 1960 in small villages. What is the alternative acceptable documentation? It is specified a letter from government agency (probably I am thinking MRO) would be enough. Also if this is not available they requested for affidavits. Did any of you provided affidavit? Let me know how you responded and it will be very helpful for me.

I am looking to move to the states as my 2 year daughter is a U.S. Citizen (was born in the U.S.)
The only problem is I don't know which visa or green card I need...?
I heard there is a way I can get a green card because she is a U.S. Citizen. Without waiting until she's 21.
I would like to get everything done before she starts school.

If anyone know any information please help

Hi all,

I was hoping someone could tell me what this means. I moved to America in April 2016 after all my documents were accepted. I even paid the USCIS fee a month before moving here but when i check my case status it still says "my case was approved".what does this mean and how long does it take to get a green card after this message as it has already been 60 days and i am in urgent need of the card as i have to travel abroad.

any help is highly appreciated.
