Failed Drug Test
Hi Everyone,

Any help on the various doubts me and my wife have would be great. I am a US Citizen living in Mexico, and my wife is in the process for her Green Card. She had her interview at the US Consulate back in March, and failed her drug test, and was told in her interview that she could re-take the medical exam in one year. The people at the consulate have said that after one month passes we can schedule a new interview and thus a new medical exam. My questions are as follows:

1. What new documentation will she need at the interview?
2. If she receives her immigrant visa, how long do we have before we need to move to the US?
3. Once living in the US, how long do we need to stay there (I have a job that could potentially relocate me to other countries in a few years)?

Any help on this would be greatly appreciated!

Thanks,

Eric

I-130 and the CSPA
Hi everyone,

My wife is a LPR, and submitted an I-130 for her biological daughter (F2A). The I-130 was approved on 01/28/16, and her priority date is 09/09/15. The current visa bulletin shows visas available for F2A with priority dates before 01/22/15. Her daughter will turn 21 years old on February 26, 2017. I don't anticipate a visa will be available to her before then as her PD is 9/9/15. I am wondering if she can take advantage of the CSPA provision to subtract the time her I-130 petition was in processing from her age when a visa is available? If so, what is the correct way to calculate what her age would be under the CSPA?

Thank you in advance for any relevant information!

When will be my interview scheduled, Can I change job as I sponsored myself?
I did concurrent filing on 04/20/2016 of green card through marriage to a US citizen. I got a RFE letter on 7/15/2016 and provided my evidence by 7/29/2016. I received my EAD on Aug 26. Since then I am waiting for green card interview request. I checked processing time. For I-130, it already seemed passed the date in Nebraska Center and for I-485, they were processing for Dec 2015 application on Jul 31. Should I do request for more information on my application to USCIS? I am worried if they consider my application date from the day they received RFE from me.
Can anybody please tell me how long it will take to get interview scheduled in MN?
I am also planning to change job, will it affect my application since I sponsored for myself. I am on F1 status. My new job is going to pay me more than previous one.

Travel to US when Green card processing is pending
I am a US citizen and I sponsored green card for my parents two months ago when they were in India. We planned for them to go to the US consulate in India for processing of the application. But my father passed away suddenly. My mother is lonely, heart-broken and very sad because of her loss. I would like to bring her to US as I am worried about her current situation. She has a valid visitor's visa but has a green card application in process. Is there anyway to bring her to US while her application is pending?

TPS-I130-I485 HELP
I'll make this short.

My husband came into the country legally and he then applied for TPS which was granted. His TPS expires next year and they haven't announced anything about it being renewed. I am not getting docs ready to file i130 & I485. Are there any other forms I need to send with this? How would he be protected for the time we'll be waiting for these to process if TPS is not extended?

Family based green card application
Because of the help I received from this website and a few others during my process, I always promised that I would submit once I was finished.

I applied for green card earlier in the year and I received my green card 3 months and 2 weeks later. I will share with you all the triumphs and the mistakes I made during the process.

I provided a U.S. bank "certified true copy of the original document" of ALL copies that I attached to my application (i.e. birth certificates for all relevant parties, marriages certificates, police record, and passport copies). If I mentioned a person in my documents, I provided certified evidence - proof of who that person is (e.g. passport copies - certified). Additionally, I provided certified copies of documents for my parents' marriage certificate as well.

The mistake I made was in submitting the Medical Examination & Vaccination Record Form I-693 without first receiving a request for the same. Luckily, I was with an office that was proactive and they requested it again. I was able to have the doctor reissue without any additional cost to me.

Overall, the process was painless and the responses by e-mail were a lifesaver as each time someone touched any of my applications I received a notice.

Best of luck to all persons currently in the process and those contemplating applying! I hope that this information helps someone.

Please help I-864 form 125% poverty guidelines?

I-601A Waiver got approved 08/2016

I am a US Citizen My Spouse is a DACA holder and I cannot use his income for I-864
? I need help?

The top poverty level guidelines at 125% for 2016 is 20,025K for a houhold of 2. The sponsor meets it at 20,600K annually by estimating his paystubs and he filed his taxes at 22,000K for 2015. Do this meet the requirements for I-864 sponsor ?

Also the sponsors current earnings are estimated about 21,165K annually if we multiply his current earnings as of today to 4 months which is what is left of the year? Please help me?
