H4 Visa Before/After I-140?
Greetings,

I hope you all are doing well. Currently I am on the recruitment period stage for the PERM Labor Certification of an employed based green card process. I still have about 8 months before my H1B expires, so it’s possible that we will require to get an H1B extension depending on the progression of how fast the PERM application is filed or completed. In the meanwhile, if I get married in my country of origin and I apply for my wife’s H4 visa, I would like to know:

-With the H4 application, would she be able to apply for an EAD before my process moves to an I-140 petition? Is this only possible after the I-140 is approved?
-What happens if we marry and she gets the H4 after the I-140 is approved. Would she still be able to apply with me for an I-485 adjustment of status?

h1b visa transfer
Hello all,

I am currently on H1B visa came through one consultancy firm on Jan 2016...i am searching for the job and my employer didn't run the payroll till today .I have decided to come back to India.

My question is whether my H1B will be valid if any indian employer (Big mnc) want to transfer in future...i don't have pay stubs with me.what do i need to provide at the time of transfer. Appreciate your inputs.

All i want to know is ..if i fly t india without paystubs and experience letter from my current employer in US...can i use my H1b transfer in future with some other employer in india with out any issues ?

My H1B visa has been approved today. Thanks for immihelp and people who posted their experiences which helped me to prepare and gain confidence but each applicant is different and could face different questions. Below is my exp

VO: Which Company and who is the client ?
H1B : ABC ,Its an in-house project . No Client
VO: Can you prove that you work for ABC?
H1B: Sure,Does Employer letter or paystubs work ?
VO: Yea gimme paystubs
H1B: Gave
VO: You visa is approved. Read this rights book
H1B: Thank you and left the place

My spouse is changing his employer n premium petition is going to apply. I'm planning to travel to India in month end. can I travel while applying for change?? will it create any problem while I'm returning to US in july?? confused dnt get any proper answer till now.. help me

Question about documents submission
Hello All,
I had my interview on 30th April @Hyderabad. I went in for F1 (OPT) visa. I got a 221 (g) white slip. I was asked to submit
Invitation letter, CV, Questionnaire and supporting documents (publications/references etc). I submitted all these documents. However, I did not submit my I-797 and OPT card. Should I submit these documents now? Will it be ok to email twice? Please provide suggestions/inputs?

March 28 - Biometrics
March 29 - Visa Interview ( 221G Yellow Issued )
March 30 - Document submitted related to 221G ( All i797)
April 4 - Visa Issued
April 6- Passport Collected

Moved from L1 to H1 in US and this was first stamping.
Worked on i94 after petition was expired 4 years ago for 6 months.
VO asked to prove if i was allowed to work during this period.
Submitted all the i797 from day 1 in US to extension approved till 2020.

Please take your all I797 for Visa interview.

Hi here are the following queries i have and would really be thankful if i could get some help:

I have my H1b sponsored through company A and i have a stamped visa valid thru Aug2018.

2. Now i am planning to switch to an employer B and decide to stay at ofshore for an year or so and employer A will revoke the H1b visa after three months.

3.Now after an year if employer B wants to sponsor my H1 will i be under cap exemption?

4.Will I have to go for stamping again or drop box will be okay.

5. Will I move out of status if there is no sponsor for my visa for one year till emp B applies?

6. If i join back my employer A after one year will i have to go for stamping again even though a new H1 petetion will have to be filed?

My interview is on Apr 4th, 2016

My interview experience

My appointment time 9.30 AM in Hyderabad Consulate
Reached consulate around 8.45 AM. Parked car and took locker to keep personal items.
Went into consulate around 9.10 AM
Security check took approximately 30 min.
Waiting Area 1 took around 45 min.
Then fingerprints check.
Waiting Area 2 took around 30 min.
Made us to stand in a line where they are allocating counter numbers.
After 15 min of wait time, they gave me counter number 11
Four people are already waiting at counter number 11

A gorgeous American lady is taking interview. She looks serious but occasionally she smiles looking at screen while asking questions.
She seems asking reasonable questions and waiting for right answers. When applicants are answering, she stops doing things and listening to what they are saying.

Three of four applicants Visas are rejected in my counter number 11 in front of me.

I started panicking and at the same time I’m confident that I’m going to crack it.

Finally got my turn –

Hello, how are you doing?
No reply from her.

VO: I797 please
Handed over

VO: Who is your Petitioner?
Answered my employer name

VO: Nah. I meant who is your employer?
Answered my employer company name.

VO: What are your job duties?
Explained my job duties (she listened carefully to every statement I made)

VO: Please can you provide I-129 and project documents?
Actually if you don’t mind I have a packet provided by my employer, can I hand over to you?

VO: No. Please just provide I-129. I can’t go through all those documents.
Sure thing and I started taking off binder.
She stopped and said “Never mind, pass that complete folder. Also tell your employer next time don’t send documents in this way”

But she is very pleased by the way my employer provided documents.
She looked at project documents.
Also she looked at other documents for 2 minutes.
She handed binder back to me

VO: Where do you work from client location or employer location?
Client

VO: Where do you live?

VO: What is your higher study?

VO: Which University?

VO: From how many years are you working for this employer?

VO: What is your client name?
I said my client IT operations group name as mentioned in client letter. (She typed in some where and couldn’t find it)
She insisted to spell it.
I explained that I said my IT operations group name and actual client name is –
And I spelled it.

VO: How long have you been working for this client?
Three months

VO: Why? (This felt like a tricky question)
I was assigned for a new project with this client and that’s the reason we applied for H1 amendment with this client

VO: Nah. Why?
I didn’t get that. Please can you repeat your question?

VO: Why this client?
Explained about my project and said that it’s good for my career growth

VO: Do you have a middle layer?
Yes I have vendor

VO: Your Visa is approved. Do you have the rights pamphlet?
Yes I do have. Thanks. You have a great day.

H1B Transfer related Query
Below is the situation and couple of questions. Someone please clear my doubts.

I am currently working with XYZ and I have H1b visa valid for next two and half years with ABC as my petitioner. But I have never been to USA with that visa. My current employer XYZ convinced me that he would ammend my existing visa and initiated H1B visa under cap-exempt. Based on above my situation.....
1. Do I need to attend interview again after the current employer petition is approved ?
2. I heard I have to use drop box to drop my passport for new visa stamping and no need to attend interview, if that is the case, my previous visa will be cancelled?
3. If I enter US with my new visa, can I use my previous employer's petition to change a job under old petitioner?

Please answer the above queries. Thanks in adance
