H4 Visa 221(g) yellow form administrative process
Hi All,

I am here in USA before 3 month on H1B Visa.

I have no pay stuff on my hand. I had try for my wife H4 Visa without any pay stuff.

But When she appear for Visa they had check I797 and marriage certificate but not ask about any pay stuff.

They have check some details online and gave One yellow form 221 (g).

They have point out like “ When Administrative process is completed on your case, you will be contacted and requested to submit your passport, this letter, and accompanying envelope to the nearest VFS Office”

From Last two month I have not got any reply from VISA Office. So What I have required to take next step to get my wife visa soon.

From Last One week I got a job but my employer still not generate my pay stuff.

If you have any Idea please advice me on my email ID: [email protected]

Thanks for your time.

Gaurav

Successful Visa Stamped after 221(G) Query
Hi All

There is no word to express the appreciation of this portal. This is really a stepping stone for the H1B Visa. Thanks to all for sharing their experience in this forum.

Let me share with you my experience right from the first:

I got my appointment for Visa Interview for February 19th 2008 at 10 am IST at Chennai. Being a local candidate I went to the US Consulate at 9:45 am IST. There were many people standing for the security check. In the security check, I was asked to open a sealed cover of my Employer which consisted of Income Tax Returns of the employer. After checking they sent me inside where I need to wait in a long queue. Here my fingers were scanned and all the below mentioned documents were checked and were put in a separate blue coloured folder.

• Original Passport
• Original LCA (Labor Condition Application) from Employer
• Original VISA Interview Appointment letter
• Original HDFC Bank Visa fee receipt (pink & yellow)
• Original DS156 - with Photo, Tamil Name with the Signature
• Original DS157
• Original I797 Notice of Action
• Original I 129 Petition for a Non Immigrant Worker,
• Original H classification supplement (comes along with petition)

Once the verification and scanning of my finger prints were over I was asked diverted to another building. I went there by 10:15 am IST. Since there were many people attending the Visa Interview I was asked to wait. The clock struck 11:10 am IST when I was asked to join the queue for Visa Interview.

The person who interviewed me was an American lady and here it how it went.

VO: Visa Officer
Me: Myself (Candidate)

VO: Hi
Me: Hello and Good Morning
VO: Good Morning. Can you please give me your blue folder?
Me: Yeah. Please find this blue folder.
VO: Are you currently working for this Company <Indian Company name>?
Me: Yes I am working at < Indian Company> only.
VO: What is your role there?
Me: I am a Software Engineer there and am working for the project <Customer Name> .Here I explained about my current project in two to three sentences describing both technically as well as functionally.
VO: That’s good! What is your highest education qualification?
Me: I have Bachelors of Engineering in Computer Science, Masters of Business Administration in E Business and also I am an Oracle Certified and Sun Certified Java Professional.
VO: How many years of experience you have?
Me: I have about three years of experience
VO: Which specialization do you have?
Me: I am a Bachelor of Engineering…..
(VO stopped me by asking this below question)
VO: I am asking you the specialization in which technology and not qualification.
Me: Oh! Sorry madam.
VO: Not a problem.
Me: I told him the technology I am specialized <Technology or the tool I am working on in my current company> and also about certifications that I have done in the same.
VO: Who is your US employer?
Me: I told my company’s name <US Employer>, their customers and also the projects they do.
VO: What project are you going to work there?
Me: I explained my project description and my role in that project shortly and precisely.
VO: Do you have project detail document?
Me: Yeah. Here it is and I gave the project document signed duly by my Employer and the Customer.
VO: That’s good.
She was looking in the computer for some information for about five minutes.
VO: Is this an in-house project?
Me: Yes. It is an in-house Project and I will be working in my Company <US Employer> at Place Name <US City and its State> for the Customer <Customer Name of the US Employer>.
VO: How did you get this job?
Me: I had posted my résumé in dice.com and my Company <US Employer> called me and I had two rounds of technical interview. One was an online test and other was a technical interview.
VO: Yeah. That’s good. Can you please get me the Tax returns of the company <US Employer>?
Me: Here it is and gave the confidential cover. I opened this cover since the security guys asked me to do so.
VO: That’s not a problem.
She was checking for some information in the tax returns very carefully for a couple of minutes. After that she was again checking for some information in the computer for about five minutes
She then took the famous 221G Blue form and stared marking the list of document and at the bottom of 221 (G) query form she wrote No Passport.
VO: Sir, I have marked the list of documents that are to be dropped at the VFS drop box and you need not drop your passport which I have mentioned in this form.
Once we verify these documents we would send you an intimation to drop your passport alone. Once you get that intimation submit the passport through the same drop box and I will issue the VISA.
Me: Should I come for Interview again?
VO: No! You need not come and you just drop your documents marked in that form through the drop box. Do not drop your passport! Once we verify these documents we would send you an intimation to drop your passport alone. Once you get that intimation submit the passport through the same drop box and your visa will be issued.
Me: okay. Thanks and have a great day.
VO: Thank you.

Note: None of my educational documents were asked.

As soon as I reached home I mailed my Employer to submit the list of documents.

On April 12th 2008, I received the necessary documents from my Employer. Also we need to fill and take a print out of DS156 - with Photo, Tamil Name and Signature and DS157. These forms are available in http://www.immihelp.com/forms/state.html

Once everything is over I submitted in the VFS drop box on April 21st 2008 by paying Rupees One hundred and Fifty Five. The documents marked and submitted to US Consulate were:

• A copy of the petition with all supporting documents
• A copy of all the employment contract or letter of agreement signed by Employee and the petitioner
• Petitioner’s Income tax Returns for the last two tears and financial statements
• A notarized list of all the petitioner’s employees of the job site listed. The list should show all the employees’ names, their specific job titles, start date and end dates and their individual salaries and immigration status.
• Status Unemployment Wage reports showing all wages paid to each employee in the sate for the past three quarters as field to All States
• A detailed and specific description of the internal development project to which you will be assigned. Include a complete technical description of the project, employer, time-line, current status of employees assigned, worksite location and marketing analysis for the final product.

On April 24th 2008, I got courier from VFS Chennai. In this they have returned all the documents to me except:

• Petitioner’s Income tax Returns for the last two tears and financial statements
• A notarized list of all the petitioner’s employees of the job site listed. The list should show all the employees’ names, their specific job titles, start date and end dates and their individual salaries and immigration status.
• Status Unemployment Wage reports showing all wages paid to each employee in the sate for the past three quarters as field to All States (another blue form)

In that courier there was a blue form intimating me to drop Passport.

On April 25th 2008, I dropped my passport along with a newly prepared DS156 - with Photo, Tamil Name and Signature and DS157 after paying another Rupees One hundred and Fifty Five).

On April 29th 2008, I received the Passport with VISA stamped on it.

So guys! Never ever worry if you get 221G. If your US Employer is genuine you can get VISA stamping easily. Please be optimistic. All the best! Once again I would like to thank this portal.

H1B Denail Notice
Dear Friends,

I have applied for the H1B last year (2007-2008 CAP). I am selected in the Random selection process and the application was denied due to the reason the company which i have applied is a black listed company (Denial Notice Sent). Now for the new CAP (2008-2009), i have applied the same petition with a different employer (A big company). Now i would like to know whether my profile (which is last year's) will go for the Random selection process or will it be considered as a already selected one.

Kindly let me know ASAP. Iam eager to know. Urgent...........

Regards
Soori

Your chances of getting VISA depends upon your confidance, your ability to explain whats your client/customer and how your skillsets can be used. above all choosing right company to proceed with your visa aspirations.
**** **** **** **** **** **** **** **** **** **** **** ***

1. Dont blindly go with whoever you know or
dont opt without vefifying anything just
because your friend is getting prcessed
   through same customer

2. Check the organizations prior USCIS approvals
   and rejections and VISA stampings.
3. Organization history, how long they are into
the business and whats their area of business
and their tax filing detail proofs.
4. Any organization which said to be having some
standards and ability to support you
throughout your VISA stamping process atleast
possess a decent portal with regular updates
and clear client list, Sufficinet number of
   references.
5. Do your research and be confidant about your
research, ensure that he is genuine and
capable of guiding you in yout $dreams.
6. Ready from your side, gather every possible
   credential you can have.
