H1b visa and Green Card filing at the same time?
Hi, I am currently an L2 Visa holder. I have applied for an EAD and started working in July 2016. My husband is an L1 visa holder and his company sponsored our Green Card which we filed Dec 2016.
My current employer wants me to file for an H1b visa as they do not want to depend on my husband's employer.
Does anyone know if it is possible to have both processes ongoing in parallel (GC and H1b) without having any problems? are these processes totally independent?

H4 : i94 was truncated to back dated/already passed date
Both my Spouse and Daughter are currently in US with me on H4 visa. There H4 visa is valid till 20th July 2017. Till 8/10/2016 there I94 was valid till July 2017. There were some issue in travel history of i94 for both of my depends(which was displayed online), so on mid August 2016, I went to USICS border and security office in Los Angeles to get travel dates corrected, but there they discovered/told me that for my wife old passport which has valid H4 visa expired on July 2016, so the i94 which was till July 2017 needs to be corrected/truncated to match expired passport date(Even though she has her new passports renewed before expiry of old passport). So they updated/truncated my wife i94 to back date in July 2016 (this date already passed, according to this updated i94 she will be now be out of status) and they asked me to apply new I94 through I-539 form. Also they stamped on passport visa page to update new back dated i94.
 
Similar case was with my daughter , her old passport expired on May 2016, so they updated/truncated her I94 from July 2017 to May 2016(same as passport expiry date) (this date already passed, according to this updated i94 she will also be out of status). They have also updated her passport visa page with new i94.
 
As soon as there i94 was updated/back dated, I contacted my company and applied there visa extension in “Nunc Pro Tunc” petition with application date in mid Sep 2016.
 
Along with their(H4) visa extension I also applied my H1B visa extension and amendment(My visa was expiring on July 2017, but still I applied my visa ext and amendment along with their(H4) visa extension) in premium processing, so that H4 will also be treated in premium. Unfortunately I got RFE in H1B, which was replied in Dec 2016 and I got approval for 1 year, now when we received i797, my approval notice is correct (Dec 2016 to Dec 2017) because my i94 and visa both were still valid till July 2017, but my dependents whose filing was in “Nunc Pro Tunc” petition has approval dates similar to mine (Dec 2016 to Dec 2017) even though my dependents extension was files in “Nunc Pro Tunc” petition.
There approval is neither a) Back dated from i94, nor b) From petition application date (Sep)
 
Please note that both of my dependent has i94 on i797 approval notice from Dec 2016 to Dec 2017
 
Now my wife has gap of ~5 months and my daughter has gap of ~8 months.
 
Please support how to get this rectified

H-1 H-4 and H-4 EAD Concurrent filing for renewal
My husband has applied for H-1, H-4 and Ead renewal concurrently. H-1 and H-4 are approved but got an RFE for EAD. Initially the concurrent filing was regular but converted to premium after a month. After 5 days we got approval for H-1, H-4 on same day and RFE for EAD next day. We replied the RFE as soon as we received it and the status is updated to RFE is received.
My question is:
Since i filed concurrently with H-1 will it be still considered as premium after responding to rfe or will it be processed as regular processing ? My h-4 ead will expire in few days and waiting the renewal.

L1B to H1B conversion while in USA and out of USA for >1.5 years

Hi,

I had initially come to USA on L1-B in year 2011 and then my L1-B was converted to H1-B in 2013 while I was in USA and then I repatriated to India in Jan 2015 and I am now back to USA in Aug 2016

Before coming to USA in 2016 I had to undergo the H1-B Cap exempt process

1) I want to know if total number of day I spent in USA while on L1B also is considered for maximum possible stay ?

2) I was outside USA between Jan 15 to Aug 16 so was wondering if my Max possible stay counter gets reset based on this ?

221g received but meanwhile travelling to another country
I had gone through H1B interview on Jan-20 at Mumbai and got 221g slip asking for client documents via email. I have asked my employer to forward the required documents to email provided in the 221g slip. The interviewer took my end client letter and returned all other documents including my passport.

Now my question here is,

I will be travelling to another country in the meantime and may not come back to India for a year or so.

1. If my petition gets approved and US consulate asks to submit my passport for stamping, how can I send the passport for stamping?
2. Is there any timeline before which we need to submit passport to consulate?

Your help is much appreciated.

seeking advise on H1 stamping @ India
Hi All,

I'm on f1 during the period 2013 Aug - 2016 act and worked nearly 2.6 years on OPT with a couple of clients.
now am on H1 (on oct2016 got the 3 year visa) working for clients since couple of months.
I'm looking to go h1 stamping India/hyd in Feb mid, 2017

Can anyone suggest me what are the list of documents are required for stamping? Is it a good time to go interview in Feb?
Really appreciable if anyone give best advise ASAP!!!

Reach 30 minutes before interview or Bio they make people stand in line outside 30 minutes before the scheduled time and send people in batches as per interview timings.

For Biometrics just carry I797, original passport, appointment confirmation, DS160 confirmation (for every member in case going with family), 2 photographs for children below 14 years.

What is your highest education?
Which City you will be working?
Which Client?
What is your salary over there?
What is your Designation?
How long you are working with your employer?

Answer the question as mentioned in your LCA / Petition papers.

To my wife What is your highest education?
To my Son who is 5 years old what is your age? (Just a formality) My son answered the question after a long pause. (Carrying children below 14 year is not compulsory).

And the VO said your visa is approved.

I got a mailer on 16th that passports were ready to pick up I picked them on 18th.

When you reach interview counter handover passports and I797 to VO as they ask for it first thing. Keep them handy. It took more than 2 hours to come out of Consulate.

I did lot of paper work/documentation but was not asked for any. I suggest others too to prepare paper work/documentation thoroughly just in case if it is required to show them.Please be confident, keep an eye contact. Answer without hesitation.

My brother appeared for H1B visa stamping process at Delhi Consulate today (24.01.2017), wherein after interviewing, although his passport was held back, but issued 221 g slip requiring documents viz letter from his client and payslips from month of onboarding his present job.

Background:

My brother has done MS from US and has been working since Feb 2016. The client is resilient in issuing letter.

I want to know:
If anyone has faced same experience, what is the probability of getting VISA stamped?
How many days further it might take after submitting required docs, as he is suppose in return in 4 weeks.
In how many cases of H1 B visa stamping such problem occurs.

If anyone has faced same experience, it would be great if they can share their insights

Administrative Processing H1B visa stamping Delhi Consulate
Hi all

I gave my VI on the 18th of January 2017 at the Delhi Consulate. The VO said my visa was approved. I did NOT get any 221g slips. Its already been 4 working days and the US travel docs website says your passport is under "normal administrative processing" while the passport tracker website says your passport is still with the embassy/post. I contacted the customer care number but they told me what i already know. I sent an email to the support-india email ID but got a reply to wait for atleast 10 days. I have travel plans and this is cutting it too close.

Anyone else in the same boat? Anything else that i can do? Any suggestions!
