I got laid off by my employer, can my wife still attend H4 visa interview ?

I need help regarding whether it is safe or allowed for my wife to attend a H4 visa interview.

I was working on H1-B visa for my employer and I got laid off by my employer today.
They said, I need to keep coming to work from Monday, but they will be running my payroll till end of this month.

My wife had left to India for vacation, with an approved I-797, for H4 visa.
Her current visa is expired and she needs to get visa stamping before she can return back to USA.
She had completed and submitted a DS-160 form 2 weeks ago, but did not pay the visa fee and so could not schedule an appointment yet.
Just before we were about to pay the fee and schedule an appointment for H4 visa interview, I came to know today that I am laid off.

Also, while we were filling out her DS-140 applciation, my I-140 application has not yet been submitted to USCIS.
So, we had answered NO, for the question, "has anyone filed Immigrant petition on behalf of you ?" on her DS-160 form.
Later on my I-140 was submitted and got approved. Now, today I am laid off.

I am confused now here, because my employer said, they will run my payroll till end of this month, am I technically laid off now, yet ?
Therefore, can my wife still use the submitted DS-140 to schedule and attend the interview ? Is it really risky or at least not advisable for my wife to go ahead
and attend the interview ?
Or is it recommended for her to stay away back in India, until I am able to find another job and have her apply for H4, under my new employer ? I am concerned about what if that might take too long ?

I want to know any suggestions as soon as possible, so I can make a decision.

H1B visa stamping Documents
Hi Friends,

I have few queries on the documents I have to carry during interview.

1.My employer has mailed only H1B approval notice(original) and informed that they would be sending all the other documents through email. My question is, Is that Ok if we carry the photo copies of the documents? Will there be any problem if don't carry originals? For example, LCA,MSA,SOW,Client letter,offer letter etc.

2.My employer says that LCA and I-129 are same and they woulb be sending LCA. As per my knowledge, I don't think they both are the same.

3.I work for client and I have only client letter. In client letter, they mentioned about the project I will be working on I don't have complete project documentation. Will there be any issue if I don't have project documentation.

Kindly suggest.

Info required on passport change after filing of H1B
Guys,

While filing H1B application, I have given my old passport which has validity till Dec 2015. Now I have extended and got a new one. I have few questions on this.

1) while filling DS-160 or while booking slot for Stamping, which passport number should i give. older one(which I have used for filing H1B application) or the newer one.

2) When the VO asks for passport during stamping, which one should I give..??

3) In case of an approval during stamping, will the VO keep both the passports or only one. If one, which one will he keep.

4) In 2008, I was issued a 221g for my H1B during stamping and my employer was not able to produce the documents and the case was left alone. After this I have gone for B1 stamping which was approved and I have travelled to US couple of times on the same with out any issues. Now during this H1B stamping, do u see any chances that the VO tracks the older H1B stamping result. If yes, what is the best way to defend it.

Guys,

I along with my kid and wife attended interview on Nov 5th. VO said our visas are approved. When I checked CEAC website both my wife and my application status showing as ISSUED. However my 5months old kid application is showing as Admin processing. Can anybody give inputs on this. Please suggest.

H-1B application delay for approval.
Hi All, I am sudheer here and residing in Bangalore.

I have applied for H-1B this year and I have got CAP selection. But after this there is no status update. My application still shows received only. I have been waiting since from April 2015.
I want to know is there any chances of approval of my application?
Is there any cause, delayed 7 months?

Please let me know any one has the same problem going through?

H4 to H1B Change of status denied
I received a COS denial today because I traveled to Canada while the H1B was getting processed. From what I have read online, I learnt that going back to India and getting H1B stamped is a easier solution to change the status. Is their any kind of amendment that can be done here to change the status ? Please let me know as I would like to consider all the available options and choose the best. Thank you.

If we are from a Big MNC and if we have a well known client, will they ask for any client specific documents, like SOW, Client letter etc.,?
My client doesn't provide a Client letter, what are options please can someone suggest.

H1 interview in New Delhi embassy on 2nd Nov
Thanks to Immihelp for providing this forum to share experience. It's been very helpful.

I had fingerprinting on 1st-Nov. Easy process as explained by all, took just 15 mins. No formals needed and you can take cell phone inside if it's off. I dont think they allow laptop kind bags, just file folder.

Interview on 2-Nov.
I'm a consultant working on EVVC model but my end client is a Govt agency. Employer is a small H1 dependent company. I came to India on vacation and was very worried about interview but prepared all questions. I had 2 L1s before I transferred to H1.

My time was 8:30 but I reached there at 7:40. That time 8 am line was being processed and they asked us to wait on opposite footpath, There were few benches but it was overcrowded.
At 8 they asked us to stand in queue and after few mins of wait I was inside for safety check. They stapled my petition to passport before entering inside. After that security let us sit on a bench and after 5 mins asked us to go in main building.
There I had finger prints verified and was asked to join the queue for interview.

I didnt see many people for H1. Most of them were B1/B2. When I reached at front of queue, a person asked me to go to a specific window where an interview was already going on.

To my discouragement, VO rejected the elderly couple in front of me for B2 visa. VO was taking interview in fluent Hindi. He had rejected someone else as well while I was in queue.

I was then called by VO and he asked for Passport as soon as I reached at window:

Me: Good morning Sir, how are you doing.
VO: Good, passport please.

VO: Where r u going
Me: XX, YY state

VO: Why r u going there
Me: To work for my employer
(VO laughed a little and said - I hope so)

VO: Who is ur employer
Me: Answered

VO: What is ur role
Me: Answered in 1 sentence

VO: Do u have a client
Me: yes sir, I do

VO: Who is ur client
Me: Answered

VO: Did u receive your rights pamphlet
Me: Yes

VO: Ok I'm approving ur visa- read the pamphlet b4 going
Me: Sure.

And that's it. He kept my passport. No other documents were asked. My passport was issued that night and ready to pickup next afternoon after 2 PM.

I believe confidence, preparedness and formal attire is key to clear interview. Answers need to be short and to the point. Good luck to everyone.
