Rejection after 221(G)
Hi,
I would be the unluckiest person applying for H1B. I applied for H1 on Apr 18th '05, got approval on Sep 7th '05, attended interview on Dec 21st '05. Interview was only 5min, they asked my degree certificates, US employer offer letter and Project details which I couldnt produce, eventually queried under 221 (G) for
1. Detailed Project description,
2. Active clients and projects of US employer, 3. Complete itinerary of activities for my 3 year stay peroid and
4. Client offer letter.
My employer cooked up all the above and send, I dropped those documents in VFS, Hyderabad drop box. With in 5 days i got passport and 50$ DD and a refusal letter stating that my application is been suspended and my I-129 and memorandom of rejection reasons will be submitted to USCIS, the reason could be the documents i submitted didnt meet requirements of INS.
I am currently working in the best company in the world and my employer in US in one of the best companies, even then i didnt get visa, my time is bad.
Guys, dont get afraid, make sure you carry all required documents, especially
1. Project detailed description with market analysis, time frames...
2. US employer's active clients and projects and so on......

Dear All,

My h1b was rejected yesterday. VO took all H1b papers and said that he will send to USCIS to cancel my I797 (as he says that i dont have a job there by seeing project details). But my employer says that the project sent is currently ongoing project. He wants to re apply at USCIS ( how can a visa officer can conclude that the project is dummy (My employers says)). And he says my problem will be resolved in 3 months. Can anybody has idea regarding these cases. Please respond me Iam in great dissappointment and tension too.

H1B interview
I had appointment with INS for my H1B on 25th Jan. I was very confident to get it thru as I am currently employed in a very good company in Chennai having above 7 yrs of IT experience.
When I approached the counter the officer asked me to say who I am going to work in US. I replied saying that it depends on my employers feasibility and the client requirement as he is having several clients across US. Then the Officer asked me about the clients in US for which I replied with some client names. To my surprise he was stressing on the client name for which I am supposed to work.
Then he gave me a blue sheet. The sheet was checked on some of the tabs precisely asking details about
1)the client that I am going to work
2)Contract between the end client and my employer.
3)Technology used in the project

One of the guys standing before me in the queue was asked why he was opting to go to US though he has a good job in India. For which he remained blank. Kindly send me an email if any of you came across the similar situation and tackled with out a query.

H4 Process
Hi,
I am finding very less H4 experiences. Can we please have separate area for H4, so that reading would be easier for H4 aspirants?
My problem is My wife is going for H4 visa interview on first week of Feb 2006. But my last working day in the existing company is 1st feb 2006. I resigned in the month of december 2005. I didnot get a salary slip in january(for Dec 2005 salary) and i will not get any salary till my final settlement is done. i will get a formal relieving letter on my last working day, i.e 1st feb 2006. Does my wife get any problem in the H4 interview for not having copy of my Dec 2005 and Jan 2006 salary slip?. I will be in india when my wife has H4 interview and would be travelling in second week of feb 2006. Please guide me
Thanks
Suresh

Wife got H4 in Chennai
Hi,
My wife attended the H4 interview in Chennai on Jan 21st and got her visa. This site has been extremely useful in preparing for that and I want to thank everyone for contributing their share.

She had her interview booked in english but asked for a translator when she went there. Initially the lady who gathered the documents was not happy about this and she told my wife that she book english interview and ask for a translator. My wife insisted first (taking a risk) but then gave up. Even though the lady at the counter refused to give one, she did mark her file for translator. So, when she went to the visa officer, there was a translator there. The interview itself was very simple. Questions asked,

a) When did you get married?
b) Where was the marriage?
c) Show me the wedding photos
d) When did you husband go to US?

Then she got her visa.

thanks again for everyone who posted the questions and experiences.

Venkat
