Hi ,
We are currently on L1(My husband) and L2(Me) visa, and my husband is working in a reputed org, he applied for H1 from outside agency and got clicked. Oct our status will be automatically changed to H1 and H4. I am currently working on L2 EAD.We got I 94 approval already.

Now my question is, Whether I need to stop my job after October or do I need to take leave till the H4 EAD comes? Is there any options that I can keep on doing work?

Question about my spouse for H4
Hi everyone,

I have a question. I am applying for a H-2B, and my husband has to apply for a H4 to come with me (that is done through the DS-160 form, right?)

1. Does he need to apply together with me? On the same day? If that is so, do I need to schedule two appointments at the Embassy for both of us? Or when I schedule the appointment, do I need to tell the embassy that I am coming together with my husband

2. Does my US employer have to file for a petition for my husband as well, or just me?

h1b interview
Hello All,

I recently changed my job on a project base and changed my employer, my h1b visa got denied from uscis. I found an another employer and working on transferring h1b on employerC. Based on attorney this will be a consular process and I am planning to visit India for doing my 1st h1b stamp. This is my 5th year of h1 and there are no h1 stamps on my Passport. I have f1 stamped. Please advise questions and how long usually it takes for interview process/approval and receive passport at the embassy or in your state/local city. I am from Gujarat and I heard they send the passport to Ahmedabad for collection.

Please share your experience and any advice will be appreciated

H1B transfer while in India
Hello there,

My visa status got changed from F1-OPT to H1B last year i.e 2015 and I am currently with employer A's H1B and never got a chance to get the H1B visa stamping done. Recently I got a full time opportunity from employer B and they have started to prepare my petition for H1B transfer. Also I had to travel to India due to a personal emergency couple of days ago(right now I am in India) and told Employer B that I will come back to US on their company's visa stamping. When I consulted employer B to have an update on filing status, they informed that they are going to file the transfer petition in premium processing late this week or early next week.

I did not inform my current company i.e Employer A about the H1b transfer since I don't have the receipt in hand yet. In fact my current employer knows that I am going to come back to US on their company's visa stamp. I have the form I797A (with attached I94) expiring in Sep,2018 and all the other supporting documents required for visa stamping from employer A. So here are my questions:

1. When is the right time to inform my current employer that I am gonna quit and come to US on Employer B's visa stamping.
2. Since employer B is filing my transfer when I am in India, I believe I will get approval notice without the I94 attached to it. Will this be a problem when I attend visa interview on employer B's H1B or at the POE(except I receive a new I94).
3. If at all I change my mind and doesn't want to join Employer B after H1B transfer aprroval, Can I still go for stamping on Employer A and come to US and work for employer A.
4. Can I get the visa stamped on employer A and enter United states and work for Employer B(on whose approval notice there is no I94) or do I need to go out of US again and get a new I94 card.
5. Since I haven't worked for employer B I don't have any paystubs from them. Is it ok to show employer A's paystubs during visa interview.

Pls let me know If you have any other safest route to tackle this situation.

H1B - approval validity dependency on passport validity
Hi,

I just learnt that my H1B petition got picked in the lottery. When I submitted the documentation for this petition, my passport has another 12 months of validity. I submitted my passport for renewal which I will may receive in next couple of weeks. Please address my following concerns.
1. Do I need to send a copy of the latest passport (after renewal) to anyone ?
2. will the H1B approval period decided based on my old passport? or is it ok to go with the new passport when I go for stamping in India?
3. I am currently in US with L2-EAD status. If I plan to visit India this year, is it advisable to change the status from L2-EAD to H1B (if it is approved) after my return ?

H1b petiotion withdrawn after visa stamp, still i am cap exempt?
Hi. I have obtained visa from employer A for the period of 01 Oct 2015 to 30 Sep 2018. Due to some personal problem, i could not able to join employer A. Today i have received mail from employer A stating they are going to withdraw my petition (cancel my H1B). Now if employer B is ready to sponsor me visa,
a) am i cap exempt?
b) Will there be any problem for me to get visa as i did not join employer A after getting Visa?
c) Hope i am eligible for interview waiver (Drop box)?

10. Do you have any children?
11. Why are you going alone?
12. When do you intend to take them with you?
13. Tell me more about the software you will be working on?
14. Address where you will be working? is this the same as your company's main office?
15. Have you been to XX state before?
16. What was it for?
17. Is this a fresh H1B?
18. How did you hear about this company?
19. How did you get to know about your previous US company?
20. Do you have any children?
21. How long has this company been running?
22. Do you know the name of the CEO of the company?
23. Have you worked on this software before?
24. What are you currently working as?

Thats it. Then came the golden words "Your Via has been approved and you will get an email once your visa has been stamped"

My advice ...... just like everyone in the forum suggested ..... Be Confident and Be Honest and you will not have any problem.

H1B Visa refused under section 214 (b)
Hello,

My H1b got refused on 13th April 2016 at US consulate in Mumbai INDIA.

Now i am reapplying the H1B visa, please help me to get below mentioned queries.

1. Is it necessary to make the changes under DS160?
2. What types of questions they may ask as my Visa has been refused earlier?
3. What should i answer if they ask why are you reapplying the visa again?
4. There will be impact on the second interview?

H1B visa at HYD Consulate-221g
Had Interview on 25/04/16. The interview went well. Answered all the questions. Regarding the contract between my employer and client it was dated back then 2012. The VO then issues 221g and writes "Please email Employment Docs to [email protected]".

Can you please help me on this. What might be the documents that are need to be emailed.

H1B transfer from US
Hi ,
I got H1B visa stamped in India from Company A. Now they dont have client , so I did not go to US on this visa.
Now Company B want to transfer my visa but they are asking me to come to US and they will take care of all expenses. Once I will get the client they will process the H1B transfer.

My question here : Is it possible to do H1B transfer without pay stubs as I did not work for Company A and I will be in US.

How can I proceed with this situation ?
