update about H1 B stamping in India
Hi all,
I was going to get married in October 2020 to a H1 B holder (new H1 got approved in first week of July 2020).
He was going to travel to India for the wedding and then apply H4 for me however because of the restrictions our plans have gone into the drain.
I wanted to know if he comes to India now will he get a chance to stamp his new visa also in case we get married, is the embassy processing new H4 applications ?
Are there anyone in the same boat?

H1-B VISA Correction
Hi,

I came to India in February 2020 for my H1-B VISA stamping. On March 18th 2020 my visa was issued, but due to the complete lock-down I wasn't able to collect the passport until the consulate mailed it. When I received the passport around June 1st week, I observed that on my VISA Petitioner Name (PN) and Petition number (P#) were completely incorrect, but at that time the consulate was still closed. If these two were correct I would have had a valid VISA before June 22nd Presidential Proclamation and eligible for travel. In August, consulate started processing F, M and with some exceptions H1-B visas.

--- May I know the process for visa correction? When I contacted the Hyderabad,India consulate, they have provided me with this link to follow https://www.ustraveldocs.com/in/submitting-your-documents.html . I would like to know if I have to book an appointment for this or I can go directly to submit the documents using "document submission letter" mentioned the above link.
 
--- My VISA issued date was on March 18th, 2020 which was before June 22nd, 2020 Presidential Proclamation. Technically, I should be eligible for travel if it wasn't for the incorrectly printed details on my VISA. Since this was a printing mistake by the consulate, I assume correcting the details on already issued VISA will not come under the actual processing of H1-B. Please correct me if I am wrong. Does this case considered as an exception?

Please help me understand the above two queries and advice the further steps to follow.

Which I797 spouse show show
Hi All,

I am in US and got my new H1-B approval (I797) valid from Jan 2021 - Dec 2023.

My old I797 and H1-B visa on passport have expiry of Dec 2020. All stampings/approvals are from same employer.

My wife plans to take H4 emergency appointment and travel soon to US from India.

Does she need to show old I797 during the visa interview if she plans to travel before Dec 2020 ?

Also, can she show new I797 at port of entry to have her I-94 till Dec 2023 ?

Is US government currently issuing H4 visa.
I am a citizen of India and have recently been married to an Indian who is currently residing in US under H1B visa. He is a holder of this visa since 2016. Also, his H1b was activated and stamped before 22nd June (that's when the trumps H1B proclamation came into effect).

I need to know if US embassies is taking application for issuing H4 visa whose spouse already has an active H1B.

I have Canada PR and my h1b visa stamping date in canada is Nov 2020. Wanted to check id h1 stamping is still on? And even if i managed to get my visa stamped, will i be able to return to US without issues in this covid situation

H4 stamped 2022 but i94 valid only till 2021
Hi,

  I got h4 visa stamped based on my husband new employer till 2022. But when I reached US, immigration they asked for my i797A(with husband old employer)which is till 2021 only and gave i94 till 2021 only.

Can someone tell me what is the process for extending My i94, whether should I apply for i797 extension or anything else?

I-94 reduced due to expiring passport, could H1B Extension be filed now
Hello folks.

back in 2019 i had my I-797 and I-94 valid through mid 2021, but when i traveled outside the country and came back,the CBP officer reduced my I-94 based on my going to expire passport and reduced it to early 2021 (with difference of nearly 5 months between the i-94 dates).
my wife who is on H-4 has her i-94 unchanged (same as original 797 expiry date).

I had plans to travel to India this year to correct my I-94 on my way back,but due to covid,it was cancelled.

Now i have few questions:
1. Am i eligible for H1B Extension as my new I-94 expiry is 5 months away with more than a 8 months remaining on my 797 expiry.
2. since my wife's H4 is tied to my H1B ,is her I94 effected by my extension in case it goes though successfully. (i.e does she need extension)
3. can i file for her extension of status before 6 months,as she has more than 6 months left on her I-94.

P.S i got my passport renewed. and i have period left on my visa.

H1 visa validity before travel and after stamping
Hi All,

I get VISA stamped (in FEB'20) first time but unfortunately am unable to travel till now due to COVID'19 pandemic. I am having some doubt's that need to clarify here, i.e

1.) When does the three year clock starts?
     - The start date on the petition or the day the visa is stamped or the day when one actually enters the US?

2.) How long one can stay in home country after getting the visa stamped?

I94 expired on old passport (for spouse)
I have a situation here. When me and my wife entered US on Feb 15th, 2020, my wife’s I-94 got extended only until July 4th, 2020 (because the passport expires 07/04/2020) in spite that my H1-b visa and my spouse's H4 expires on Oct 25, 2021. Due to COVID situation, passport renewal got delayed and is issued on 08/12/2020. At this point I-94 is expired and need extension on my wife’s new passport. Could you please advise if this is necessary and if yes what needed to be done !? How do we submit application for I-94 extension ? Thanks in advance.

H1B denied on receipt notice - Urgent advice please

Employer A Petition Valid till 19-JAN-2023
I-94 based on Employer A Petition till 29-JAN-2023
Transferred to Employer B on 15-MAY-2020 and working on receipt notice.
Employer A H1B withdrawn on 20-MAY-2020
Employer B transfer petition denied on 12-AUG-2020 due to Specialty Occupation.
1) Is my I-94 still valid till 29-JAN-2023 even if my Employer A withdrawn my petition?
2)Can my current employer file appeal ? is it good to go with that way.? what are chances of approval?
3)Can I continue being in USA and try some other company and the employer can file for a transfer?
4)Could you please suggest what are the available options for me further ?
