H1B, H4 Visa

Hi,
Me and my Husband both are working in IT Field , We applied for H1B thru one company in US. But in this lottery process,
I got selected in random pick, but my husband was not selected. As I can’t go there alone and I don’t want to miss this Opportunity , thus after thinking a lot, we have decided to go H1 for me and H4 - Dependent visa for my husband and my son (2 years) . Now this month we are planing to go for visa interview.

Now our major problem is that, in interview how to justify that husband is going on H4,however as in my all docs they can see we both are working from last 7 years and my husband working as a Project Manager. What should my husband reply if VO ask any of these questions...

1) "Why you are going on H4, as u know you will not be able to work on H4"
2) "Your are having much exp/current salary then your wife even you are going on H4?"
3) "What will you do there?"
4) "What is your future plan related to your career as you are going on H4"
5) Any other obvious question coz of this H1-H4 case

Any answer/information related to these questions will be very helpful to me.

Thanks to immihelp for having a platform to share our experiences which in-turn helping those who are preparing for it.

Preparation :
I wont give any suggestion on the documentation because you had to get all the documents as suggested by some of the other members .

OFC on 8th Dec 2014 :

There's a big queue outside and we need to wait on the footpath yes foot path in a queue to enter the premises . So suggestion was reach there just 15 min before and at the starting of the queue find the board with the slot timings go an join the queue .

As said please look at the board with the slot timings at the starting of the queue as the queue messes/merges going further and you wont know in which line you are standing and its my personal experience and there's nothing to do inside just biometrics (scanning ur right and left hand) and get the stampped DS-160 which need to carry the same document for the next day interview

Visa Interview 9th Dec 2014 10:30 am:

Reached the venue before 45 min and the queue was around 200 mts long . Will miss the timings if we stand up in the queue So went ahead and spoke to the VFS employee and told him that we had a kid and listening to he checked someting in the tab and asked us to go ahead (we are lucky here as the queue was long and its very hot with full traffic) .After that there's a queue to deposit your personal belongings so make sure you wont bring any electronics or bags and I promise it will delay the whole thing and brings up more tension .

Point to Note : Except your documents and some money dont bring any sought of bags or electronics (Security wont allow the file pin inside) .If you have anything then need to stand in another queue to deposit so think about it . They wont allow the File Pins inside so make sure you staple it and put it in a plain transparent file .

So After depositing the personal things you need to stand in another queue where the manual security checks your timings and passport along with the DS-160. He will opens the gate and now you enter the consulate(Till this time you will be in the open footpath with no cover under hot sun and full traffic) again one more security check where they will dump your documents in to a tray which will be scanned and one more human security check .Once cleared you will go inside and wait for the dependent as they are standing in another queue

Points to Note : Till the above point you need to stand on footpath with no cover ,full traffic and pollution . The security guys inside dump the papers and files in the tray after scanning while collecting it back please make sure all the originals and xerox was collected correctly any mess here will create more tension . take time and no hurries (I noticed some senior people documents got lost here in the sense the sequence and they had no idea which one to show for the VO when asked)

Real process :

You will enter the main building where a person will scan the passport and gives you a token take that and follow a queue where the finger print(which was taken on the biometrics) check happens and the structure remains the same (visa interview where a lady/person sits on the other side of the glass and as asks for information) and nothing will be asked just greetings exchanged and finger print checking .

Sit there and wait for the token number gets displayed and proceed to the counter

Point to Note : Listen carefully about the questions and slang which will help when your turn comes(We did the same) . guys before us was from cisco and everything was clear for him but while explaining his R & R along with project I can hear the stumbling of the words and got confused and got some slip for submitting some documents .

So its our turn and we went ahead and made my son to seat on the slab and kept the all documents to the other side

VO : Good Morning
We : Good Morning

VO : How are you doing ?
We : Doing good

Informed my wife to take the kid from the slab as some one had fallen down last time

VO : PP
We : Handed over the PP

VO : Which company you are working
We : Answered

VO : Which client
We : Answered

Golden Words "Your Visa Approved" and handed over the pamplet

By the time VO told that golden words my kid pulled out the finger print scanner and asking my company tag .... In this confusion the VO had given us the rights pamphlet and called next in the list ..... After that re-arranged everything and got it confirmed from the VFS employee and re-checked everything and left the premisis in the same way which we entered

POINT TO NOTE : AFTER COMING OUT BE SERIOUS(IN THAT HAPPY MOOD ITS DIFFICULT) DONT LOOK AT ANY AUTO WALAS AND DONT RESPOND/CONSIDER AT ALL .IF YOU LOOK THATS IT THEY WILL JUMP ON YOU LIKE HONEY BEES AND ASK 150 FOR 1KM SAYING TO GIVE IT IN THAT HAPPY MOOD SO MY SUGGESTION WAS DONT STOP ANY WHERE NEAR AS THE AUTO WALAS WILL LOOT YOU LIKE ANYTHING (NOT EVEN LISTEN TO THEM OR CONSIDER THEM). SO GO AHEAD AND DONT STOP ANY WHERE NEAR THE CONSULATE AND WALK ATLEAST HALF A KILOMETER SUCH THAT AUTO WALAS CANT FIND YOU WHERE YOU ARE COMING FROM THEN STOP AN AUTO AND BARGAIN (GIVE THAT EXTRA MONEY TO POOR ON YOUR HAPPY OCCUASION) . HIGHLIGHTING THIS AS I AM A VICTIM WHO RESPONDED AND PAID A 130 FOR JUST A 1.5 KM . DONT EVEN DRINK THE TENDER COCONUT OUTSIDE HE WILL ALSO LOOT YOU

I have visa interview scheduled for next weekend over Mumbai consulate. My petitioner has sent me I-797, I-129 and LCA docs. He has sent one envelop for visa consulate which contains financial docs for last year and RFE response document that he submitted while replying my RFE.

Now, Mine is client project. I have repeatedly asked my employer to send me client letter but for some reason he is not sending it. I am feeling nervous because of this. Is client letter one of mandatory document ? Can it lead to 221 g ? What should I answer in case VO asks for it ?

Mine is internal project and i have given 221g for project document and existing employees list, which my employer is not able to provide them.

can i move to another employer with same h1b position, in which i need to work at client place and will be able to provide client letter.

mine is in-house project and i have submitted project doc and required documents. but they wanted to see the credibility of my employer that does they have ability to pay me for in house project. As my employer is small with 10 employees/

H1B Interview:
what is your name?
employer name?
project name and description?
wht is highest qualification?

then given me USA rights booklet

then started actual interview

is this inhouse project?

asked me to provide i-129 and project description docs

told me to wait in lobby and waited for 1 hr. then Indian lady came and asked all my petition related docs.

then waited another 1:30 mins

called me to one closed room for interview, this time one India lady taken my interview.

how do you know your employer?
she had doubt and asked me, is he relative to you? (though is not relative to me, if yes also what is the matter on that. these people doesn't have sense to take interview in right way to get the details.)
she goggled and told me this kind of projects are avail in market, why do you need to develop? i explained her nicely
she said:we don't have any issues with you, we have doubt on your employer, we need to check that they can pay you for inhouse or not, as it is small company.

then she asked.
how much you paid?

actually my employer is small but its genuine project.

end up with 22g.

All viewers: please ready complete petition documents and be prepare for all kind of questions. if yous is in-hose project and small company, 100% they will give 221g for some more documents. be prepare for that.

Actually USCIS has been done necessary verification and approved h1b. But in interview time, these people would ask somany unwanted question and waste of time.

I attended h1 interview in Hyderabad consulate on December 3rd 2014 8:30 slot. My visa was approved but the status was changed to issued on
on December 10 th 2014. It took a week to update and stamp passport for some reason.The status said that my passport is still with US Embassy/Consulate and after a week it changed to passport is ready for pickup. I thought it went to admin processing and waiting for the updates. I was not issued any slip and VO said my visa was approved. I thought my experience might be helpful to ones who are on same boat.
No need to panic once your visa is approved and you are not given any slips. Below are the questions I was asked.

1) date of birth ( I think it did not show up on screen)
2) whom do you work for?
3) Who is the client?
4) what do you do for the client?

VO said my visa is approved.

HI, Good Morning to all of you.

I have an employer A who initiated the visa for me and is stamped. I am ready to fly to USA in a month or so.

However, I am beginning to get full time offers from some major companies.
I feel its unethical to leave the employer A who had gone through the hassle of doing my visa. However, the offers are too good to resist. I will fix this dilemma later.

My question here is, Can we do a H1b transfer from india itself and report for new employer. If I tranfer, should I attend for stamping again..I am hoping that this would be a problem, so that it will clear the dilemma for me and will consider swtiching after an year or so..

I am sudarshan. My current employer is filing H1B for me.I have completed B.E.Mechanical and being from a non IT background I have to have a detailed experience letter from the previous employer.

However my previous empoyer is not willing to provide me the same.As an alternative I have with me Superwisers affidavit stating my roles and responsibilities.

However my question is
As previous employer is not willing to provide me the detailed experience letter if they come to know that their employee (my superwiser in this case) has given affidavit to its X-employee will they do any legal action against my superwiser.

Questions:

VO: So you work for XYZ?
Me: Yes

VO: You are working in ABC state?
Me: Yes

He asked me informally whether there are any kids in the queue behind me, I looked around and answered appropriately.

VO kept the passport and said "Your visa is approved".
Thats it. It took less than 5 minutes for whole thing, but of course I was in the queue outside of the consulate for close to 2 hours.

Also, make sure you don't have any closed envelopes in the documents you carry. Security is strict and they were frisking everybody rigorously.

Date : 4th and 5th Dec
Location: Chennai

 My Case:
    The passport number on the appointment confirmation letter is not same as my new passport no.(Got my new passport after fixing the appointment using old passport no)

Dec 4th:
  On entry at OFC office, they cross checked my passport details to the DS-160 form, since there was a mismatch they asked me to updated the DS-160 form in some browsing centre and come back soon.
 Autowala waiting outside directed me to a place where a guy does this job. It’s not a browsing centre but he does this job alone charging 300/ per form. Since it’s my need and am running out of time paid him the amount he had asked and got my DS-160 form updated. Autowala asked 100 for to-and-fro bargained to 50/

Later went back to OFc and finished the job.

Dec 5th : The BIG day
 After waiting in long Q for some time entered the consulate. They verified my passport and DS-160 form confirmation no and said "We cannot find your appointment in our system". Shocked.. Asked me to wait... after an hour of wait they called me back and said it’s because of change in DS-160 form, it’s not detecting the latest and will go with the old one... After giving again the biometrics I was placed in the final Q...

1) Who is your employer?
2) Aaaw your B1 was cancelled when applied for H1?
3) It’s a mistake from our side, a junior person might have made this mistake.A person can hold B1 and H1 together, since its valid till 2017 I can revoke your B1.Do you want me to revoke it?
4) Again ..Who is your employer?
5) How did you come to know about this company?
6) How big is your company?
7) Are you working for client?
8) What about your family?

then comes the golden words "Am approving your visa"...

I asked him back does he need any other docs... he just replied

No ...just go and book your flight ticket :).

Thanked him and left..

TIPS from my experience:
  1) Keep sync the info between the DS-160 and passport. A minor change in name also caused problems.
  2) Be confident.
  3) For passport renewal in tatkaal process at passport seva kendra, carry 2 address proofs.
