H4 Visa stamping
Dear H4 visa applicants
After reading a lot about the interview process, I was a bit cautious even though it was a dependent visa interview. My interview date was 12 Aug 09 and I planned everything so carefully so as to make sure that nothings goes wrong but it did.
I arrived at the consulate office (Mumbai) around couple of hours earlier to my scheduled interview time. I was holding my documents file while standing in line waiting for the call. I would like to quote my experience in terms of following do’s and don’ts.
1. Any kind of leather purse is not allowed inside consulate except your wallet to keep the money.
2. You should be having your passport and interview letter handy at the time of call, only these two things are required to gain access inside at the time of your scheduled slot (after your call by the person standing outside).
3. Arriving half an hour early is good enough as access inside depends upon your time slot irrespective of huge queue (usually people with later time slot stand and wait in the line and makes it like so crowded). Consulate personnel would call for the time slot so even if you are towards end of the queue, you can always go ahead at prescribed time.
4. When I had gone in inside, after initial scanning, lady at the scanning counter showed me the way inside to a hall and I was asked to stand in a queue to submit my passport and interview letter to collect a package of documents in a green VFS envelope.
5. I was waiting at the counter when two ladies dealing with this process couldn’t locate my pack.
6. After a couple of minutes, they showed me a seat and asked me to wait until they are able to locate my documents.
7. People in front of me and after me, were moving ahead happily as their documents were being handed over to them.
8. After waiting for around an hour, lady called me and gave me my envelope and said, I have made a mistake while filling up DS 160 form and so I can’t go ahead with the interview process. I’ll have to go back, fill up the DS 160 form again, submit and then would take a new interview date.
9. I was stunned at this disclosure and was not convinced at the explanation. When asked about the mistake, she only said, I have not chosen visa category correctly. Where and which field, was not known and I was shown the way to exit quickly.
10. In panic, I forgot my passport at the counter and came outside and called my taxi guy to take me to VFS office to understand the reason for rejection which is around a couple of kms from consulate.
11. After waiting for a long time, I was given permission to talk to a lady at VFS and she explained me the same thing (wrong visa category chosen). Which field and which page in the form, she couldn’t answer. In fact when I pressed more, she said, I don’t have access to your form and I can give you only generic information. And she told me positively, that this is not a rejection but unacceptability and two things differ by a great deal.
12. Accepting this ray of hope, when I said, I accept my mistake but when documents were already validate and my interview letter and other documents mentions visa category as H4, I got the same response. However I quickly understood, as per US visa process, this is the only option available to me.
13. So friends, word of caution here is – please validate your DS 160 form doubly before you submit it, as in some rare scenarios, it will not throw an error and not all the business rules have been incorporated in the online application.
14. And once it goes wrong, process becomes so lengthy, like starting everything from scratch.
15. I am post this experience because I read too many tips on the visa interview (all useful though) but nothing on these lines. So all I want is my first hand experience may prove of some use to others.
16. Just to complete my story, you need to reactivate the HDFC receipt before you get your interview date. And for that you need to visit the VFS office with both the receipt copies and your passport.
17. I have been informed a date of visa interview which was a month later than my earlier appointment, i.e. 13th Sep 09. Fortunately everything went well that day and I was qualified for H4 visa after 5 minutes of interview without evening showing a single document. Now I am enjoying my vacation time with my husband in the US. To tell you, interview questions were plain and simple what you get to know after reading the stuff on this website.
18. All the best!!

H1B approved after 221G
I had been to US consulate on 10th Aug 2010 for H1B Visa interview. Actually my petition was approved on July 2009 itself.

Q: Why you are coming late since your got approval on last Oct ?
Q: Where you are going to work ?
Q: Is it internal project or client project?
Q: Whats the project name?
Q: what you are going to do for Edify?

Finally Visa officer issued a 221(g) Blue form..

they asked for the following docs to submit at VFS office (Eventhough I had most of the docs).

1) A copy of the petition with all supporting docs as filed to USCIS.
2) A copy of employment contract or letter of agreement signed by you and petitioner.
3) Petitioners income tax return for the last two tax years and financial statements
4) A notirized lis of all the petitioners employees of job site listed. A list show all employees names their specific job titles, start and end dates, and their invidual salarie and immigration status.
5) State Unemployement Wage Reports showinf all wages paid to each employee in the state, for the past three quarters as filed to

 All states

 States of .

6) A detailed and specific description of the internal project developement to which you will assigned. include a complete technical description of the project, employer, timeline, current status, no of employees assigned, work site location and maketing analysis for the final product.

Then I got the missing docs from my employer at last week(20/09/2010) and submitted on (23/09/2010)...

Finally I have received my passport with VISA stamped today. They took only 3 working days.. I am surprised...:)

Dont worry guys if they put the REF.

Thanks

Regarding experience letter of past company.
Hi,
I have my H1B filed this year through Mumbai. However I am in worry because I do not have earlier company's experience letter. I have earlier companys appointment letter, lst pay slips, Form 16 etc etc. I have served there for seven years but because of service bonds, they didnt give me experience letter.

My questios are :

1 ) Will experience letter of earlier company become problem for me ?
2)Can I submit fake certificate in such case, as I have really served there.
3)What are the chances that my H1 will not get get stamped because of this.?
4) This is the only document I do not have.

Please advise.
Thanks in Advance,

Smita

Successfull H1 stamping at Checnnai with I797B
I attended visa interview on Aug 31st at Chennai and got my visa with out hard time. Hearing experiences of people who are/were in similar situation like me and lot others scaring me including the attorneys that i have slim chance of securing visa, i lost hope of getting visa. But by gods grace i got it with out any hiccups. But the pre-visa tension was terrible and i had to live with it for like 8 months. Hoping that this would give some information needed and confidence to others who are in situation like me, i am writing this.

Case Description:
I am now working as full time employee as programmer analyst for company C. In the month of Aug 2009, transferred my H1B to current employer (C) from employer (B). Initially i got a query to show that i am status. I submitted the latest pay stub. In Feb 2010 i got I797B saying that the employer B revoked my petition in Mar 2009 and i am out of status by the time i transferred my H1B to company C. I am not aware of the revocation with my previous employer B. I am not in project at the time of revocation (Mar 2009), but after 1 month he himself put me on a project and i worked for him till Aug 2009 and he paid me till august. He never directly or indirectly mentioned about the revocation till this date, only i came to know about the revocation from the USCIS letter with I 797B. As soon as i received I 797B, initially i planned to go to India for visa but after legal consultation (as i have a valid visa from employer A which is valid till September 2010), i traveled to Mexico late Feb 2010 reentered with company C's H1B doc and obtained a new I-94 valid till Sep 20, 2010.

I attended visa interview on 31st 2010. The VO only asked questions based my current employment like about project, salary, how long i have been working and pay stubs. He did not ask a single question about my I797B or my troubled previous employment. All the best guys who are in situation like me.
