wrongful deportation in B2 visa which lead immigrant visa denial
I am writing to formally share my sister's wrongful deportation from the United States and the subsequent visa denial based on that decision. I believe that the deportation was the result of false accusations and misinterpretation of facts by the port authorities at the time of her arrival. This decision has caused significant emotional and financial hardship for my family and me.
My sister previously visited the United States multiple times from 2002 to 2007 without any legal issues. However, during her last attempt to enter the U.S. several years ago on a visitor visa, she was deported by a port officer without justification or strong evidence. At the time of her deportation, she was not given a fair opportunity to present evidence or defend herself against these allegations. Due to the traumatic experience, she did not immediately disclose the details to our family. However, this wrongful decision recently led to her immigrant visa refusal, further separating our family, including my aging mother, who is highly dependent on her. The emotional toll on my family has been severe.
Recently, after discussing the incident with my sister, we identified key points from her conversation with the port officer during her deportation:
1. Overstaying in the U.S.: She never overstayed her visa. On one occasion, she remained in the U.S. for an extended period with USCIS approval. We can provide official documentation to confirm that her stay was legally authorized.
2. Working in the U.S.: She has never been employed in the U.S. and has no history of unauthorized work.
3. Fraudulent Employment Details: She was wrongly accused of misrepresenting her employer’s information. The company she listed in her application is a legitimate entity, both in her home country and in the United States. We have sufficient proof, including business registration documents, tax records, and employment verification, to confirm its validity.
It is deeply concerning that my family must suffer due to what appears to be an unfair and unjust decision made by the port authority.
I am seeking your advise/comments or suggestion what would be our next steps, as it is critical for our family’s well-being.
Thank you for your time and consideration.

Help Needed - Not seeing option to submit additional documents
Went for L1 interview and the officer approved I-129 and asked if I was traveling and I said yes, he then handed me the below instructions, but when I login I don't see the option - what could I do? How long does it usually take for this option to become available.

The officer told you that you are otherwise approvable, but you need your passport immediately for travel? No problem. We are returning your passport to you today and administratively refusing your application.

When ready to return your passport, please log on to your account at https://ais.usvisa-info.com/en-ca/niv and select the "consular section instructed me to send more documents" option. Follow the instructions and return your passport to us to continue processing your application.

I94 expired in June 2024, but H1B stamp is valid till Oct 2025. How do I fix this?
Hello everyone Can someone suggest

The i94 on my wife’s i797 has a validity until 2025 Oct and this i797 was issued in 2022.

She entered US in April 2023 and was issued i94 until June 23 2024 , as this was her passport expiry date [which is again June 23 2024].

We didn't realize that this i94 date has been shortened due to passport expiring before the i797 expiry.

We found out this issue today while going through our documents , now if the i94 issued at port of entry is valid [which is June 23 2024 ]and not the i797 one [2025 Oct ], then in that case she has overstayed by 4 months already as its [Oct 25 2024 ] today. Is that the case?

how can we resolve this matter?
