EAD Approved - Spouse of an H-1B Nonimmigrant--(c)(26)
I applied for my wife's EAD on Dec 6, 2017, after my H1B extension upon getting approved I-140. I completed I-765 on my own without lawyer's assistance. (My company lawyer quoted $1200 for this. I only paid USCIS fees of around $400). I sent completed documents to Nebraska center (since Michigan falls under Nebraska jurisdiction as per I-765 instructions) on Dec 6 and receipt was sent on Dec 12, 2017. However, receipt number was starting with EAC meaning it was sent to Vermont.

We received approval notice on March 17, 2018, and EAD card on March 19, 2018. Processing time as per on USCIS site was more than 115 days for Vermont. (As of Jan 31, 2018, they were processing Oct 9, 2017, applications). So I was expecting a response by the first week of April. I was expecting an RFE or denial since I sent wrong I-797 for H1B principal's spouse. (or at least I felt it was a wrong one). I realized it just after mailing it but did not find any way to notify USCIS or send an updated document. I could only notify address change.

I thought of sending an inquiry yesterday. But to my surprise saw an approval notice from USCIS in my mailbox on March 17. I guess USCIS did not send RFE to notice because either I only thought I sent wrong I-797 but sent correct one (I have two I-797, one for approved I-140 and another for H1B extension based on approved I-140. I sent the second one.) or USCIS had the records with them and did not need me resend another I-797.

So it took 91 days for an approval. I did not follow-up with USCIS. USCIS "My Case Status" is still showing my case status as "Received". I guess they update that after few more days.

Waiting for a Work Permit 160 Plus Days
This forum does give me some hope and at least lets me know that others are experiencing delays. Congratulations to those and/or their spouses that got work permits and the best of luck for all of us still waiting.

 I do have an attorney and after 100 days (10 days after the 90 days) they sent an inquiry asking about the delay. The response from USICS to the attorney was they would respond by February 24 or before, but have never responded.

October 3, 2017 was the initial date. USICS inquired at the end of October claiming we had not sent a birth certificate and translation, which in fact, we had. The attorneys asked us what the Ivory Coast (Cote d’Ivorie) issues for birth certificates and we indicated that what we had was what they issue which is to say it has an official seal but isn’t a fancy document. So, we resubmitted the same birth certificate and translation they already had and they acknowledged receipt on November 16, 2017. They have not asked for any further documents.

So, what I do not know is, if the official initial day 1 is October 3rd or November 11th? The attorney says October 3rd.

At some point soon, I am going to ask the attorney about contacting the Ombudsman. I hesitate to contact my senators and congressman for one particular reason: in Texas, all of the applicable legislators have negative views towards immigration, so, I cannot see them helping, even though they might surprise me.
 
As I read through this post, it seems sometimes ombudsman help and sometimes they don’t seem to make a difference, but, I can hope when I get that point.

So, we wait.

Want to share w/ you guy my frustrating experience, seeking help.
I applied for my wife on 10/03/2017, 168 days ago, yet, no EAD till now.

- Filed 4 SRs, no response.
- Contacted Senator 3 times, USCIS said they are processing cases the order they were received, nothing they can do.
- Called USCIS many times, no help at all.
- Contacted Ombudsman 03/12, no response yet.
- Expedite request denied citing insufficient evidence.

- Info pass scheduled next week. I am supposed to travel out of the country in 2 weeks. Any advice you can give me to ask at Info pass if they can issue me a travel document on the spot? Please help.

Please everyone, my case as been pending for 170 days. I have a lawyer but he isn’t doing anything about it. I’m trying to contact ombudsmen as I see they have helped a lot of people on here but I don’t know how. Please can someone give me the website or the link to contact them.

Different information on myaccount site and Case status site

I created an account on the myaccount,uscis website to see if I had any positive news as many apparently had. Unfortunately this was not the case for me.

However I did notice that the information is different from Case Status page... but not in a good way.
The received date information is different on both sites. One says Dec 26 (myaccount) and the other (as well as my paper receipt) says Dec 20...
anyone has the same experience?

Also, did anyone receive their renewed EAD card without status having changed on either websites?

Have submitted expedite request on Feb 23rd - denied on Feb 26.
Contacted Congressman Feb 28 who got answer from VSC March 6 saying my case was assigned to an officer for response.
SR (from my lawyers) on March 12 - response mailed March 15 but still havent received letter so dont know what they will tell me.
Went to local immigration office on March 14 (managed to get an appoitnment on Infopass) but they said they could not do anything.

My expiry date for my work permit was March 13 so have been suspended from my job.
I need my renewed EAD in the next 21 days or my employement will be termintated.

Did the fact that my lawyer raised an SR on March 12 stopped the March 6 process from COngressman? I am getting worried... thanks for your advice.

EAD Extension Rejected due to the Outdated Form
Today I got a big package from USCIS,
So excited, would it be interview notice?
NOOOOOOO, My EAD extension request I did one week ago, was rejected because of outdated form.
It says
"The application/Petion was filed on outdated version of this form. Please resubmit on the current version.

What does it even mean?
i-765 form in the site is expired in 2/28/2018 but it says current version is still valid until the new edition comes in.
In fact I waited couple of weeks hoping that they will release a new updated form, but it did not happen. I contacted to USCIS website administrator, they said you can use this form. I also contacted to USCIS customer service they said you can use the expired form as long as edition matches. So why did I get this message?
Any idea please?

My i-765 form is exactly same with the ones on the site, the edition date and expire date...

L2 EAD Renewal
1. My case got approved on 91st day. Received notification of approval (I797) on 95th day. Expecting card in couple of more days. Below is the story....
2. Raised SR on 75th day, 78th day response received was your case is being processed.
3. After reading through this site, I contacted nearest Congress office and on 86th day. My case was picked up by them on 87th day.
4. Raised SR to USCIS on 88th and 91st day. Every time same answer our request will be processed.
5. Called Congress office on 91st day to check if they can raise expedite request on my behalf. Receptionist find out from case worker that they have already taken necessary steps, i don't have raise expedite request to USCIS. When you call to congress office they never allow us to talk to case worker. we need to probe the front office workers to get updates from case worker. That is what i felt.
6.I kept on checking on USCIS website for the status but there was no change.
7. On 92nd day I called USCIS and raised another SR they mentioned that can be expedite request as my case had crossed 90 days. At the end of the call same statement again ... wait for 15 to 30 days to receive response.
8. On 93rd day I created my account in https://myaccount.uscis.dhs.gov/. I got to know about this new site when i read the Forum blogs in this immihelp.
9. To my surprise my case on approved couple of days back that mean 91st day it self it was approved.
But even now there is no status change on the USCIS site. I was almost loosing my job. I kept borrowing additional days of leave from my employer.
10. I felt that registering my case at congress office was helpful. I had added detailed one page explanation also while I submitted the privacy act form at Congress office.

did Biometrics on September 1 2017

since then didnt get nothing 7 months already

i called so many times and i got an email on march 1 2018
 for the form i-765 that says:
"your case is currently under review , you should receive a decision or notice of other action within 60 days of the date of this letter"

today on march 16 2018 i receive a letter for form I-485
"form I-130A , supplemental information for spousal Beneficiary was submitted,however,page 1 , part 1 ,item 3.a and 3.b of form I-130A list someone other than the beneficiary OR page 1, part 1 item 3.a and 3.b is blank.
sumbit a completed and signed form I-130A , for a spousal beneficiary"

now what is this letter exactly mean?
is my I-765 gets effected? im am waiting for that and need work permit
what should i do next? i am wating for so long
