Employment based EB2 - RFE on Non Availablity Birth Certificate
I am August 2018 filer and was waiting for EAD to come, but unfortunately received a RFE letter today after 5months to submit additional evidences related to Birth certificate. My birth was not registered and hence I didn't had birth certificate. As per attorney guidance, submitted 2 affidavits and non-availability letter signed by local registrar office in plain letter since there is no standard format for non-availability birth certificate at the time of filing on Aug 2018.

RFE says:

1.Submiited affidavits are not enough. Secondary evidence should be but not limited to church or school records indicating name/parent name, DOB or hospital records or govt issued document.

2.where BC record doesn't exists, applicant must submit an original written statement on government letter head indicates reason for the birth not registered, whether similar records for the time and place available with legible stamp, seal, signature contains words like birth or death, secretary etc.

I am so worried after so many years of wait and need help for this forum to answer this RFE:

1. can I provide SSLC (10 school ) transfer certificate as a secondary evidence? Is there any other proof can be treated as a valid proof for secondary evidence?

2. For Non- availability birth certificate - Is there a standard format available where I get the signature from local office and submit? I searched in many forum, but couldn't find a standard format for NABC.

Do I need submit original document or submit just photo copy and bring originals at the time of interview?

Did anyone had similar experience and able to clear the RFE by providing necessary documents?

EB1C India - PD June-2017 - Case transferred to Another office after interview - Initial Review
Hello Everyone

I had my AOS interview( EB1C India - PD June 2017) on 8th Jan and My case status changed to 'INITIAL REVIEW' yesterday and I got an email notification saying my case has been transferred to another office for processing and a transfer notice was sent. Strangely it did not say that the 'INTERVIEW WAS COMPLETED' as many people on this forum have experienced.

Anyone is a similar kind of a situation? Anything to be worried about? I still have time before my PD becomes current but is this expected change in the status? Appreciate your help

EB1C Interview done in Sep, still no update.
HI all,

Is there anyone else who is still waiting for i-485 approval even though the visa number is current since October?

My timeline:
EB1C-ROW
Priority Date is July 12, 2016,
Interview Date : Sep 14,2018
Case Transferred to TSC on Oct 2,2018
SR raised on December, received a respond that you will hear an update within the next 60 days. it's now 48 days and still no update yet.

I was told @ the interview that our case is approved and we will receive the cards in 4-6 weeks, I think the October Visa bulletin had come out on the day of interview, but they regressed my case based on September Visa Bulletin.

Ia anyone here with the same experience?

PD is Sep 2016 which is current from 1st Jan 2019.

EB1C-India-Interview experience - Question
Hi,

We had our i485 interview in SF field office last Tuesday 15th Jan. Everything went fine and the office up-front said the GC will be approved once the visa availability is current for my country.

Once after completion of the interview, she has asked us to sign the last page of the i-485 form to consent nothing has been changed in my case.

I am following the blog and have reached out to my attorney regarding this. Looks like no one has experienced such. Can you please share your experience and can ANYONE confirm if they have gone through such.

EB3 - Initial review email after 15 days from interview
Hi Guys,

I had interview in Houston on last week of Nov 2018. Online case status show case must be review but I got email on Dec 15th that its in initial review. Still no update after that. Anybody facing same experience or any feedback how much time or whats going on.

I also Called 800..: No red flag and its pending... etc just wait.

Question on priority date for EB-1
Hi,

I have a question on the green card priority date.

I applied for my labor of EB-2 green card with my employer in 2013 and my I-140 with EB-2 was approved in 2015. I was out of united states in 2014 and came back in 2016 in L1-A visa. In 2017, I did concurrent filing of my I-485 and I-140 in May 2017. My I-140 with EB-1 category is approved in October 2018 and when I look at the approval notice, I see my priority date as 2013 .

So, my question is does USCIS honor my old priority date when it comes to issuing green card ? Initially i thought my priority date is May 2017 (when I filed my I-140 and I-485), but was pleasantly surprised to see old priority date. Not sure if you anyone has gone through the similar situation .

I-485 Case After Interview move to Nebraska
Hi All,

Had the I-485 interview on Sept 5, 2018 at Santa Ana field office, so far no news.

As so I called USCIS today and found out that my case has moved back to Nebraska for an adjudication.

Anyone has any thoughts of the above scenario?
