H1B success in hyd consulate on 18/11/2009
Hi to all i am very happy to have sucess my H1B. Today only i have done my interview.My interview was done in 3 mins only. The questions i was asked as follows:
1)where are u going to work?
A)...................
2)how much salary u will be?
A).......................
3)what is ur degree?
A)......................
4)how much exp do u have in this present company?
A).......................
  

   Then the golden words i got from VO.
Thats it. BUt i am lucky to have only 4 questions. But i can say one thing even u have documents u should have some luck to get visa. I too have not fulfledged documents. I thought i will get query but i did not get query. Why because VO did not ask me single document.

Section 221(g)
I had my visa interview on 14th October 2009 at Chennai. The Visa Officer asked me whether I was issued a H1B earlier and I replied "Yes". The point to note here is that I have not travelled on the earlier H1. He also asked about my academic qualification, total IT experience, my previous company, my role in the U.S and the client name.
I explained my role in the U.S and gave the client name as YYYY . I also mentioned that I will be working for the client from the employer ZZ office. He then asked for the I-129 and the LCA. He said everything was fine but then he wanted some more details from my employer. He gave me a letter under Section 221(g). I was a bit taken aback as I was expecting the golden words "Visa approved" unfortunately that didn't happen.
 
I immediately sent the contents of the letter to my employer. I received the documents and submitted them on 29th October 2009 at VFS center, Hyderabad. I was in for a pleasant surprise when I received the courier on 5th November and found my H1 visa stamped on 3rd November.

I would like to take this opportunity to thank immihelp.com for their dedicated website. Also special thanks to those people who have shared their experiences. So people who have got a letter under Section 221(g), please don't lose hope.

Got h1b Stamped after getting 221(g) - Change of work location in LCA

I attended my interview in Chennai consulate on 23/10/2009:



The vo started with the question:

Vo: How are you?
Me: Good! Thanks

Vo: What you will do for YYYY ?
Me: Explained about the in house project which I’m going to work for (which was provided by employer).

Vo: What is your highest degree?
Me: Masters in CS

Vo: Where you will work in the US?
me: New Jersey (which is wrong, actually my employer is in New York, but my stay address was mentioned as New Jersey in my application form)


Vo: Verified the LCA for work location. And asked it is mentioned as New York?
Vo: Are you sure about your work location?

Me: Yes Sir.
Vo: Typed something in the system.
Vo: Gave me blue form 221(g); and asked me to get an LCA for the New Jersey site.


I was really confused about the work location; I thought I will be searching a job in New Jersey. It was my mistake.

I told about this to my employer on the same day (23/10/2009), they said it is not possible to get a new LCA for New Jersey. They said we can explain like, I will be working in my employers office in New York and staying in employers guest house in New Jersey. And submit the lease document, and in house project details as a proof with other mandatory documents including the old LCA which contains New York.


Got the explination letter from my employer on 30/10/2009.

So and so employee will be working in New York only and he will be staying in
New Jersey. The same has been clearly mentioned in the DS156 form when the
employee came for the interview.

The employee by mistake mentioned his work location as New Jersey.

Project Description:
So, Mr. Joseph will be working in our registered New York office in so and so
project.

My role in the project:

So we respectfully request you to provide him the h1b with multiple entries.

Submitted my passport with approval notice, I129 fully filled application form, LCA and the explanation letter to the VFS Chennai Office on 02/11/2009.

Go my H1B stamped with in two days i.e. on 05/11/2009.

So 221(g) guys they are there to serve you so don’t worry.

You will surly get it. Trust me.

Note: Don’t forget to keep you passport even if they don’t ask you to provide it.

H1 visa stamping and H4 Visa interview
Hi,

Can anyone help me out?My query is as mentioned below:

My fiance is working in US. He recently got his Visa transferred to a new employer; the Visa stamping for the same is still pending with him. We are supposed to get married in 16th Feb, 2010. So after that, he needs to get his H1 Visa stamped while i would need to face interview for H4 visa application. Now my questions are:

1> Will it be a good idea to take a single appointment for both his H1 visa stamping and my H4 visa interview? If YES, pls provide me some help regarding the same.
2> If NO, pls suggest me the best possible way to plan this.

Employer Change of address
Hi All,

Recently my employer has been moved a new place and there is a change in address in the website.But my LCA has old address.

In DS-156,which address do I need to mention for the Q: Where you are going to work in US.The one in LCA or the one in website.If I mention the website address do I need to get a new LCA from my consultant.

Any insights Please help me.

I got H1B a year back. And still staying in India waiting for the time to become favorable.

221g isued at chennai consulate
Hi,

I went to chennai consulate on october 30th and they issued 221g blue form and ticked every thing on it like taxreturns,wage reports,client letter,client contract agreement,...
The interview is like this
Me: HI Good Morning :)
VO : Good Morning..How r u doing
Me: I am doing very fine.How are u
VO : I am fine.IS ur present employer xxx
Me : Yes(I worked for that company on EAD and also supporting that company from India also)
VO : What will xxx do?
Me: I replied
VO : On which project you are going to work now?
Me: I am going to work as a consultant for the same YYYY company.
VO : Is YYY your employer and Is it a consulting company?
Me: I answered yes for both the questions
VO : Is YYY is sending you as consultant to YYYY company?
Me : I answered yes.
VO : Why YYYY didn't sponsored H1B for you?
Me : I answered YYYY company is not sponsoring any H1B and they asked me to come as a consultant.
VO : Asked where I did my Masters and from which unversity...which year?
Me : I answered
VO : Asked for my Master's documents?
Me : I showed to him
VO : He gave my documents back and asked me to wait for sometime as other VO has to check my documents.
Me : I waited for 30min and an India guy came and took my I-129,LCA,Petitioner tax returns,Client letter,Client work order,Consulting agreement between client and company,employer letter to consulate,employer's offer letter,employer agreement and Indian guy went inside.I waited for an hour and the consulate became empty and the VO officer called me again.
VO & Me : He is ready with 221g blue form and told that you didn't have client letter by ticking all the checkboxes in 221g.I showed him the client letter then he told that you dint have employer's tax returns I told him that I had with me and I showed to him(I dont know what he checked for an hour all though those documents are there he asked for those)...then he asked for employers wage reports.I said that I don't have them right now and VO told that anyway you are missing some documents so submit all those documents with passport and we will decide whether to issue you a visa or will send the letter to uscis to suspend the visa if we are not satisfied with the documents.
Me: I said Thankyou and I came out.

By the way my employer sumitted all those documents in response to RFE to uscis

Please share your thoughts whether the visa will be approved for the persons with 221g

H1 interview @HYD on 28th Oct
Hi All,

I attended the H1 interview at Hyd US consulate. The interview was just 2-3 minutes. Following is the conversation i had..
Me:Good Morning Sir
VO: GM
VO:What do you do in YYYY company (ZZZ is my current employer in Hyderabad)
Me: I explained hin about my role and what i do in 2-3 sentences
VO: Did you travel to US earlier (He just browsed through my passport and as i have 3-4 visas stamped he thought i went to US earlier)
ME: No Sir
VO: Not even on Study Visa?
ME: No sir
VO: Why are u going to U.S
ME: To Work Sir
VO: Are you going to work for any Client
Me: Yes sir, YYYY client (i had the client letter but he didn't ask me to show it)
VO: Your visa is approved and you would recieve it in a week days time
ME: Thank you Sir..

The VO was very cool. Be confident while answering. All the best.
