Harassing by employer
I got visa through some of the consultancy in Mumbai. My employer is postponing my travel date from last six months due to his problems .He doesn’t want to give me the port of entry letter. Tell me the importance of port of entry letter while you are going first time to USA.my plan is to change my employer in USA.

Please tell me how to sue an employer from India. I want to complain about my employer to consulate people in India.Tellme how to approach. Please advice me.

Fathers Tourist visa : 221g yellow form
My parents applied for a tourist visa in OCT 2006 DELHI. My mother was given a visa however my father(a retired businessman, 65yrs of age) was given a yellow 221(g) form with a tick mark on " Your application requires additional administrative processing before a final decision can be made. This office will contact you once the administrative processing has been completed".

It is over 6 months , i wrote an email to them , they said they will reply once the process is complete. What should i do next? Should He re- apply

Also, can anyone tell me what Batch ID is and how can i know what is Batch Id for my fathers application.

Any help on this will be much appreciated.

Better wait till it is transferred since his case is already filed, dont go on old employers name its not good. Wait till his H1 is transferred to New one and then u go to consulate for H4. I think this is better. If its getting too late for u, left for u to decide

Hi,

My husband was working in a
company in US till april 2007 on H1 visa. He is now
working for some other company and in currently
undergoing a H1 visa transfer. Can i apply H4 with his
old H1 or new H1 documents. It may take some time to
get a new H1.

I am planning to come as a dependent in the month of
july. With what documents should i file for a H4.

I got my h1 approval last month(2007 quota)...How early i can go for stamping???????i mean if go for stamping in june will there be any risk

H4 to H1
My spouse is in India and has H4 visa stamped. Now we also filed H1 this year. H1 is picked up and its waiting for approval. Does H4 status expires on approval of H1 ? To utilize H4 to H1 conversion once he comes here, does he need to come here before H1 approval? Do we have problem in Port of entry if he comes on H4 visa after H1 approval?
Please some one provide me answer.

221g yellow form
Hi Guys,

On 25th april i've attended the visa interview at delhi consulate and the officer had given me yellow form as 221g additional administrative processing required. she took all the documents that received from US except I797 and said once the processing is done she will let me know. so my question is how to check the status of case, how much time it will take to complete the processing, whether i need to go consulate or mail them?? kindly reply to my queries if anyone had gone through the 221g-yellow form situation

Here is my question. I currently have a B1 visa and i am planning to apply for H1 visa . My brother is also working in US on H1, will i be facing any issues due to this reason.

Refused under 221 (G)
I attended interview on 21st December 200 and was given 221 (G) asking for some more documents.and after long time my employer sent the documents and i posted the same on 11th April 2007.

toady i received a letter from my consulate

Dear ZZZ

Based on the documents submitted to us and the information elicited in your interview with the Officer we are unable to issue you an H-1B visa coz,

Your petitioner does not appear to be either willing to able to provide qualifying employment in the US in accordance with appropriate laws and regulations .

In accordance with the US las and department of state guidelines action on your case has been suspended and the I -129 petition filed on your behalf wil be returned to US citizenship and Immigration service (USICS)with a memorandum explaining the facts of your case as presented to us at the time of interview. The US consulate in chennai no longer is handling the case ad will be unable to give you any information on the status of application.

For your Information our VISA was refused today under 221 (g) of the immigration and Nationality act ( INA). essentially this section states that a visa cannot b issued to anyone whose application does not appear to consular Officer to meet the requirements of the INA or the regulations thereunder.


What does this mean.
