H1B, H4 Visa

First of all i would like to thank everybody who shared ur experience with us.This is the best website to get information regarding stamping.I would like to share my experience to all.

My interview is on 21st March 1:45PM and i was there around 12:45 and they allowed me inside the consulate around 1:30 and i went for security checking.After the checking i went inside a room where there are lot counters for checking the documents. I have been asked to sit and i was having one big file containing all the documents and a carry bag which contain my purse and marriage album.Apart from this i was having my interview letter, HDFC challan and Passport in my hand.I was waiting for my turn but at that time they asked me to go to another building.I went there and i saw the same counters there again.They asked me to sit in the chair but at that time i noticed that my passport was missing which made me too much tensed.I dony know what to do.I asked the guards and they asked me to check in the previous counter.I went there but it was not there.Whole crowd was watching me as everybody came to know that i lost my passport.I was embarrased but my full concentration was in searchng my passport.again i went to the another biulding and searched there.But the guards asked me to search outside the consulate.Thus was the biggest mistake i did.As i went outside i was not able to go inside again without my passport.I know very well it was inside.I requested the security to search my passport in those 2 places.I was standing in sun for nearly 30 min but they told finally it was not there.I was praying continuously.One guard came from inside and asked me what happened i told everything and he went inside to search again.Finally after 1 hour i got my passport which was there in 2nd building in the same chair where i sat.Again i went inside and finished all the formalities like doc checking and finger prints after that i was waiting for interview.The ladies who came along with me finished the interview and left the consulate .i was very much tensed and there were heavy rush on that day. took nearly 2 hours for me to get my chance.The girl who went before me has applied for f2 and she was also newly married and the asked her abt w2 as she told she dont have.They asked her pay stubs in which they have 600$ per week.Finally she got rejected which made me more tensed.I went for my interview.

VO: Good after noon mam.How are u(with smile)
Me: hello sir, good afternoon .Iam fine(with smile)
VO: Can i have that blue folder(Which contain my passport,Husbands I797,his passport copy)
Me: Of course
VO: He saw the date when he entered USA and he asked me whether i have W2 form
Me: I told yes and i gave that
VO: He saw that and he checked something in system and he said the magic word that my visa was apporoved
Me: Thank you sir

HUhhhhhhhhhhhhh.......

It was jus 2 minutes....for which i prepared a lot.But i would like to say everybody that please bring all the necessary documents.We dont have to worry and get tensed.Please please please keep your passport very safe.It was really a lucky day otherwise i would have left the consulate without my passport.

This year i am applying for H1-B.

My Case is:
1)-I have completed my B.Tech. in I.T. (Distance Education along with my job, completed in june-2006).
2)-I have completed my Polytechnique Diploma in Computer Science and Engineering(Completed December-2002).
3)- I am in job from July-2002 to till date.(Around 4.4 years of I.T. experiance).
4)- I am MCAD certified. (Microsoft Certification).

Now I have worked out in four I.T. companies including current company in which i am working.

The first Company in which i have worked was very small group of persons (Around 8-10) and also was not an MNC deails in local Market only.Currently it is not existing more.
But i have work experince certificate of the company.I worked with this around 1.3 years.

The Second Company in which i have worked is not either an MNC or not very big, but well known in local market.Same i have work experince certificate of this company.i worked with this around 1.1 years.

The Third Company in which i have worked is an MNC (Australia based), but not a big company.
I have work experince certificate.I worked with this for 1 year.

The Fourth and currently working in company is Middle level company(Around 60 persons) as well as an US based MNC. I am working with this company for last 1 year.

Now what does it seem here ? Could i will be able to get H1-B ?.

If not then what condition is not fullfill the criteria.

Please let me know.

Afroz u mentioned that u have mechanical engg degree. and if u have only 8 to 10 months of exp. u probably dont stand a gud chance of getting the visa. u shuld have atleast had 2 to 3 years of solid IT experience in a very big MNC here. computer science graduates like B techs or MCA's stand a gud chance even if they have 1 year of experience. if chennai consulate is no longer handling ur visa then there are 2 scenarios:

1. the best one is u might get a visa after a long long wait time or

2. the worst case is that ur petition might get null and void altogether. i am not discouraging u but i am letting u know what exactlt happens.

be positive although its hard on u but there is life beyond US visa also. so pray to Allah.

Its good to hear that u havent submitted any fake docs. U mentioned in forum that u have exp in mechanical background and u are working for IT from last july.
afroz just note that the basic qualification for H1 visa is
either you should be graduate in computer science degree (or) non comp science graduates are expected to
have 3 years of work exp in IT industry.
This is were VO got a chance in ur case.bcoz u have only 10 months of work exp.
Even though USCIS is approved petition in ur case,some times they will forgo the criteria.but consulate catches us.thats why they have send ur petition details to USCIS FOR further review.
its good sign they have given back ur original I797,I129 but i dont think u have chance for delhi ,bcoz to apply for other consulate u should not have previous rejections.
Practically possible solution i suggest is request your petitioner to file a case for u at local labour court in US,and tell the court the company requires u very much,if really intrested this process can be completed at maximum of 1 month,if court approves ur case no body can stop u issuing visa.

I would be thankful if anyone clear me regarding this.I've attended the interview in sept 2006 and i was given 221g in the interview. As per my consultant i've withdrawn my case from Melbourne Office and they have sent the documents back to me. Can I attend the Interview in India with these papers???

Please help me regarding this as early as possible.

Hi folks,
           I was issued 221g and Visa offier asked me to submit additional documents without passport. I have done the same on Feb 12th at VFS office. I got mail from consulate as follows

"In accordance with United States law and Department of State guidelines, action on your case has been suspended, and your petition for a Non-immigrant Worker filed on your behalf was returned to the United States Citizenship and Immigration Services (USCIS) on March 15, 2007 with a memorandum explaining the facts of your case as presented to us at the time of interview. The U.S. Consulate in Chennai is no longer handling your case, and will be unable to give you any information on the status of your petition".
 
    What does this mean? Please share if anyone have experienced the same.

although i have posted but this one i make it more clear.
i had attended H1B interview on 21st dec'06in chennai consulate.The VO on having a look at my experiance letters from mechanical said my case will require processing.then after 8 days i receive a letter saying my case has been referred to uscis & chennai consulate is no longer handling ur case.
now am in a fix.what to do?my HDFC is used-up & i have to fill fresh HDFC fee again & take appointment again.But my employer wants me take interview in delhi or other consulate.
i have all the original doc's with me.
can i do that?

please i have not submitted any fake doc's,only my background is mechanical graduation & experience in mechanical industry.
i have completed my SAP Certification in july last year & working presently in IT industry.
please advice as am going to fill my fees & take appointment.where can take & what are the chances of success.

i repeat again no fake doc's.
b'coz there is life beond US.
i just want to know the procedure.

i had attended H1B interview in chennai recently,but they rejected my case saying the chennai cobsulate is no longer handling ur case & ur petition has been returned to uscis. may he got reservation about my mechanical background & experiance.i am into sap field.now my employer wants me take the interview in delhi.can i do that?or i have to go back chennai again.

I have applied and attended for H1B Visa on 24th of December 2005 at Chennai consulate - I was given a 221 G and I was asked to submit additional documents. Having arranged all the additional documents I attend for my visa interview on 25th of Jan 2006. I was again given 221G asking for a specific document called “Marketing analysis of the final product”. Having arranged the same on 24th of Feb 2006 (Marketing analysis of the final product) I handed over all my documents such as I 797-LCA-DS 156 & DS 157-PASSPORT IN ORIGINAL – DD OF 2300/- etc. at VFS office at Hyderabad as said by the counselor officer.
 
To my surprise after two months that is on 25th of April 2006 I got a courier from VFS office, on opening the courier I found My Passport in original and DD of 2300/ - without any letter from the consulate or any Visa stamping.
 
I called up Chennai consulate on the same day that is on 25th of April 2006 and intimated the officer about my case, the officer said that in her records it shows that additional documents sent by me on 24th of Feb 2006 were not received by the consulate and the visa officer added saying that, I should send an email to consulate explaining the case in detail.
 
 I have explained my case in detail to my best knowledge,and finally they got my all documents.

My application was put to Additional Admin Process, almost 15 months ago. I would like to know how long it would take for the completion of AAP, I am in a condition where in I am not able to understand the position of my visa status.

So any one can help me and throw some light on the way to further proceed in this aspect

The admin process is not yet completed.

1)The Consulate is verifying information presented during your interview. This can be a lengthy process. While we recognize your desire to bring the case to conclusion, we cannot process your case until after the investigation is complete. We will contact you with more information as soon as it is available.

2)We regret we are unable to provide specific time frame for your case. If you wish to withdraw your application, please let us know.

 so tell me..what should i do shall i wait?Its almost 15-16months completed...

Hello Friends ,
I need your help with my case urgently . I had applied for H4 and I have received the blue slip 221g . Please help to find out what steps need to be taken next.

Following is what happened at the consulate.

The lady at the consulate has issued a 221g asking for the following details
Category is

Your application requires additional information as indicated below .

1. Explanation for low earnings from 2003 till present -
has anybody else got a similar query for additional information ? Could you please tell me who should provide the explanation my hubby's company or my hubby ?

2. There are 2 options to submit
a . attend an interview personally on any tuesdays, wednesday and thursdays
b. use the drop box facility

Can I go for any of the 2 options ? Which option would you people suggest ?

Please help me with my dilemna.
