Aug /16/ 2017 Nebraska center asked for ( Additional Evidence)

Aug /25/2017 the evidenced was received and the clock resume.

Sep/ 01/ 2017 still waiting

have no money , lost a job offer and my back account is (- 1126).. and can't get anymore money from the bank.
NOTE: this is based on pending asylum which I have to wait 150 days without work to be eligible to apply for EAD.

Guys, I wanna share my struggle with Nebraska Immigration Center. My case was filed on May 10 and still under review. They asked for additional evidence which my lawyer says that was just like " digging for an excuse"....I had to wait 150 days before I filed and after I filed it has been 111 days......COME On Nebraska...the funny thing is that there website says they are working on June 8 cases....

and when you call and speak to 2nd level officers - they give you different info ...I truly regret coming to this county. The immigration law is not clear and I think it's based on nationality. If this is a country of rules, they shouldn't mislead immigrant by stating that ( EAD processing time doesn't exceeded 90 days, And for Pending asylum doesn't exceed 30 days ) , I spoked to some people who have their Ead application on the same Nebraska center and got approved within 80s days and filed few days before me.

EAD Delayed
Hi,

I just learned today, 75th day from the first receipt I got for my I-765, that my EAD is still on its 37th day. The reason behind it is that there was a Request for Initial Evidence dated July 7, 2017. Receipt date for our compliance to said request was July 25, 2017.

My dilemma is this: my US Citizen husband is becoming overwhelmed with the financial responsibilities for my 5 kids still in my home country. I need to work as this is putting some strains on our marriage. He is just my second husband. My first husband passed away and I am the kid of person who keeps the commitment so I am praying that this marriage will last until our old age.

Is there anything I can do to shorten the 38 remaining days?

Would appreciate your advice guys!

Hi All,

My EAD was finally approved after 116 days

First of all, I wanted to thank everyone who share their experience with us. it definetely help me a lot with this process

I want to do my part and share my experience

A little background: I had an EAD based on OPT and I have job. My company was kind enough to let me take a leave of absence after my EAD expired, while I waited for my new EAD. I also got married (same sex if that helps) earlier in the year and I started my green card process in May.

Here’s my timeline:

May 4th_ USCIS received I485, I765 and I130

May 12th _ received all the receipts for my application.

May 15th_ received a letter with my biometric appointment

May 31st_ biometric appointment for I485 and I765

July 20th_ raised my first SR at 77 days through the phone

July 21st_ USCIS requested for RFIE for my I485 & I130 (RFIE resets your I765 processing time back to zero. I didn’t know this until recently. Also, the website at time said it was a RFE and not a RFEI as the letter stated, so watch out for that)

Aug 4th _ raised my second SR at 90 days and requested for my case to be expedited base on financial loss (possibly losing my job if I didn’t have my EAD card soon)

Aug 7th _ My 90 days SR was assigned to an officer and got response saying the following:

“Recently, you contacted us regarding your Form I-765, Application for Employment Authorization. Your case is within our current processing time. Our systems show that we received your response to our Request For Evidence (RFE) on your Form I-485, Application to Register Permanent Residence or Adjust Status, on July 24, 2017. Your Form I-765 will be processed within 90 days of the receipt of the requested evidence.”

(Here’s when I realized my case was reset back to zero and when I started to freak out)

Aug 7th _ on the same day I got a response for my expedited request saying the following:

“Your case in currently under review. You should receive a decision or notice of other action shortly”

Aug 11th_ received a response for first SR with the same response as above

Aug 12th_ contacted my local congresswomen for help, just in case

Aug 17th _ the office of the congresswomen informed me that my case was being expedited and under review by an officer.

August 22nd_ got scheduled for an interview for my I485. (I don’t know if this affected my i765)

Aug 30th_ card in production

This was definitely an ordeal. Never been so stressed and depressed and whatever other feelings you can think of.

* Expedited replacement of lost or damaged immigration or travel documents issued by USCIS, such as a Permanent Resident Card (Green Card); and

* Rescheduling a biometrics appointment.

EAD filing in early June, and still pending, and will lose the job offer
I have been waiting for my EAD card for 85 days, and my case is still pending. I feel very hopeless and strengthless, as I run the risk of losing my job. The Employer might cancel my contract, if I couldn't provide my EAD after the Labor Day. I try every means to keep positive, but it is a very hard situation for me now. Here is my case:

Case Received by USCIS Phoenix: June 6th
Raise e-request: August 25th (pending 80 days)
Received e-request email response from USCIS: August 26th (pending 81 days)

Here is the response by USCIS: Recently, you or your representative contacted USCIS concerning your Form I-765, Application for Employment Authorization, to request expedited processing of your case. Below is a summary of what we found and how the issue has been or may be resolved.

The primary goal of Curricular Practical Training (CPT), pre-completion Optional Practical Training (pre-OPT), and post-completion Optional Practical Training (post-OPT) is for the students to gain practical experience in their field of study, not to earn money for living expenses or to fund their studies.

It must be noted that F-1 students are required to establish that they have the financial ability to pay for their course of study and living expenses for the entire period of study as indicated on their I-20, thus they cannot claim financial hardship due to the very nature of their nonimmigrant status and maintenance thereof. In addition, an employment offer or start date does not qualify under USCIS's severe financial loss expedite criteria.

Therefore, your request for expedited processing of your application is denied.

Your application will be processed within the normal USCIS processing times, which can be located on the USCIS website at www.uscis.gov or by calling the National Customer Service Center at 1-800-375-5283.

Response from USCIS: USCIS will review and process the request; Expect a reply by September 19, 2017; However, it shows your SR YYYY YYYY YSC is currently not assigned for processing.

I send email requesting assistance to senator on Aug. 28, no any response yet.
I even asked the international office at my university, and he told me "There is no speedy process with USCIS for OPT. But you can call them exactly after 90 days of the receipt of your application. And speak with one of the USCIS officers to expedite the application. Normally they do help with that."

I am freaking out, and I am thinking go to congressman to ask for help, and contact Ombudsman for help. I cannot just be passive waiting, and I am going to lose my job, due to my pending I-765. That sucks!

Hi guys,

I am a quiet follower for this forum for couple of weeks. I appreciate all you guys here, your experience is valuable. Without this forum, I will not get my EAD approved as quick as I want.

I know it is terrible torture to wait for paper to go through, please be patient and do have hope. I am lucky enough to get response for my SR and got my EAD card expedite.

Here is my timeline:
- July 12, 2017: send out the whole package to Chicago office.
- July 13, 2017: receipt I-765 received
- July 13,2017: receipt I-130 received
- JuIy 18, 2017: receipt I-485 (FP fee) received
- August 3rd, 2017: did walk-in for Biometric Appointment for I-485 (official schedule is August 10th)
- August 4th , 2017: received notice for biometric appointment for I-765
- August 7th, 2017: did a walk-in for biometric appointment for I-765 (official schedule is August 15th)
- August 16th, 2017: raised first service request (SR) to expedite I-765 due to financial loss (pending job offer) by calling USCIS customer service
- August 17th, 2017: got email from USCIS asking for proof of pending job offer. I faxed my job offer letter.
- August 25th, 2017: status online changes to "Card is being produced"
-August 29th, 2017: status online changes to "Card was mailed to me"

I will sleep in the doorstep to welcome any postman delivering to my apt :))

EAD after biometrics
PD is 7/10/17. Doing my biometrics (filed I-485 with I-765) tomorrow (8/31). Does it mean that there is a higher chance that I will get my EAD card in a couple of weeks? It is processed at the Nebraska office

Also, submitted an expedite request. How long after did you hear about the decision? They said 5 days. Did you hear from them by email or mail? My reason for the request was financial hardship since my current visa expires tomorrow. Was wondering whether it can be denied because the reason is too weak and common. I am sure there are tons of people requesting it for that reason.

Sorry for the multiple questions. Appreciate your advice.
