Tiempo estimado para obtener Green Card por trabajo
Este aporte lo hago con base en mi experiencia para obtener la residencia permanente o green card a través de un trabajo.

Este proceso consta de 5 pasos los cuales se deben cumplir
1. Evaluación inicial y preparación
2. Publicación de la posición
3. Reclutamiento y evaluación de los aplicantes. Diligenciamiento electrónico de PERM
4. Visa de petición de inmigrante USCIS
5. Ajuste de Status

Este proceso debe iniciar con la voluntad por parte del empleador de otorgar el patrocinio al empleado para cambiar de un estado de visa H1 a Residente Permanente de los Estados Unidos. Recuerde que este patrocinio o sponsor se otorga unilateralmente y de manera discrecional por parte del empleador. No hay normas o leyes que indiquen que usted tiene ese derecho después de haber trabajo cierta cantidad de tiempo.

1 Evaluación y preparación
Tiempo estimado 4-5 meses
El abogado de inmigración contratado para llevar a cabo todo el proceso, envia al Dept of Labor la información del puesto de trabajo que le están ofreciendo. El DOL envia un approval de este paso.

2. Publicación de la posición
Tiempo estimado 4 meses
Como parte del proceso, la compañía que le ofrece a ud este trabajo, está en la obligación de publicar en un medio de comunicación la info de la posición con el propósito que se presenten los ciudadanos americanos que consideren que cumplan con el perfil para esta posición. Si nadie cumple con el perfil, se puede continuar con el proceso.

3. Reclutamiento y evaluación de los aplicantes. Diligenciamiento electrónico de PERM
Tiempo estimado 5 meses + (auditoria 3meses)
En este paso se hace el diligenciamiento electrónico de las formas necesarias. El abogado de inmigración contratado hace esto. Este paso es prácticamente el mas importante y en el cual su caso puede ser sujeto de auditoria. Se Der así, el proceso de auditoria toma 3meses mas.

4. Visa de petición de inmigrante USCIS
Pagando premium processing el tiempo estimado son 3semanas
Si no paga el premium processing puede tomar hasta 4meses
En este paso, ud debe pagar al abogado todo lo concerniente al proceso mas los costos que el abogado considere por sus servicios. En nuestra experiencia son aproximadamente $12.000 dólares para una familia pequeña (3 personas, padre, madre e hijo(a)). Adicionalmente ud también puede decidir si paga el premium processing.

5. Ajuste de Status
Tiempo estimado 6-12meses
El abogado envia la documentación necesaria a USCIS.
Antes que ud y su familia reciban la Green Card, uds recibirán dos documentos. Permiso de trabajo y permiso de viaje. Una vez presentado el ajuste de status, ud puede recibir los permisos de trabajo y de viaje dentro de los siguientes 6meses.
De igual form una vez presentado el ajuste de status ante USCIS, ud y su familia recibirá la cita par tomar los biometrics. Después de los biometrics ud y su familia recibirá la cita para la entrevista.
Para la entrevista, ud debera tener listos los exámenes medicos, los cuales ud y su familia debieron haber tomado ante un medico APROBADO por USCIS. Consulte el listado de instituciones y medicos aprobados.

485 Interview at SFO

Interview at SFO at 7:45 AM 3/29/19

Overall process took 30 minutes. Officer was very friendly. Officer first started asking questions for daughter, son and wife and me jointly.

In the middle of interview she said, I will put together all and send this case back to office and once VISA available they will take the final decision. Please follow instructions to change address if any and donot forget otherwise it will be hard to track. At the end donot panic if your case is not approved when date is current, officer will process in order. Lastly she gave interview completion letter.

I-485 RFE Respond
Hi

I have responded RFE on I-485 on Jan 08, 2019. i have not heard anything back from USCIS. Does anyone has similar experience? what is the usual wait time for RFE Response?

I-485 pending. Atlanta filler
It has been 120 days since I had my interview and still has no idea what is going on. I received a RFE 1 week after interview asking for I485J, even though I submitted I-140 and I-485 together and have not change employer.I responded the RFE within 1 week and since then nothing. Not even a mail saying they are reviewing my case. Called Uscis 3 times since then, only able to submit a SR once and again nothing. Just a email saying they don’t need anything else. Is so frustrating. Today a email my congressman asking for help. Anything else that I can do? Anybody else inthe same situation or if you were what did you do for USCIS to work in your case?

Anyone can please share their interview experience esp. from Houston office.
Do we need to take anther medical if ours still valid till 2 years completion in Oct 19.
Also, do we need 485J if 140/485 is filed concurrently.

Adjustment of Status Interview
I would like to share my experience and also have a question for others who may have faced a similar situation.

My PD is 12/29/2016
i140 approved - 11/13/2018
Case transferred to local office - 12/04/2018
Ready to schedule interview - 02/08/2019
Interview scheduled - 03/25/2019

The IO was very friendly and we chatted about a lot of different things. He asked the basic questions around if we were arrested and so on. asked for additional documents to prove me and my wife are still married.

He then said everything looks great and he will review the i693 and then approve the case by afternoon. He also said if we do not hear back from USCIS asking for additional details then consider the case approved and we should received the GC in 30 days.

After a few hours of the interview our i485 case was updated with status as interview completed and the case needs to be reviewed.

Not sure what this means, has anyone had similar experience??

NYC EB-2 NIW waiting after interview
I filed my I-485 concurrently in October 2017. After waiting in agony for a year, my I-140 NIW was approved in October 2018. Everything seemed to be moving at a good speed after that. Transfer to NBC in November 2018, "ready to schedule" then "interview scheduled" both in January 2019.

I went for my interview in early March 2019. The interview went generally fine. The IO was very friendly, perhaps just a little new to the process. He said everything looked good and his supervisor would just need to review it before approving it. He said in theory they have 120 days to respond, but that I should receive a decision in a week or two. I have now been waiting for 3 weeks and my status still says "Interview has been scheduled".

The only "issue" with my application was answering "Yes" on question 25. I explained that I answered "yes" only because I had a couple of speeding tickets in the past, nothing else. He asked if I had any documentation about those traffic violations, which I did, and I gave the copies of the tickets to him (even though the I-485 instructions say we don't need additional evidence if the violations only resulted in fines under $500, which was my case!). The IO himself said that speeding tickets are not a problem, but that now USCIS just wants to know everything, so he attached the tickets to my application and put a note on Q.25 indicating that evidence was attached pertaining to that question.

The frustrating thing is that I read on **** * that someone who went for an interview on the same day, same field office, same category (EB-2 NIW) and who also had speeding tickets but still got approved on the spot!! And the officer told that applicant that speeding tickets don't count and changed the answer on the form to "No"!! In other words, if I had got the same officer, I could've been approved on the spot as well.

The inconsistency in the adjudication process from officer to officer is so frustrating and unfair. It's a lottery. And now my application is probably sitting forgotten on a shelf somewhere in their office, and I'm stuck in limbo again until I reach the date where I can raise an SR or make an infopass.

18 months in this process, and over 13 years living legally in this country. I can't wait for the day when I don't have to think of the word USCIS ever again.

Asylum based I-485 transferred to an asylum office
Hi, guys. I just checked case status and found update: Case Was Transferred To An Asylum Office

On February 21, 2019, we transferred your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number LIN....., to an asylum office for processing. That office will mail you a decision or send you a request if it needs something from you.

Is anybody got same status? What does it mean? Why NSC transferred my case to an asylum office? Should I worry about that?
