OFC Query
Hi Everyone -

I had an L1B rejection in 2014. As part of that process, I gave OFC at chennai. Now, I am planning to book a slot for H1B stamping.

Do I need to give bio-metrics again for H1B? As I had completed Bio metrics for L1B, I just wanted to confirm

Could someone please let me know?

question regarding name change
i have changed my name while studying engineering. so i have mentioned my old name in the question of 'Have you ever used any other names?'. in ds160. Will there any chance of counselor asking about this during H1B interview?

my degree, passport,H1B petition having new name only. Please help me.

I applied for Visa interview in Delhi

OFC appointment experience
Took Metro to reach American plaza, it's right next to Metro station.
Mobile phone is allowed, you just have to switch it off. Better to carry all papers in a folder. Don't carry any pen drive or any other electronic item.

I was just asked for my passport, DS160 and appointment confirmation (nothing else). He took my finger prints of both hands, thumbs and clicked my photo and told me not to reach venue too early. Reach only 15 minutes before scheduled time.
Queue In -> Out time was not more than 15 mins.

Consular appointment experience:
Took metro to Race course station, enjoyed morning walk to Embassy. Mobiles or any other electronic items are not allowed, bags are not allowed but they setup a counter across road to collect phones/bags (Rs 50 per phone). I was interviewed by young guy

Me : Good morning officer
VO : Good morning Sir.
VO : You going on H1B
Me : Yes
VO : Are you going for first time ?
Me : replied appropriately
VO : What does your company do ? Clients ?
Me : Explained it's a product company and blah blah
VO : What do you do ?
Me : replied appropriately
VO : What is your role ?
Me : replied appropriately
VO : How much is your salary there ?
Me : replied appropriately
VO : I don't see any issues, I'm approving your Visa.
Me : Thanks a lot.

People outside asked for I797 and stapled it to passport. But VO didn't ask for any other document.

Now, here is my turn!

September 2: Attended in person in OFC and gave finger prints, Photo. They have asked why you are going to US? Answer: To Work
September 3: There is a big line. Appointment time (10:30AM)

Slowly the line moves.. by 11:30 i reached a counter where they verified the finger prints. (First look i thought that is the actual interview location but it is not)

Then i was moved to actual interview location. I was given with a token for interview counter.

There are 5 members are there before me. Majority are B1 Visa.
The guy before me, seems unprepared for the interview. He has given extra information than actually needed (So that questions were more.. naturally!)
Before coming my turn, a helper has taken my passport and given to Visa Officer (VO)

Finally my turn came.
Me: Good morning Officer, How are you doing today?
VO: Hey, Have you been in US earlier?
(I have a B1 Rejection in 2013)
Me: No, Not yet
VO: Oh! this is... Okay.. Two years back (By seeing monitor).
Me: I just smiled.
VO: How do you know your employer
Me: Well! For global exposure i just posted my resume in DICE.com; They interviewed me technically; I got selected
VO: That Make sense
VO: Where are you going in US?
Me: YYYY city
VO: ZZZ? which state?
Me: YYY
VO: Oh! Yes! I am approving your VISA
Me: Thank you! Thank you so much!

Regarding Consular Interview
Hi Everyone,

Please let me know if there is any belief that if we attend the consular Interview in Chennai we will get it otherwise we won't. Do we need to follow these myths.Please advice.

By the way my H1 B got approved in July and I am planning to attend the Visa interview in October.

Visa refusal section in DS 160
Dear All.

I had H1 selected in lottery and approved last year. I did went for stamping interview in Sept. 2014.
Got 221g white slip asking fro detail documents from employer.
Due to some reason, attorney submitted those documents on January 2015.
In April, I received letter from consulate stating "your application is sent back to Visa application center Vermont" for further review.
Mean while my current company used my same approved case and filed new H1 and it is approved now.
I will be going for stamping in next couple of weeks.
So my earlier case will fall under Visa refusal? Do i need mention it in DS 160 when there is question about "Have you ever been refused a U.S. Visa, or been refused admission to the United States, or withdrawn your application for admission at the port of entry? "

Can i do a H1B transfer to new employer with receipt number while petition is pending
Dear all,

I came to US in H1B visa with Emp A validity till Sep'15. On Dec'14 I got a new job and I moved from Emp A to B.Then Emp B transferred my H1B petition on Dec'30 2014 in normal processing. On Jan'26 2015,my Emp A has revoked my H1B petition.On March'15, the H1B filed by Emp B went to RFE and we responded with required docs. USCIS updated my case status saying that they will respond the RFE on June' 09 15. Since there is no reply from USCIS, my Emp B raised a SR and the case history was updated saying they will reply on July' 19 15.On Aug'20 15 USCIS updated they are reviewing & mail my notice.Now my Emp B asking me leave the country due to the project end and going to terminate me.Can i do a transfer now to new employer with receipt number alone and how many days can i stay without status?

H4 ead
My husband's green card application has been initiated by his current employer and his PERM is under processing. I have two questions on the H4 ead that will be granted after his I140 is approved.

  1. If I obtain my H4 ead after his I140 is approved and my husband then changes his job, will the H4 ead be still valid?

  2. Supposedly he changes his job after the I140 approval but before I apply for H4 ead, will I be able to apply for a H4 ead after he is under the new employer.

  3.Will the employer be able to revoke an approved i140 when he changes jobs.

Still my h1b status is in RFE status
I have applied for h1b visa from consultancy and Its been 2 months that my my h1b status is in RFE status and my employer keep on delaying saying that RFE documents have been already prepared and sent to Attorney for review as they had said this one month back and also said that they will usually send the docs to US consulate 1 week before the last date so that chances of getting approval is high with out getting any RFE again .could any one having same as my situation ?please help
