Hey guys, I hope you can help. I have been racking my brain for weeks regarding my brother's N648. The main thing was question 11:
In your professional medical opinion, does the applicant's disability or impairments prevent him or her from demonstrating the following requirements? (Check all that apply. If none applies, the applicant is not eligible for this exception.)
The ability to:
_ Read English
_ Write English
_ Speak English
_ Answer questions regarding United States history and civics, even in a language the applicant understands
Initially, the Psychiatrist did not check "speak English" as he can speak basic English. Technically he can read it too, he has a mental disability (only finished 2nd Grade overseas) and an IQ of 76. I mean anybody can speak english ("I" "No", etc.). The question is too vague and offers no other explanation/description. When I looked at samples of completed N648 forms, somebody with Alzheimer's and has tried taking citizenship classes (in a native language and English) for over 2 years had it all checked off by the Doctor. Surely that person can at least speak a few English words, right? Also the Psychiatrist's handwriting is hard to understand. I will show the doctor samples of filled forms that show insufficient and sufficient answers to some questions, and ask him to write legibly.
So the initial interview result was denied, one reason was that in Q11, the medical professional indicates you can answer questions in English; however, your mother testified that must have been a mistake by the medical professional.
second reason was on Q12, indicates an interpreter was not used, however, your mother testified she acted as the interpreter during the medical exam. Additionally, the Interpreter's Certificate was not submitted.
One of the question was if the president were to die, who would take over. Upon hearing the word president, my brother answered "Biden", the rest of the questions, he answered "I don't know" "I don't know either" My heart sank. Why is not the "Answer questions regarding United States history and civics, even in a language the applicant understands" not taken into consideration? Did the interviewer proceeded, since he or she will not be able to use N648 form? My mom interpreted out of habit, but we didn't think she needed to do the certification (we thought it meant a true interpreter).
Luckily, we have a regular family practice doctor that has seen my brother once before (they just moved back to the state). He can speak the same language so he can just check off that Medical certification part. How should I hint to the doctor to check off everything (we would likely show the N648 form that the Psychiatrist filled.
