AP application process and time line so far.
Hello everyone I just wanted to share my process for the AP application as if now. So I began the journey of this AP application since may 2016. My lawyer told me about this when I informed her that I was going to get married and would like the application for permanent resident to start right after that. She told me my options and w decided that this trip would be to visit my grandmother who is elderly and obviously with age in poor health. Also to cost my great grandmother who is the only person from my oldest living generation from my family she is 94 years old and also in very bad shape at this point they both helped raise me as a child. I am a DACA recipient for almost 4 years now. Anyway I initially applied for the AP in may signed papers and paid everything to leave in July well that didn't happen I waited and waited and never even received a reciept number I contacted my lawyer eventually and asked so she said not sure what's going on but let's submit it again well that was in late July second attempt to travel in September for humanitarian reasons and again I waited and waited and no receipt number or notice of action again I finally got in touch with my later again and asked wth wa showing on so she had me com in her office again third time and said to sign AP papers again and update the dates of travel and submit it and request expedite shopping. ( I wasn't sure what that meant either at the time) so this time I went in on November 11rg and finally submitted my application uscis received it on December 7th and sent me a receipt number now I know it takes up to 30-90 days or so to be processed but I was really in no rush to travel to Mexico my home country which I have not been to since 14 years ago. Well last week we got a call that my great grandmother isn't doing to good at all so I called uscis last Thursday the 5th and told them if I could expedite my case they asked me why and gave me different categories to chose from like emergency/urgent loss for a business, humanitarian etc. Mine kind of fell under urgent and/or humanitarian reasons so that's what I chose humanitarian. She said wait like 5 days and they will get back to me, so I am now waiting for a response on that. I hope to hear from them soon I would like to really go see my great grandmother and hope that my kids who are the youngest generation can meet her being the oldest person alive from all our family! In my application I did submit letters from their doctors and in it it said that I needed to go see her with out farther ado. I am praying that they let me go soon. TBH I will still travel even after January 20th. I believe that it will be worth it going even with trump coming into office that day. Some people are saying what if we are not allowed back ! But you will not know unless you do it. And let's say you don't go and others do and have no problem then you'll say why didn't I just go. Plus he can not do something like remove DACA immediately. It has to go through a process just like it took a while for Obama to get it passed and approved. Anyway yes sorry i know is long but hope to hear of people who have similar stories or dates and kind of share our hope and nervousness together. Good luck everyone. ??

AP experience
I'm here to share my experience. I'm daca and went to Mexico with AP, i traveled with my wife and daughter both USC.

my immigration history:
i have no criminal history or deportation, i came to the US when i was 6 months old undocumented back in 1991. in the year 2000(9 years old) i left to mexico and came back in 2004(13 years old) via car with my little brother who is USC and another family who my dad knew at the time, i was in the back seat of an suv CBP didn't asked me questions but i didn't have papers either i guess i was really lucky.

AP Travel:
so i applied for AP back in may 2016 and got approved in November 2016 i applied humanitarian reason and it was because my grandma(79 years old) was sick and haven't seen her for 16 years. so i left to mexico on 01/03/2017 and came back 01/09/2017. all i could think in mexico was are they gonna let me back in? it was really scary and overwhelming. so the day came and i boarded the plane from oaxaca to Houston Texas aiport, when we got to the customs line there 3 lines citizen, citizen and resident, and visitors. so my wife and daughter went to the citizen line and i went to the visitors line as i was getting close to my turn i started getting nervous i tried to think about other things but wasn't working. then it was my turn the officer took my finger prints and picture then he told me why my family isn't with me. so i suggest you stick with your family if your traveling with them and go to the visitors line even if they're USC. then he sent me to second inspection and was in there for like 10min the officer called me and asked, where did i go, how old i was, and where i worked then he stamped my passport and the AP but he kept both. it was a great relief after that.

my advice is that if you have no criminal history or immigration issue besides unlawful presence but on Daca you should be fine. feel free to ask question i will gladly answer, good luck everyone on this journey!

My experience
Hey everyone i traveled to mexico with my AP and entered the U.S thru San francisco. Heads up !! the first thing you want to do if you have a connection flight is to have it schedule atleast 4 hrs apart because when i got to san francisco they made me wait on a 2hr line for visitors or visa holders, after waiting almost 2hrs my turn finally came up i went up and they asked me for my papers (AP)and passport they also asked me what was the reason for my travel and how long have i been in the U.S and if i go to school or work and i answered all his question and (yes i got a little nervous) after that he took my finger prints and a picture and put a check mark on the immigration paper that they give everyone inside the airplane (make sure you dont lose that) and then he told me to proceed to the back room that they were going to finish filling out my papers , their system was slow i waited almost 3hrs in the back room they said on a good day its usually 1:30 hr but since their system was down i waited more , they called me up took my finger prints and a picture again and they also asked me for my other copy of my ap paper i told him i didnt have it it was in my luggage just incase i loose one ill have the other one , he asked for another Identification so i gave him my driver license and then waited another 20minutes they called me up stamped my ap paper and my passport and tood me to have a good day. Everyone that is traveling you guys will be fine . Goodluck to you guys!

Can I fill it out on my own? What do I provide?
I really want to fill out the application for AP, should I do it on my own or get a lawyer. I have a lawyer who first filled out my DACA, then the last 2 times I filled it out on my own. I want to know what I need to turn in with the application, I have a grandmother who just passed and I have another grandmother who is very weak and it could happen anytime, I don't want to miss seeing her one last time. What do I need to submit with my application for proof? About how long does it take to get an answer and be able to travel?

Thank for all your help.

Delivering AP outside USA after departure
My wife's AP has been approved on Jan 9th but there is no update on production and mailing date. She needs to go see her dad who is hopitalized. We requested expedite required when submitting the documents on Nov22, but did a mistake that we didn't follow up with customer rep. But, I had a letter, supporting documents (health documents) and a note (please expedite- according to information on USCIS) included in the documents.

We called USCIS officer and the only response was 'wait' and the documents should be there within 30 days. I don't want her travel to be delayed.

Is there a risk if she leaves US without AP at hand (but its approved)? I can mail her to documents before she comes back. Also, she has been in US legally under F2 visa and she currently has TPS. There has been no instances of out-of status. Her F2 visa expired 6 months ago but her status has been maintained by I-20 as well as TPS.

Any suggestions - thanks

Help
Hello Everyone,

I applied for Advance Parole on October 13, 2016 with the intention to travel to Mexico and reenter legally. I was told the wait time was set at anywhere from 3 months to possibly more. I was in no rush and we all had no idea the angry cheeto would actually win. Anyway, my aunt who has advanced cancer requested to see me, because in her words she felt the battle was lost. I then proceeded to call USCIS and request that my application be considered for expedited processing. I have this timeline as follows:

12/21/2016

On December 21, 2016, your request to have your case expedited, was completed.
12/19/2016

On December 19, 2016, we sent a response to your request to have your case expedited, referral number
12/19/2016

On December 19, 2016, your request to have your case expedited, referral number, was assigned to an officer for response.

I was told It would take 5 days but here we are 22 days later and my status has not changed from my case was received. I followed suggestions posted by others here, I even sought out assistance from my congressman. The assistant doesn't know how to exactly how to help me, so i have given up on that. My problem is that I am in my last semester of college and the longer I wait the slimmer my chances are of being able to fly out to Mexico to see her. Apart from school I work day and night so once my classes really starts it will be almost impossible to ask for time off. Does anyone have any advice for me? Anything would be appreciated.

Advance Parole
Good afternoon,
I have a questions since I'm starting to get worried.
I applied for my advance parole on November 28th 2016. I got a letter with my receipt information which said that they got it the next day.
Since that they I haven't get any further information.
I am currently living in NC and I applied asking for the days from January 2nd to Jan11th. Obviously those days are gone, but I would like to know your feedback. Like if you apply around the same time and if you have any different information.
Would any of you will still going to your country even after the 21st?

Thank you and I really appreciate it.

Traveled with AP with deportation order
Just wanted to share my experience traveling with AP with a removal order on record. I am a TPS holder. Was nervous to travel on AP because of my Removal order that I received 2004 before i received my TPS status. received TPS 2010. Coming back everything went smoothly. The agent that was checking me and my brother didn't know what AP was so he had someone take my paperwork in the back to verify authenticity he took my fingerprint and pictures verify my address than he told me to hold on. Because the wait was taking a while he had me and my family go get our luggage while we wait. Then we met back with him where they inspect luggages. Someone brought back my paperwork about 15 mins later. While he started entering my info on the computer he received a call from someone that ran my name and brother saying they are good to go. Then he realize he doesn't have the stamp so i had to wait like 20 minutes waiting for him to figure out where the stamp is. While waiting I just asked him questions about the process. He was really nice answered all my question. Basically saying I just need to make sure your paper is stamped to make sure your travel is on record. Then I asked him about traveling again he said you are good to travel again. I asked him will i get my AP paper back he said yes because I will need it to travel again since it does not expire anytime soon. Finally someone came stamped both papers entered my info on the computer and taught the guy how to do it. I traveled with my husband, my three kids age 4, 5, 1 and my brother who also was traveling with his AP for the first time. He gave us both papers back. On the paper he put Paroled in till Jan 2018. I asked him what does that mean he just said that as long as I have the right documents I legally can leave and comeback till then as long as my AP is valid

Advance Parole with I-485 visa pending
My husband was unlawfully present in the U.S....
Then we applied for adjustment of status after getting married.
He also applied for advance parole which was granted.

According to new case law, "Matter of Arrabally," unlawful presence does not trigger section 212(a)(7)(A)(i)(I) - which would make him ineligible and consider his trip outside the US a "departure."

Recently, he did leave the country... (before our I-485 was approved - we are still waiting for the interview)... he was paroled back in the US.

He did have to go into a waiting area... and was there for 2 hours - until his name was called and got his parole stamp.

But things worked out fine! We were worried that the new case law was not reflected on the USCIS website... but a few blogs and articles mentioned that the website was outdated.
