Very cool H1-B stamping in Chennai
Hi All

I would like to thank this forum for mentioning various useful hints and it helped me in preparing a checklist and having everything in place. The entire H1-B stamping was very cool except the long waiting hours for my number to be called. The visa officers were very cool and friendly. (just before my stamping, she rejected a F1 and L1 visa) This is my second time H1-B stamping. In my case, i came to US with employer A and changed to employer B. Had all the papers from employer A as well as employer B. Here is the interview transcript with the officer.
Officer: You'd been to US quite a few times..hah...
Me: Yes
Officer: Have you already started working for employer B and how long?
Me: Yes and last 7 months
Officer: Are you here in India for a vacation?
Me: Yes
Officer: Can i see the company letter and your degree certificate?
Carefully read that and she said my visa is approved and i can go and pay the fees.

Some of the companies provide the information such as the request for H1-B visa to the consulate and describe the roles and responsibilities in detail in the same letter or multiple letters. It is imperative that we read the contents and provide the approrpriate information (in my case the TT Services rep was expecting multiple letters whereas to me it was in single letter. Itz upto us to explain even when some of the things are being overlooked by the TT services persons)
PS: The same day, i did notice that most of the H4-B was approved.
So be cool, prepare a checklist and make sure all the documents are there, and run through all the documents once to make sure the contents mentioned in such documents are accurate. Don't overlook anything!

H1b Visa interview
Hi All,
I have to attend visa interview on 22nd June.
I have all the documents genuine and here before I have travelled to US (B1 for 2 months) and UK (b1 for 1 month). The only problem with my document is that I dont have a proper exp and releaving letter from my first employer as I left the company without notice. I worked there for 2yrs. Before leaving that company I had taken a letter from stating that I m working there for 2yrs but thats not the exact exp letter. Will this be a problem in interview? I will really appreciate any comments on this matter.

H4 refusal 212(a)(6)(C)(i)
Hello Everyone,

I have a 212 (a)(6)(C)(I) black mark on my Passport for H4 VISA recently based on my previous H1B rejection in 2001 So I am unable to get a Visa for US. The only way of getting a US Visa is to get a Waiver ineligibility legally under section 212(i) of INA (Immigration and Nationality Act) proving that Consular officer improperly considered applicant’s underlying fraud as an adverse factor in denying H4 VISA. I am trying for the same. But I am helpless in this regard.Let me explain U my case what was happned at Chennai consulate.

My wife got H1B stmped on 26th May thru Satyam Computer Services, even me too attended simultaneously for H4, unfortunately I got a QUERY on my H4 for the reasons of my previous H1B rejection in May 2001 coz of FAKE experince, hence they treated this as mis-representation of material facts and put a query under section 212(a)(6)(C)(1) of US Immigration Act, asking me to submit supportive documents, later on I got an invitation from American Consulate General-Chennai to reappear for an interview, I did attend interview on 3rd June by submitting all the supportive documents, but again they told me the same old story....my case is been sent to Washington for some clarification, they need to get some clarity on this issue to waive of ineligibility, even he told me that there might be a 50-50 chance of over coming the issue as per the section mentioned above, later on I got a reminder for final appearance based on that I did attend on 13th June, but this time they blutly refused my VISA based on my previous rejection, But this time I've produced all the genuine documents for their reference sake and they didn't even bother about my current documents and they didn't even allow me to explain my purpose of visit.further I want to know that the reason of H4 rejection under "If the visa is denied under the section 212(A)(6)(C), is there a way to reapply for the visa so that the person can prove that his visa was denied for wrong reasons and he had not misrepresented any material facts related to his current visa?"

If any one of you have similar experience, please let me know what is the method followed to get a US visa

Got my h1b Visa
Hi All,

Nice to see a forum like this. I had a very good experince using this website. I collected a lot of information from this websites. I prepared for the visa such a way that i use to read the questions asked for 221(g) rejection & then see what went wrong with them to give that. I also had a good check list with me. Even i got 221(g) when i attented first time. So don't get panic if you get 221(g).
Th check list which i had is listed below.

1) Your passport ( Copy of all pages)
2) All experience letters, offer letters
3) Your latest resume/Covering letter
4) Your present company ID card & Inside / Outside photos of your present company (better color Xerox of ID card)
5) All educational certificates ( from X class onwards) including all mark sheets, provisional certificates, Degree certificates etc (color Xerox of Degree certificate)
6) latest 3 months payslips
7) 4 photos ( 50mm X 50mm size)
8) Bank statement, where your salary is getting credited
9) DD's for Rs.4400 & Rs.2200 infavour of " American consulate general, chennai"
10) DD for Rs.441 infavour of " TT services, chennai" ( You can pay this amount by cash also in consulate)
11) Your web appointment for consulate print out
12) All the required documents for any non-immigrant visa Plus
13) I-797 -- the original notice of approval,
14) The complete I-129 petition submitted by your prospective employer including the Labor Condition Application
15) Letter from petitioning employer confirming employer's intent to hire the applicant
16) US company information: photographs of the inside and outside of the company's offices (provided by the employer), prospectus, brochures, and annual report
First time applicants may consider submitting the following documents:
• Names and current phone numbers of the personnel managers at the applicant's present and past jobs
• Names and contact information of two co-workers from your current or most recent place of employment
• Names and contact information of two co-workers from past jobs

When i went first time they asked me the below questions.
First consular officer asked me to give my 1797,129,LCA. He had a detailed look at that. Then he asked my degree certificate & gave back to me. Then asked me the following questions.
1) Why you want to go to USA ( i answered properly)
2) Which client you are going to work
Here it went wrong. As my consultant had asked me to tell that as per our company terms client will be decided once to land in USA. I told the same to the officer. But he is not ready to belive that.
Then he started advicing me that it for my safetly that i should make sure you should have a clinet & min of 12 months of work. As i should not wonder accross in USA without a job.

Then i understood what he said.

They were asking these below papers.
"A. You may appear for an interview with a consular officer on any Tuesday,Wednesday, Thursday form 9.00 Am to 12.00 noon.

If you bring this letter you do not need to make an appointment through TT Visas.

1) A detailed description of the petitioner's needs for this position and how the beneficiary worker intends to address them. Provide specific examples of how the person's skills match the petitioner's needs.

2) Interior and exterior photos(15) of the petitioning employer's work premises and of the work premises where the H/L worker is/will be deployed to be provided by employer(Visa officer specifically wrote - Include client site)

3) Provide a detailed and specific account of how the H/L worker will be employed during the next 12 months. Be sure to specify location, client, and client contact information, nature of the project and duration of the project(Visa officer underlined these words - location, client & client contact information).

4) W-2 forms for all people employed by the petitioner for 2004 and dates of their joining.

Again i went on June 15th 2005.

I gave all papers required by them. Then he din't ask any questions. He said you can pay the fee & get you visa & work in USA. So when you face the officer be cool, give hima good smile & attend with confidence. So he doesn't think that you are trying to hide something from him.

Regards
Anand
