H1-B visa Renewal criteria
I was issued H1-B Visa on 03 Jul 2007 which was valid until 15 Sep 2010. My employer filed a petition for my H1-B extension for three years which was approved on 01 Sep 2010 i.e. before my visa expired. The new I-94 which came with the approved petition allows me to legally stay in the US until 15 Sep 2013.
 
I wish to visit India and apply for a H1-B visa in Mumbai towards the end of October. Though the H1-B visa stamped on my passport has expired more than 12 months ago, since my H1-B petition is an extension of my first H1-B petition and I still have a valid I-94, will I be considered eligible for a visa renewal?
 
Also since I live and work in the US on H1-B what address do I feed in the DS 160 form - my home address in India or the one in US?

Any responses will be appreciated.

Anyone help me on this?

In the Visa letter, US Immigration office told that they notify New Delhi Consulate, but I am from Chennai region. Can I get appointment at Chennai US Embassy or since they already notified about this to new Delhi, so I have to take appointment at New Delhi only.

Please any one have any idea on this, then let me know,

4. Show me the letter that your Employer sent to USCIS?

7. Show me the LCA & I129 forms?

That's all. I got my VISA.. :-)

H1B stamping at Frankfurt
Hi

I had a H1B stamping done recently at Frankfurt Germany recently. sharing my experience below:

I came into country on L1B later changed to H1B status. I work for a big US based Manufacturing MNC as a full time employee. I had to travel to Germany on a business trip, so had to go for stamping to be able to re-enter.

Much in advance my attorney wrote a query to the US Consulate in Frankfurt asking if a non-german is allowed to attend for the visa interview in Germany, the answer was very diplomatic. Though they did not deny, it was not very encouraging. We toyed with options of taking it up in Frankfurt vs going to india after the business trip in Germany for stamping. Could never reach at a clear conclusion, I just thought I would take the risk by attending in Frankfurt & see my luck.

So finally I was at Frankfurt consulate on 20th Sept for stamping. At the main gate there is a counter for checking the appointment letter & passport, then I passed through the security check to enter the main building.

In the main building when you enter there is a reception desk, where the receiptionist would give a token number for waiting & hands over a small flyer which specifies the order in which the documents must be sorted before we go to the interview window.

When my number was flashing on the screen I walked to the counter. A lady was sitting in the counter, who checked my Appointment Letter, Fee paid receipt, Original Petition. She asked if I am resident of Germany, I answered No.
She then asked for my CV. (Surprisingly CV was no where in the list of documents needed as given by the Consulate. I gathered my CV as part of my documents - as this was suggested in Immihelp! Thanks to Immihelp).

The Lady took the documents, marked on my appointment letter that I am on business trip to Germany. She then said to wait again to be called at another counter for main interview.

Now the real test begins!
I approached the main counter when my number was called. Below are the questions asked;

VO: Why you want to go to the USA?
Me: I am working for xxxx company & am here on business trip, I need to go back once I complete the visit here.

VO: Since when are you working for xxxx?
Me: Since <Date Yr>

VO: Sorry from when?
Me: <I again repeated my date of joining>

VO: Is this your 1st H1B stamping?
Me: Yes

VO: So why you came to this consulate if this your first H1B, why not to your home country or any other consulate?
Me: I am had to travel to Germany on business to our plant at <place name> on an urgent visit. So, I approached here.

<<At this point he looked very hesitent to accept my application. He did not like proccessing my application for sure. He took a long pause before going to the next question>>

VO: <Was asking about my company products, if we have discounts>>
Me: I explained on the products and discounts we get.

VO: Ok, I am approving your visa, you will receive the same in 10 working days.
Me: Is it possible to receive it personally, as I dont have the Germany visa for a limited time?

After this there was some drama. Initially the VO said, it is possible to pick up after 3 working days.
The he said....he has some more questions!!!!
This was a blooper!

The VO questioned about my field of study in Masters & was very particulat if my education had a particular subject. I guess he wanted to make sure if it falls under TAL, not sure.

After this he again said my visa is approved & handed over me a slip to show after 3 days at the front counter to pick up the passport.

That was it, I walked out.

I picked up the passport after 3 working days & travelled back to US. At the port of entry the officer asked my role in the company & asked a bit about my job duties.

I must say going through all the postings in Immihelp really helped. Particularly in preparing the necessary documentation. Thanks to everyone contributing to this forum.

H1B Visa
Hi All,
I have completed my masters in Business Administration and been working on my OPT from one year. I am working as an WMQ Administrator. I have applied for H1 B from my new employer as i have some issues with Old one. Within a week i got a letter from USCIS asking for several documents under RFE. My employer sent all the documents requested and waiting for the approval.

Now the problem is " I need to go to india within a month from now for my wedding. My Husband is in US and he is on h1 B and waiting for his greencard Priority dates. At that time i need to go to the Visa Stamping as it is the first time visit after H1 b approval.I am tensed about 221 G form.

I still have F1 Visa valid till Dec 2012. Can i get admitted to university and get the I 20? If i get the I 20, can i return to US without H1 B Stamping from Home Country. Please advise.
