visa approved and then denied after 2 days
My VISA was approved by the the consulate at MUMBAI, and she kept my passport with herself. 2 days later when I recieved my passport by courier, i found that they have denied it under section 214(b). How is it possible, If they had any doubt about my social and economical ties, then would have asked me for the same at the time of interview or else they would have rejected my VISA on the spot.

Visitor Visa granted for my in-laws on their 2nd attempt
B2 visa - Telugu appointment - Hyderabad

I am very much thankful to immihelp for their extensive guidance on the visa process, guidelines, document templates and experiences.
My in-laws had their first visa interview 2 months back and it was rejected under 214(b). Very few questions asked like
1. Why do you want to go to US?
2. How many children do you have?
3. Where are they?

We have been nervous when my in-laws went into the consulate for the 2nd time. Their telugu interview was at 9:15 AM and were allowed in by 8:45 AM, and they came out at 11:45 AM. The reason it took more time is because of the new fee increase they had to pay for which it consumed 1 hour.
When they approached the consular officer, they faced the following questions
1. What does your son-in-law do?
2. What does your daughter do?
3. How many children do you have?
4. Where are they?
(He asked Q. 3 and 4 twice - not sure why he did that)
5. What do you do? (business and farming)
6. How much acres of land do you own? (asked twice)

>>Your visa is granted. We are yet to know the validity period of the visa. It was a big relief for us.

B2 Visa Self Sponsor
Hi,
My parents would be applying for B2 visa soon. I have asked them to answer the question in the form 'Who will be paying for your trip to the USA?' as 'Self-Sponsor'.
I'm here on L1 visa.What all documents should I provide them with. Even if they are self sponsoring, do i need to provide the Affadit of Support form I-134 and bank statements. Please let me know asap as i need to arrange for their interview in two weeks time. Thanks.

B2 Visas
B2 Visa

B-2 Visa is required by people who want to travel to U.S as travelers. The maximum period of stay is 6 months in any particular year.
For Ex: A 10 year B-2 Visa grants you to stay for (theoretically):
6 months in year 1
6 months in year 2 (Please don't repeat this every year, you will have problems)
6 months in year 3
................
......................
.............................
6 months in year 10.

B-2 Visa comes under the category of Non Immigrant Visas which means, the candidate applying for it, has no intent of immigrating to the US.

Visitors from most countries are required to appear for an in-person interview at the U.S consulate corresponding to their dwelling.

People Travel to U.S mostly during summer (April-October). It’s advisable to have an appointment at the consulate as early as possible.
 
About the VISA Officers

The VISA officers interviewing the candidates go through a rigorous training offered by the U.S government. After successful completion of their training they are assigned to work at different embassies around the world. In some cases, the spouses of the VISA officers also work in the same embassy. They may interview candidates or perform other duties at the embassy.
 
Generally the Embassy personnel are acquainted/ trained with different cultures of the world. They also learn a lot through their interactions with people from different nations.

Every visa officer learns about the psychology of the Visa seekers by interviewing different candidates for U.S Visas. This learning process provides the Visa officers with a fair idea about a potential candidate’s motive.
 
Since they are human, it is possible they can make mistakes and reject Visa’s for able candidates which are rare.


Multiple short trips in one year may result in serious consequences like denying entry to U.S, warning or strict cautioning, reducing the stay time in U.S.
A pointer about the psyche of the American Visa Officers.
• They don't forget liars(database has information about lying candidates).
• They don't forgive liars, cheaters who lie and cheat on their visa application form.
• They can sense fear (if you watch any Visa interview closely you can figure it out).
• They don't like their decisions questioned(if your visa is rejected keep quiet and get out, any abusive action goes into your record and can be used against you, just like a U.S cop giving you a speeding ticket, take it and don't talk unless asked for).
• They make quick decisions.
• The can judge people quickly.
• They are honest gatekeepers to U.S entry and act in the best interests of U.S and not the Visa seeker.
• They make correct decisions most times.
• They are fair and balanced (unless you misbehave).
 

Reasons for Success in B-2 Visa Interview


The following are some of the reasons why a candidate may be successful in getting an B-2 Visa in an interview
(1) Candidate was truthful and confident in his/her answers to the interviewing officer.
(2)Candidate has a good, valid and truthful reason to go to U.S (Most Valid and Correct Reason is: Tourism and visiting the kids).
(3)Candidate has sufficient ties (and he must convince it in his answer to the consulate officer) back home which prove that he will return back within 6 months.
(4)Candidate has a good idea about where he/she will stay in US.
(5)Candidate has got sufficient money (property, Bank balance) in his home country to show that he is not so poor as to settle in U.S for a better living and candidate did not appear hell bent on getting a VISA to US.
(6)Most important: The VISA officer is convinced that the candidate is truthful and sincere in his answers and he (the candidate) really wants to visit US for tourism and not for doing nanny work or petty jobs for his kids or relatives(remember this is B-2 Visitors visa not a work visa).
 

 
Other factors that can dictate the B-2 Visa acceptance/rejection
 


(a) The VISA officer’s mood depending upon the previous candidate’s behavior.

Generally there are some people who are hell bent on getting a VISA. So if they are rejected a VISA they stand in front of the officer and do crazy things, like banging on the glass and shouting loudly asking for an explanation of the rejection. Basically he/she is not only spoiling his/her chances of getting a VISA but also of the other candidates who are standing behind him/her.

Again the VISA officer’s are trained to handle such scenarios and not to make the VISA decision for the next candidate based on the previous candidate’s behavior. But there is a small (minute) possibility that he/she is upset (since they are human).
 

How to avoid the above scenario?

First don’t behave like the above mentioned candidate yourself. So you leave yourself another shot at the F-1 Visa. Secondly if you are behind such a candidate in the Queue, just try to be cool and calm, and try to smile and wish the VISA officer in a courteous manner and answer the questions without stutter and slowly so that the officer can understand you.

(b) The VISA officer determined that you are lying.

Like you mentioned on the application that you will stay for 5 months
Let’s consider the scenario below
 

VO: How much time do you want to stay in US?
Candidate: 2 months,

VO: In the Documentation you provided why did you mention that you will stay for 5 months???
Candidate: YYYY YYYY YYYY XX

Please read your documents and applications properly to see what is in there. Do not just say anything.

Ok. This is one of the exhaustive list of scenarios in which people who lie or do not prepare properly will be caught.
So Please read your documentation, prepare using mock interviews, ask others whether your answers seem reasonable enough so that the other person can believe you.
 

(C) The VISA officer determined that you do not have sufficient ties in your home country so that you will stay back in US.

How will he/she determine that?

(a)Generally from the way you answer his questions, he will see how strong are your ties/relations in your home country like unmarried daughters or sons, mother, father, relations and how tightly bound is your family and how dependent are they on you, so that your absence for a long period of time from your home country is going to effect the people dependent upon you and you have a really valid reason to return back to your home country rather than staying back in US lured by its quality of life/money.


(b)From the financial documentation you provide, if somebody has provided documentation that he has xxxxxxx amount in a co-operative or a private financial institution of questionable repute, then the officer may conclude that you don’t have sufficient finances. It’s better to have your amount in a nationalized bank of repute and use the statements from such banks.

Similarly if you don’t provide your bank statements from at least the past six months, the officer may conclude that you borrowed the money from somebody to con the visa officer and he may reject your visa. Always better to have sufficient proof that the money is yours and not somebody else’s. Need for proper and perfect documentation.

Always make sure that all the houses, lands, other properties you have is well documented and accounted for in your financial documentation and it is always good to go though that information before you attend the interview. The following will show you why

VO: So it seems you own a lot of property in the documentation you provided (looking at 3 houses, 2 lands)
Candidate: Yes we have 2 houses in a and b and 5 lands at b, c, d, e, f.
So there you go, always look into the documentation you provide, see what you have, don’t bluff.
 
(d) The VISA officer doubts based on the way you speak that you will stay back in US.

If you cannot express properly in English, please consider taking an interview in your native language where you can express yourselves better and give the visa officer a clear and truthful idea of why you want to go to US and why you will stay there legally and why you will return back to your home country. Again expressing yourself in a clear and concise manner not over dramatization.

Always give truthful answers. Do not hide any information from the VISA officer. Telling lies will permanently jeopardize your chances of getting a visa. VISA officers have sufficient documentation of your past visits as well as the person whom you are visiting in US to determine whether you are lying or not.

Several people secured visa after 3 to 4 attempts. Don’t lose hope and try truthfully and make sure the visa officer believes you.

(e) The VISA officer determined that you are shabbily dressed and undisciplined.

Irrespective of which country or culture you are from, if you are attending an interview dress properly.

(f) Communication problem with the VISA officer.

American accent is unlike British accent. Americans have a slang of their own. It will sometimes be difficult to understand the VISA officers even though you have been communicating in English in your native country. Please book a visa interview in your native language since you will be most effective in communicating for the VISA process.
 
Again some people might be good at speaking and understanding English and fail at the VISA interview. The main reason being the American accent. So better get used to American English by watching news channels from US like CNN, ABC, etc.


The following causes are never a valid reason for traveling to U.S and please avoid giving such reasons to the consular officer expecting him to sympathize with you.

(a)Our daughter is pregnant so we are going to U.S to assist her.
(b)My son/daughter is sick or has been operated so I am going to U.S to assist him/her.
(c)We have a newly born grandkid, so we are going to U.S to assist my son/daughter to take care of him.

All the above reasons are Straight Forward Reasons for Rejections: B-2 Visa is a visitors Visa. Irrespective of what you think (Social responsibility, Culture, moral responsibility) going to U.S on such pretexts is not valid in the Consular Officers eyes. No sentiments please. Please have a valid reason for obtaining a travelers Visa.

21. Give valid answers appropriate to your situation since, most of the candidates at the interview might have utilized answers from the web. This makes you repetitive. Use your intelligence. Take the guidance from the websites not the answers.
22. Never ever threaten the VISA officers.
  Remember: U.S visa officers don't care what/who you are, if you try to show attitude they will promptly reject your VISA. U.S Visa is a privilege not your birth right.
